The U.S. Court of Appeals for the Ninth Circuit ruled on February 2 that under the Religious Freedom Restoration Act of 1993, Rastafarian defendants should be allowed to show that they use marijuana for bona fide religious reasons in their defense against charges of possession of marijuana ( U.S. v. Bauer , No. 94-30073, 96 C.D.O.S. 756, 1996WL42240 (9th Cir. 1996); http://www.law.vill.edu/Fed-Ct/Circuit/9th/opinions/9430073.htm ; Reynolds Holding, "Rastafarian Pot Could Be Legal," San Francisco Chronicle , February 3, 1996, p. A14; "Marijuana For Religious Reasons," Washington Post , February 5, 1996, p. A10; Associated Press, "Court: Rastafarians Can Hold Marijuana," Chicago Tribune , February 4, 1996, p. 9). Acting on two tips, police initiated an investigation of marijuana trafficking from Mexico to Billings, Montana. As a result of the investigation, 26 people were indicted in November 1992 on a number of charges, including conspiracy to manufacture and distribute marijuana, money laundering, use of firearms in relation to drug trafficking, and possession with intent to distribute marijuana. Three of the defendants, Calvin Treiber, Dawn Meeks, and Lexi Bauer, appealed on the grounds that they possessed the marijuana in the course of practicing their religion, Rastafarianism. The Court of Appeals found that Rastafarianism is a recognized religion that considers marijuana a sacrament.

In Jamaica, as elsewhere in the world, the 1930s were years of social upheaval. Labour unrest on the island culminated in the vicious suppression of striking sugar-cane workers in Westmoreland: four strikers were shot dead, and dozens rounded up and jailed, including Alexander Bustamente, the leader of the new Jamaican labour movement.
It was a perfect context for the rise of a band of islanders who divorced themselves mentally from an oppressive social system. This cult, Rastafarianism, thus became cast as a religion of the dispossessed among those who failed to acknowledge the intellectual rigor of many practitioners (the depth of Biblical and historical knowledge displayed at a Rastafarian reasoning is intense).
In the hills of eastern Jamaica, Rastafarian encampments sprang up; a life of asceticism and artistry became the armour of the religion's followers against Babylon. Leonard Howell, one of the island's chief propagators of the religion, founded the Pinnacle encampment in an abandoned estate between Kingston and Spanish Town. Howell eventually decided that it was not Haile Selassie who was Jah but himself. In 1954 he was thrown into a mental home, and Pinnacle was closed down.
The dreads, as Rastafarians became known colloquially, spilled out into the ghettoes of west Kingston. Around the time of independence in 1962, there were a number of violent incidents involving fire-arms between Rastas and the police, making headlines in the Daily Gleaner. The movement was now traveling with the speed of a bush-fire into the popular psyche of Jamaica.

Rastafarianism arose in the ghettos of Kingston in the early 1930:s at just about the same time as Haille Sellassie was crowned emperor of Ethiopia. Some of the most significant signs of Rastafarianism are the long dreadlocks, the red, green and black colours and the caps. This is not only a style, but also a part of their religion. The dreadlocks symbolize many different things for example the Rastafarians roots. It is also meant as a contrast to the white mans blond, straight hair and because of that it says in the Bible: "They shall not make baldhead upon their hair, neither shall they shave of the corner of their beards, nore make any cutting of their flesh. The way the hair grows also represents the lion Judah who in turn symbolizes Haille Sellassie. Another thing that's related to Rastafarianism is the reggae music, which is the most popular music on Jamaica. 2 of the symbols within Rastafarianism are the royal ring of Haille Selassie and the Rastafarianism bible, the Holy Piby.

Rastafarianism The original Rastafarians drew their inspiration from the teachings of the Jamaican Black Nationalist Marcus Garvey who lived from 1887 until 1940. In the 1920s Garvey preached that a black king would be crowned in Africa and many of his followers rejoiced when they saw this prophecy fulfilled in the 1930s with the crowning of Ras Tafari (crowned Emperor Haile Selassie of Ethiopia). As part of his teachings Garvey promoted the Universal Negro Improvement Association (UNIA). This association concentrated on uniting black people with Africa, which he said was their rightful homeland. Garvey preached to his followers that all black people in the western world should return to Africa (Ethiopia specifically) to get back in touch with their ancestors. He called this idea the ”Back to Africa” movement. This movement was organized to liberate people after years of oppression. Rastafarianism is rooted in the principles of black self-reliance and self-empowerment combined with a ”back to Africa” consciousness, which concentrates on the awakening of a sense of black pride.

Rastafarianism
Rastafarianism originated in Jamaica in the 1920s as an expression of faith and cultural pride.
Beliefs
Both Jewish and Christian principles are foundational in Rastafarian thought, though Ethiopia rather than Israel is seen as the Promised Land. They follow the Nazarite vow of separation, which in practice means that:
  • hair is left uncut and unbrushed
    (worn in dreadlocks) dietary regulations are observed
    (pork and sometimes other meats being forbidden) contact with death is avoided
    (funeral attendance is uncommon)
Often a crown or a tam (ie a woolen hat) in the red, green and gold of the Ethiopian flag is worn. Rastafarian worship is in the form of Nyabinghi, whose style has given rise to Reggae music.
