State Laws
The right to a public education in California is a fundamental right fully guaranteed and protected by the California Constitution. Recognizing the central role that education plays in our society, the California Legislature has enacted numerous laws designed to promote equality in educational opportunities and to safeguard students against discriminatory practices in public schools providing educational services.
For example, public school teachers are prohibited from giving instruction, and school districts are prohibited from sponsoring any activity which adversely reflects upon persons because of their race, sex, color, creed, handicap, national origin, or ancestry. Instructional material used in public schools must not include matter which is discriminatory on the basis of race, sex, color, creed, handicap, national origin or ancestry. Scholarships, loans and grants must be awarded in a nondiscriminatory manner. Discrimination based upon sex is also prohibited in athletic programs provided by public schools or supported by public funds.

Admissions and School Programs Grievances and Enforcement Return to Table of Contents The California State Education Code, the U.S. Constitution, the United States Education Act Amendments (Title IX), and the Civil Rights Act of 1964 (Title IV), generally provide the basis for the legal rights which require equal opportunity for men and women in all aspects of education . These laws cover all public schools, including elementary schools, high schools, community colleges, vocational and professional schools, California state colleges and the university of California system. Laws prohibiting discrimination in educational opportunities also apply to any private school or university , if the institution or its students receive funds from the federal government. For example, if students participate in federally-funded student grant programs, or the science department receives federally-funded research grants, then all of the programs and facilities at the institution must provide equal educational opportunities to all students.

Health Education
California has several specific requirements for health education. Education Code Section (no date available) requires instruction in grades 1 through 6 in "health, including instruction in the principles and practices of individual, family, and community health." Education Code (2003) requires instruction to all pupils in grades 7 to 12 at least once in junior high or middle school and at least once in high school. Education Code Section (no date available) requires parenting education to be included in either grade 7 or grade 8. Education Code Section (no date available) encourages a lesson on the effects of anabolic steroids in grades 7 to 12. Education Code Section (no date available) requires instruction on personal and public safety and accident prevention; the effects of the use of tobacco, alcohol, narcotics, dangerous drugs, and other dangerous substances; venereal disease; and prenatal care "at the appropriate elementary and secondary grade levels". VIOLENCE PREVENTION PROGRAM INVENTORY
(Revised September, 1999)
Evidence is accumulating that most violence can be prevented. Studies show that it is cost-effective to intervene with violence-prone young people and adults before they commit violent acts, to give them non-violent options, skills, and attitudes. When this is done, and individuals develop a variety of strategies for meeting their needs, society becomes safer. This preliminary inventory describes over 40 violence-prevention programs that were established in California. It is the initial product of a project of the Friends Committee on Legislation Education Fund, which seeks to highlight exemplary violence prevention programs in the State. This project has been undertaken in the hope that every community that feels threatened by violence will be able to find patterns that it can emulate to prevent violence before it starts. Many of the programs included here use volunteers, community activists, and existing resources, so it does not require costly changes to replicate them in other communities. Mostly, the things that are needed are inspiration, leadership, and commitment from people in the community. Are YOU willing to start asking questions about violence in your community, and make sure your neighborhood is as safe as it can be? The lists linked below contain additional links to many of the programs. Each community that feels unsafe should have access to one or two programs in each of the following four areas:

Does California's Fiscal Future Bode Ill for Education?
Many analysts and legislative groups have argued that California's current fiscal problems are not merely transitory effects of a recession but are signs of a bleak new era for the "Golden State." Is this true? And, if so, how is a new era of fiscal limitations likely to affect the state's education systems? To help address these issues, Stephen Carroll, Eugene Bryton, Peter Rydell, and Michael Shires analyzed the trends that will shape the California budget over the next several years. Their results indicate that California indeed faces a budget crisis, and the long-term prospects for state support of some public service systemsincluding educationare bleak. Three trends appear likely to dominate the state's long-term fiscal condition:
  • State revenues will growbut only moderatelyin the foreseeable future.
  • "Receiver populations" (the elderly, school-age children, and others who tend to depend on state aid) will grow at least as fast as revenues.
  • Corrections costs (primarily the costs of building and operating state prisons)driven by "three-strikes" legislationwill skyrocket.

Introduction
With California facing a year-end budget deficit of $6.7 billion in fiscal year 2005-06 lawmakers are trying to find solutions to the state's financial problems. Gov. Arnold Schwarzenegger unveiled a $111.7-billion state budget in early January that cuts several prominent programs including healthcare and transportation. Arguably, the most controversial cut is the governor's plan to scale back payments owed to the school system by $2.5 billion. Education makes up 40% of the state budget, and is currently protected from cuts by the state Constitution under voter-passed Proposition 98. The education cut has angered school groups who agreed to a funding cut last year in exchange for a promise that there would be no future cut to funding. Those supporting the cut point to the fact that the governor has also proposed a 3.93% cost of living allowance for education in his budget proposal. As a result the schools will be getting slightly more money this year than last.
In addition to the cut in the education budget, Schwarzenegger is proposing that teachers should receive pay raises based on merit and not on tenure as is currently the case. California is near the bottom in terms of student achievement according to studies by several prominent think tanks released in January. The merit pay notion has caused an out-cry among education activists who say that merit raises would be disastrous due to the difficulties in putting the program in place and possible discontent amongst teachers.
