Mitigation..and then Litigation?
One of the realities of the year 2000 issue is that there is a great potential for lawsuits. In our increasingly litigious society the often-quoted prediction of a decade of litigation after January 1, 2000 seems believable. This possibility has not been lost on companies; and there has, therefore, been a reduced amount of information companies have been willing to make available on product readiness. Maybe things will change.
The New Law
In October, President Clinton signed a new law called the "Year 2000 Information Readiness and Disclosure Act." One of the intentions of the new law is to promote disclosure and exchange of information regarding year 2000 issues. To accomplish this, the idea is to raise the bar (no pun intended) for the use of year 2000 statements as evidence in a law suit, so long as certain legal tests are met. There are various exclusions and provisions of the law, and only a couple of them are covered below. When it comes to checking for Y2K compliance, now is better than the next century

He can be reached on the Internet at dteshima @netcom.com Some predict that the year 2000 (Y2K) problem will bring disaster. Others label it as a bogeyman in the service of technology consultants. To many lawyers, Y2K appears distant, remote, and trivial compared to the daily demands of judges, opposing counsel, and clients. Besides, most law firms do not employ mainframes-the computers most susceptible to the problem-but instead primarily use recently purchased personal computers and software. What if, however, a fraction of the predicted Y2K problems occur? Then attorneys could have a major and long-lasting office hangover after January 1, 2000. Besides computers and programs, Y2K can affect such office systems as telephones, voice mail, automated security, elevators, and anything else that relies on a microchip. For this reason, the estimated cost of dealing with Y2K in Europe and the United States is now $858 billion. Ignoring Y2K could have catastrophic consequences for a lawyer's practice. Y2K is one deadline that even judges cannot extend. A lawyer can, however, start debugging today. The Date Set Test A dramatic Y2K problem will occur if a computer's clock and operating hardware cannot recognize the correct date after December 31, 1999. Most applications rely on the computer's internal clock for the date and time. For example, if the operating hardware gives erroneous or unreadable date and time information to a calendar and datebook program, it will not work properly. Although most computers sold within the past three years do not have this problem, the average older PC-especially one still running DOS-may.

It seemed prudent in the first six months of 1999 that law enforcement concentrate its Y2K efforts on ensuring that internal and external computer breakdowns, power outages or the loss of 911 service did not — metaphorically speaking — hold any city hostage. From Appleton, Wis., where officials had drawn up a contingency plan closely following guidelines set by the Federal Emergency Management Agency, to Lubbock, Tex., which organized one of the nation’s first Y2K civil defense drills, police agencies were preparing for the infrastructural problems that forecasters believed would be the major nightmares associated with computers unable to make the transition to the year 2000.

The Near Term Future of Law Enforcement

As we ease into a new century it is a good time to look at some trends in our society that are impacting law enforcement organizations and operations. As you know in a fast changing society, predicting the direction of trends is about as difficult as predicting the weather. However, if we limit our observations to the next few years, there is reasonable possibility of being accurateprovided that nothing unusual, unpredictable, or disastrous happens. The best prediction I can make with assurance is that several unforeseen events will occur which will alter the course of current trends.
The purpose of this article, however, is not so that you can plan department strategies. Rather, its aim is to help us recognize the law enforcement issues that we need to discuss, observe, and more accurately identify. It is through the process of observation and discussion that we will more clearly define pertinent issues. At that time, we can then begin to devote appropriate resources to either blunt a negative trend or take advantage of a positive one to strengthen our operations and streamline our organizations.
Overview
Our increased professionalism in the past century is further evidenced by the significant elevation of employment standards; establishment of quality recruit training programs throughout North America; and the employment of a significant number of minorities. We have embraced new management techniques, modernized department management and operations through the use of high technology, and developed incredible new investigative techniques. We have reduced the number of the incidents that invite excessive force complaints and made strides in developing ways to control violent people without the use of deadly force. These are but a few examples of how our law enforcement agencies differ from those of a century or half century ago. By any professional standard, the record is indicative of how we have made significant progress.

Y2K Disclosure Law Starts Info Exchange

Now that President Clinton has signed into law the Year 2000 Information Disclosure Act, companies can begin openly sharing information on fixing the Y2K software problem. However, it is important to understand first what is and is not covered by the law.
Enacted Oct. 19, the law is designed to promote the exchange of year 2000 information among companies, their customers, vendors and even competitors by reducing the risk of lawsuits arising from inaccurate Y2K information. The law also creates an exemption from antitrust laws for year 2000 information sharing activities.
The act provides limited protection against using year 2000 statements in litigation, but it will not reduce the underlying liability that may arise from actual year 2000-related failures.
The legislation also will not reduce liability for violation of disclosure requirements imposed by federal and state securities laws.

    Stephen Brock is senior litigation associate with the law firm of Christie, Pabarue, Mortensen and Young in Philadelphia. Brock has been doing a lot of thinking about the issue of e-mail confidentiality as it relates to internal discussions on the Year 2000 problem, and we picked his brain for some warnings and legal problem-prevention techniques. "The background is really very simple," Brock says. "Every company must address the Y2K situation and, in doing that, they don't want to create another problem or potential liability for the company. The Y2K problem is unique because everyone knows it's coming and there is debate about the extent of the potential liability. Some figures go into the trillions of dollars. While no one can really know what the true cost of fixing the computer systems will be, it's projected that the legal issues, the product and corporate liability litigation, will be an even larger potential expense. "Put those two things together and you can see that we have a double whammy. With the liability of Y2K and the casual nature of e-mail, companies can face serious threats to their viability. Executives must take steps to be sure their employees at all levels treat e-mail correctly and keep them confidential."

    ON Y2K AND LAW ENFORCEMENT
    WASHINGTON, D.C. - U.S. Senator Chris Dodd, D-Conn., Vice-Chair of the Senate Year 2000 (Y2K) Committee, today announced that Chief John S. Karangekis of Wethersfield, Connecticut, would testify before the Committee's hearing on the impact of the Y2K problem on law enforcement on Thursday, April 29. Karangekis, who is also president of the Connecticut Police Chiefs Association, will speak to the challenges local police forces face in addressing potential Y2K problems, particularly in the areas of vendor services and the need for national outreach on Y2K issues to local police departments.
    "The Y2K problem has the potential to hinder the ability of the brave officers who protect our families from doing their jobs," Dodd said. "We cannot allow a lack of awareness about the Y2K problem or a lack of resources to address it to compromise public safety. I welcome Chief Karangekis' insights into how the Y2K problem may affect cops on the beat. "
    The Y2K-readiness of the nation's 911 systems will also be addressed during Thursday's hearing. At issue is the vulnerability of Public Safety Answering Points (PSAPs), which receive 911 calls. While people in distress will be able to reach their local police or fire department, response times could be slowed as a result of Y2K failures. No national organization oversees PSAPs and as such little information exists about their overall Y2K-readiness.

    Ten Ways Y2K May Affect the Legal System

    by Dennis Kennedy '80 All New Mexico state courts will be closed the first week of January 2000. The reason: concern about the Year 2000 (Y2K)* problem and the desire to have a whole week to track down problems, test systems, and get everything in order before opening the court system to the public. Alarmist? I don't think so. January 1 is a Saturday and already there has been plenty of talk of declaring Monday, January 3, a federal holiday to give technicians three full days to battle Y2K before trying to carry on life as usual. The story of the Y2K problem has been its expansion into areas such as PCs, Microsoft and other common software products, and microchips of all kinds. The approach of the New Mexico court system is a sound one in light of the potential problems the Year 2000 could cause in our legal system.
