Jury seeks clarification in Y2K plot trial
Haouari By Phil Hirschkorn CNN Producer NEW YORK (CNN) A federal jury of nine women and three men has asked the judge to clarify the central question as it deliberates the case against Mokhtar Haouari, an Algerian-born Montreal shopkeeper who is accused of aiding a plot to bomb Los Angeles International Airport around New Year's 2000. Hours after beginning its deliberations Thursday morning, the jury sent a note asking U.S. District Court Judge John Keenan what direct knowledge of terrorism is required to find Haouari guilty. Haouari, 32, is charged with two counts of assisting fellow Algerian national Ahmed Ressam, 34, in a plan to detonate a suitcase bomb at the Los Angeles airport. Ressam, who testified as a government witness in a deal to shorten the jail sentence from his April conviction, said he never explicitly told Haouari the purpose of his trip to the United States, but described it as "important and dangerous business." London-based Algerian charged in Y2K bomb plot

By Phil Hirschkorn CNN Producer NEW YORK (CNN) Federal prosecutors in the United States have charged an Algerian man identified in a just-completed trial and in court documents as a terrorist cell leader based in London. British police arrested the man, Haydar Abu Doha, 36, on a U.S. warrant charging him with conspiracy to use weapons of mass destruction for an alleged role backing the foiled plot to bomb Los Angeles International Airport around New Year's 2000. Attempted millennium bomber Ahmed Ressam the claimed lone executor of that plot has named Abu Doha as a gatekeeper to Islamic militant training camps in Afghanistan, where Ressam testified he underwent months of firearms and explosives training in 1998. Texas Congress has a 1999 bill that will limit liability and/or establish statutes of limitation for Y2K problems. U. S. Congress has a "Y2K ACT" that establishes a S/L to end 2/1/2002S.96, by Sen. McCain. The House has a "Year 2000 Consumer Protection Plan Act of 1999" that is sponsored by Rep. Donald Manzullo, R-IllH.R.192.

    Y2K AND MARTIAL LAW "Martial Law" sounds so conspiracy theory-ish that many dismiss the whole concept out-right after hearing the term. Let's establish an objective definition for the term 'martial law.' According to Webster's Third New International Dictionary, 'martial law' is:
  • "... the law based on necessity or policy that is applied to all persons and property in occupied territory during invasion or occupation and is executed by the military authority of a belligerent acting directly or through civil courts;" or
  • "... military rule exercised by a nation or state over its citizens or subjects in a situation where they are not legal enemies and when an emergency justifies such action."
    The Duke of Wellington's definition is more concise: "Martial law," he told the English Parliament, "is neither more nor less than the will of the General who commands the army. In ¦act, martial law means no law at all." It doesn't matter what you call it, it's still the same. Y2K (naive) optimists and virtually every PR assurance routinely claim the following: There's not going to be major power outages. There will be no food shortages. Telecommunications will work just fine. Everything that matters in the U.S. will be repaired. "We're well on our way".

Y2K will reveal whether the stress of chaos, combined with the lethargy of the people, the corruption of the elite and the generalized "squalor of our age" as the liberal Anthony Lewis put it, will be enough. Enough to end the grand experiment in liberty. Enough to end the journey towards liberty and the pursuit of happiness. Enough to extinguish the lighthouse of liberty and replace it with the energizer bunny battery powered version. Read Larry Sanger's excellent editorial "Y2K in our Decadent Age" for some insight into why Y2K has the potential to take our whole social system down. I believe it was the Frenchman Alex de Toquettle? "Democracy in America" that makes the claim-paraphrasing here-If things get bad, the Americans will tear themselves apart. The founding father's understood that government was not the benevolent nanny of our modern age-Big Mommy instead of Big Brother. They sought to base a government upon the self discipline, moral character and local control of the people. They sought to base the economy upon the time honored truths of gold and silver backed currency. They specifically forbid a standing, professional military, excessive foreign entanglements, a central bank and a large centralized federal government. In other words, the exact opposite of what the United States enters Y2K with. For all intents and purposes, the United States has suffered a constitutional coup de etat and the populace is too ignorant to understand what happened.

    Fall 1998 The Y2K claims and losses can occur in a wide variety of circumstances, for example:
    • Bodily injury resulting from the failure of electronic safeguards utilizing intelligent chips with the Y2K error;
    • Claims from shareholders based on the failure to disclose that the business would not operate properly or a failure to disclose the costs required to repair the Y2K problem;
    • A claim against hardware/software manufacturer for selling defective hardware or software which, in turn, caused the loss of income to the customer; or
    • A claim against consultant for negligently recommending hardware or software which was not Y2K compliant, resulting in an economic loss to the customer.
    Just as there are a variety of circumstances under which a claim or loss relating to the Y2K problem can occur, there are also a variety of types of insurance coverages available in the United States. Since the terms and conditions of these coverages vary substantially between insurers, and since the applicable law often varies by jurisdiction, this article must, by its nature, be somewhat generalized. This article will focus on five different types of coverage, at least four of which are currently owned by most businesses. However, before proceeding into a discussion of these types of insurance, a specific exclusion must be mentioned.

    Bank Imposters Can Prey on Your Clients
    Lindsay T. Thompson , a Seattle solo practitioner (and member of the Washington State Bar Board of Governors) forwards a recent Y2K advisory from The Commerce Bank of Washington , reminding customers that Y2K may generate more than just computer glitches. "Concerns about possible Year 2000 computer problems present opportunities to defraud customers of banks, thrifts and credit unions," cautions the bank. The advisory suggests it's a good idea to warn your clients to be on the lookout for individuals posing as representatives of credit card issuers, who call cardholders requesting confidential information such as account numbers. For example, some scam artists tell customers that their cards won't work after 1/01/00 unless they attach a new magnetic strip to their cards. Other cons: individuals who call customers and ask them to transfer money from existing accounts to "special Year 2000 safe accounts." Key Web sites:

    The culture of litigation
    What's it about? Recently the author received a letter from his friendly local Council Officer. To make a long story short, I was informed that the roots of a tree in our front yard had allegedly dislodged a section of footpath. And just to make the point in demanding payment to cover the expense, the Council claimed that any injury suffered by a pedestrian as a result of the broken footpath would be the fault of the property owner (myself) and could land my family in court with a hefty personal injuries claim to settle. I was not amused, as you can imagine (not the least because the letter was dated 31/12/99 and the Council offices had already closed for a number of days). I immediately wrote back with a little legal analysis of my own. Yes, I agreed, it may in fact be dangerous, but since I was quite prepared to pay for the rectification of the problem, and authorised such in my reply, the ball was most definitely in their court. As I had no legal recourse to barricade the offending public area, I suggested that they do so or fix the problem forthwith (a month later I have not even had the courtesy of a reply, let alone any remedial activity in front of my house). The fact that nothing has been done might suggest that the threats of looming legal actions were the stick with which to obtain my payment for the work.

    Gary North is one of the major writers and publishers of the Christian Reconstructionist movement. (He is the son-in-law of R.J. Rushdoony , one of the movement's founders.) Christian Reconstructionists are postmillennialists , meaning they believe that Christ will return to earth only after conservative Christianity has become the religion of the majority of the planet with God's moral law as the civil standard for society. They believe that Old Testament moral and civil laws, such as those against adultery and sodomy and murder, should be presumed binding unless the New Testament says otherwise; this belief they call theonomy. Theologically, Gary North is a Calvinist . He is President of the Institute for Christian Economics , which now publishes Christian Reconstructionist books online. Christian Reconstructionists are also presuppositionalists in their approach to christian apologetics as taught by the Calvinist philosopher, Cornelius Van Til and oppose any natural law theory as a basis for civil law order.
