Environmental Impact Assessment of Foreign Investment Projects:
A Study in the Law, Policy and Governmental Decision-making in Tanzania*

INTRODUCTION
The concept of Environmental Impact Assessment (EIA) refers to the examination, analysis and assessment of planned activities with a view to ensuring their environmental soundness and sustainable development. It is said to be a valuable means of promoting the integration of environmental and natural resource issues into planning and program implementation (see UNEP, 1987 as discussed by Lissu and Magabe, 1994:18-20). The purpose of incorporating EIA approaches has been described as subjecting a proposed action to an examination of what the possible environmental impacts of that action would be and to find ways to mitigate any negative long term impacts. EIA may also be a process which brings the proposed action into the public forum and provides an opportunity for comment and feedback (MTNRE, 1994:42). In this sense, and depending on the nature and extent of that participation, EIA processes are seen as mechanisms for public participation and the democratization of decision-making processes in matters of environmental governance and natural resource allocation and use. As such, EIA processes may result in a proposed project being abandoned, but in most cases they result in a better project more in harmony with longterm needs and with little negative environmental impact (MTNRE, loc. cit.)

Introduction to Environmental Impact Assessment
23 January-3 February 2006 Course Content Environmental Impact Assessment (EIA) is a rapidly developing process which originated as a result of legislation in the US in the late 1960s. It was adopted by the EC in 1985 and by the UK in 1988 and now forms an integral part of the planning process for many types of projects. It is therefore important to understand the nature of the EIA process and to be able to select, and use, suitable techniques. The aim of the unit is to provide training in policies, methods and applications of EIA and Strategic Environmental Assessment (SEA) in the UK and EU for postgraduate students in environment related courses. The module uses a case study to encourage participative learning related to objective and subjective components of the EIA On successful completion of this study, the participant should be able to:

Environmental Impact Assessments (EIA) ensures that the environmental effects of a proposed development is fully understood and taken into account. A developer can request the Government Office, acting on behalf of the Secretary Of State, to make a Screening and Scoping direction. Screening Directions can be requested if:
  • a developer disagrees with the local planning authority (LPA) that an EIA is required LPA fail to issue a screening opinion within three weeks of a planning application being lodged
We can make a screening direction indicating whether EIA is required. We will normally do this within three weeks. Scoping Directions can be requested if:
  • a developer disagrees with scope of environmental information required in EIA LPA fails to issue a scoping opinion within five weeks of a planning application being lodged
We can make a scoping direction indicating what information is needed in an EIA. We will normally do this within five weeks.

Environmental Impact Assessment Under the Roads Act, 1993, as amended, a road authority is obliged to prepare an Environmental Impact Statement (EIS) - a description of the likely effects on the environment - in respect of certain types of proposed road developments. These are specified in the Act and associated Regulations and include:
  • the construction of a motorway; the construction of a busway; the construction of a new road of four or more lanes or the realignment or widening of an existing road so as to provide four or more lanes where such new, realigned or widened road would be eight kms or more in length in a rural area, or 500m or more in length in an urban area; the construction of a new bridge or tunnel which would be 100m or more in length.
The Act also provides for the preparation of an EIS for schemes not meeting the above criteria where An Bord Pleanala considers that the construction of the proposed road would be likely to have significant effects on the environment. The preparation of the EIS is carried out in parallel with the preliminary design of the scheme. As environmental impacts are identified the necessary changes/ameliorative measures can be incorporated into the scheme design.

Introduction
The Master of Research in Environmental Impact Assessment is primarily a research training programme and is recognised for Economic and Social Research Council (ESRC) 1+3 funded studentships. It is designed primarily, although not exclusively, to enable students to link a programme of substantive research training to the subsequent pursuit of a doctorate. The course is modular in structure and includes training in environmental assessment and in research methods and methodology. Students will undertake a dissertation of 15,000 words and will also have the opportunity to become involved in research projects of the SchoolÂ’s Impact Assessment Unit.

    Environmental Impact Assessments
    Environmental impact assessment (EIA) is the process of identifying and predicting the consequences (effects) of a proposed project, and the determination of measures to minimize adverse effects on the environment and human health. In most jurisdictions, legislation now requires that EIAs be conducted for many types of projects. Project proponents must prepare a submission before government approval may be granted. In addition, the public is increasingly calling for accountability on the part of proponents and government to ensure that the environment and livelihood of local residents are not adversely affected. This typically involves a preliminary review of possible issues and effects, public consultation, field research into environmental and social conditions, the publication of a comprehensive assessment report, and possibly the preparation of material for a public hearing. Environmental practitioners must ensure that submissions are objective and meet all regulatory requirements. The assessment report must be informative, clear and concise to enable decision makers to quickly and easily understand the environmental implications of the proposed project.
