Y2K SUIT MAY BRING EARLY TEST OF NEW FEDERAL LAW: A millennium bug defendant says the case of allegedly fraudulent advertising for software belongs in U.S. court. By Craig Anderson/Daily Journal Staff Writer In the first-time attempt to invoke the recently signed federal law limiting year 2000 lawsuits, a group of national retailers accused of unfair business practices for selling software that might not work properly next year has removed the class action complaint to federal court. "We think it will get a closer look [in federal court]," Phillips said. "It clearly falls under the [Y2K] act." The Y2K law, approved after intense lobbying by the software industry, mandates a 90-day cooling off period to give defendants an opportunity to correct any problems before litigation can be filed. Phillips said that clock should have started running Thursday, when the case was removed to Federal court. Jones said Staples' removal of the case to federal court is a bid for tactical advantage in the ongoing settlement discussions.

    Waiting to Trap the Unwary Attorney By Marc S. Friedman, Esq. and Lindsey H. Taylor, Esq.
    It is September 15, 1998. Mr. Jones walks into your law office, complaining of a serious injury resulting from an automobile accident which occurred two months earlier. Since the extent of the injury will be unknown for some time, you note in your computerized docket system that the suit must be filed by July 14, 2000 when the two-year statute of limitations expires. Unfortunately, however, your software is infested with the so-called "Millennium Bug" and, as a result, the statute of limitations is missed. Malpractice? You bet. Here is another example. Acme Corporation asks you to review a preprinted software license agreement which it received from FutureWare Company. According to the FutureWare salesperson, the new software is "Y2K Compliant", which means that it will continue to work properly after January 1, 2000. You advise Acme that the license agreement looks pretty standard, although it contains no such warranty. The agreement also includes standard language excluding all warranties except "90 days parts and labor." Regrettably, the software doesn’t work after the turn of the Millennium. Malpractice? Probably. Many attorneys believe the looming Year 2000 Crisis will be the next legal "gravy train", on a scale comparable to asbestos claims and breast implant claims. This may prove to be a correct assessment. But as the foregoing examples illustrate, the Millennium Bug could bite many attorneys with malpractice claims against them. Those claims can arise both from the attorney’s own malfunctioning computers, from giving faulty advice to clients regarding Y2K problems, and from negligently litigating Y2K claims.

    by Janis Reinken, Attorney / Director of Risk Management, TLIE Recently, TLIE was asked to participate in a series of Y2K seminars sponsored in Houston, Dallas and Austin by the State Bar of Texas, entitled "The Year 2000 Problem: Computing the Legal Risks for Attorneys and their Clients." I served as a panelist on two of those occasions, where lively discussion occurred regarding ethics and malpractice issues as a component of the larger Y2K picture. In addition to discussion of some of the office practice management matters, the hot topic emerged as the evolving and amorphous standard of care to which lawyers might be held. Perhaps one of the most fitting (and laugh-provoking) suggestions came from someone in the audience. Figuring the cost is about the same, just buy new systems and forget about paying for compliance analysis and remedial work on existing systems. In previous issues of the Advisory , TLIE has offered suggestions on office management and evaluation, and precautions in providing legal services for clients dealing with Y2K matters. In this issue, we turn our focus to the standard of care, given the difficulties lawyers face in anticipating what a reasonably prudent lawyer could or would do under the same or similar circumstances. At this point, the standard of care cannot be derived from case law because it is limited and evolving, and the full array of legal problems that might arise out of Y2K is not known.

    by Max G. Moses, Esq., CPA I'm certain that you are just as tired of hearing and reading about the Y2K computer bug as I am. By now, everyone in the civilized world knows that if your computer stores, displays, manipulates or uses a two digit year in any fashion, the world as we know it may come to an end on January 1, 2000.
    Collection agencies and attorneys may be particularly vulnerable to Y2K challenges. Part of that results from how most agencies and law firms became computerized in the first place.
    It was not that long ago that most firms purchased collection software packages from one of a limited number of software venders. The primary function of those fully-integrated packages was to create a database of debtors and creditors. Accounting for costs that were advanced and dollars collected so that fees could be calculated and remitted to the correct client were also key uses. They also allowed for the production of form letters and reports.
    Those firms and companies still using that single integrated package probably have the easiest road towards Y2K compliance, unless of course their software vendor is out of business. However, most computer systems have evolved to the point where the collection portion of the package is merely one application among many running on the firm or agency's computer system.
    Couple this with the fact that more data today is being received electronically from the forwarder or the client and the challenges for collection agencies and law firms appear to be particularly difficult.

    THE Victorian Government is going it alone with far-reaching Year 2000 emergency legislation that suspends parts of the state constitution. Other states and territories have no plans to invoke similar legislation, believing existing laws will be sufficient to cover any problems. Only the ACT is adding to existing emergency laws. A general-purpose Emergency Management Bill currently before the ACT Assembly includes provisions for "major and systemic technological failure". The Victorian move comes after the Longford gas explosion last year revealed Victoria's disaster provisions to be outdated. The laws go beyond existing emergency measures by giving the Government extraordinary powers to deal with any computer-related breakdown in vital infrastructure. The Bracks Government last week introduced the Essential Services (Year 2000) Bill to ensure it is fully equipped to deal with unforeseen emergency issues.

    Wednesday, July 21, 1999 Clinton Signs Y2K Law Protecting Companies
    WASHINGTON, D.C. President Clinton Tuesday signed into law legislation that creates protections for companies against lawsuits stemming from year 2000 computer breakdowns. "Frivolous litigation could burden our courts and delay relief for those with legitimate claims," Clinton said in a statement. "Firms whose productivity is central to our economy could be distracted by the defense of unwarranted lawsuits." Supporters said the legislation was needed to rein in lawyers plotting a millennium-bug lawsuit offensive that could bankrupt Silicon Valley companies and slow the nation's economic growth. According to some experts, Y2K-related litigation costs could add up to $1 trillion.
