Mr. Chairman and other Members of the Subcommittee on Fisheries Conservation, Wildlife and Oceans, I am very grateful to you for electing to conduct a hearing on H.R. 1006, the Captive Wildlife Safety Act. I am especially grateful to my Congressman, Buck McKeon, and to Representative George Miller for introducing this important legislation. This bill, if enacted, would fulfill a dream I have had since the mid-1990's: to see a federal law adopted to promote public safety and to prevent the abuse of wild cats kept as pets.
For 30 years, since I began working with big cats, I have been amazed that there are no federal laws uniformly regulating the transport of wild and exotic species kept as pets by private owners across the United States. Consider:
Near Houston, Texas, on March 15th, 2000, four-year-old Jayton Tidwell watched his uncle reach into the cage of the 400-pound Bengal tiger named Cheyenne he kept in the back yard. Little Jayton wanted to pet his uncle's beautiful tiger, too. The tiger responded by tearing off Jayton's arm.
Doctors reattached the arm after eleven hours of surgery, but to date Jayton's right arm remains largely useless. However, Jayton was lucky. Other children lose their lives to big cats recklessly kept as pets. In October, 2001, on a farm outside Lexington, Kentucky, one of the three pet tigers kept by Kerry Quinney snatched his three-year-old grandson Matthew Scott from his arms as they were having their picture taken in the tiger pen. Matthew died of massive head injuries after the 250-pound tiger dragged him around the pen.

The exotic animal business faces a thicket of regulations, but some say the trade in lions and tigers is still too wild and free.
here was a time when James Edward Stephens thought his liger, Tigger, had a promising career in public relations. Stephens' Web site, last updated in 1997, advertises the 1,200 lb. lion/tiger hybrid as "The largest cat in the world!!!" and therefore "perfect for your corporate image!" But the hulking, gently striped Tigger never did quite catch on as a corporate pitch-cat. Stephens' legal problems, which currently prevent him from exhibiting his animals, have also curbed Tigger's professional progress. "He hasn't been out of that pen in five years," says Stephens, gesturing toward the liger's hilltop abode. Stephens – "Top Cat" to his friends – has two youthful lions and one baby tiger tottering around in playpens in his living room; four young tigers, three young lions and one mountain lion caged in his basement; and numerous full-grown big cats, including Tigger, lounging around in a cinder block-and-welded-wire fortress just across the hilltop. He says that over the past 16 years his hilltop ranch near the tiny Washington County hamlet of Woodrow has been home to at least 600 big cats, many of which have been pressed into service as corporate mascots and then sold to federally licensed dealers or permit-bearing exotic pet owners.

The term 'zoo' was not used until the early 1800s when the Zoological Society of London was founded. At the end of WW2 the UK had only 14 zoos, but by the 80s the number of zoos rose to about 250. Today zoos are a relic of a bygone Victorian age. There are some 10,000 zoos worldwide. Some zoos offer better conditions for animals than others, but almost all of them have cages and enclosures which are of a poor standard. Space in zoos rarely, if ever, matches the animals' natural range, and more commonly is reduced to virtually nothing. Electric fences often give the impression that enclosures are larger than they actually are. Birds are virtually stripped of their most precious gift - flight, consequently captive birds like vultures and pelicans are prone to bone disease. For 15 hours a day many animals may be shut away in their night quarters with even less room to move. You can still see elephants in small concrete pens, monkeys in bare cages, and bears in barren pits. The quality of animals' environment in zoos is paltry. The animals' boredom and suffering can be seen in the way they pace up and down the same area and sway back and forth. Some actually go mad with frustration. Some zoo enclosures mean that the inmates cannot even enjoy their most basic behavioural repertoire, including exercise, social interaction and bathing. When animals do find company, their world may be torn apart when cage mates are sold. Solitary and shy animals are often in enclosures with viewing from all sides, and even a window in the night quarters as well. Visitors tap the glass of tanks, poke the animals, and are noisy and boisterous.

Thank you Mr. Chairman, for the opportunity to testify before you and the Subcommittee regarding HR 1006, the Captive Wildlife Safety Act. Before I begin, I would like to request that my written testimony on behalf of the American Zoo and Aquarium Association (AZA) be included in the hearing record. I also respectfully request that the written testimony of the American Association of Zoological Veterinarians be entered into the record as well. My name is Dr. Eric Miller, DVM. I am Director of Animal Health and Conservation for the Saint Louis Zoological Park and a member of the American Zoo and Aquarium Association's Board of Directors. AZA represents 212 professionally-managed and accredited institutions which draw over 136 million visitors annually and have more than 5 million zoo and aquarium members. AZA institutions are the leaders in animal care and welfare, conservation science and conservation education. One of the cornerstones of AZA is its Species Survival Plan (SSP) programa long-term plan involving genetically-diverse breeding, habitat preservation, public education, field conservation and supportive research to ensure survival for many threatened and endangered species. Currently, AZA member institutions are involved in 108 different SSP programs throughout the world covering 159 species, including African and Asian lion, three species of tigerSiberian, Indochinese and Sumatran, clouded and snow leopard, cheetah and jaguar.

Other ways to help! Join Born Free Adopt an Elephant Orphan Elefriends Campaign In 2003, two US zoos imported 11 wild African elephants from Swaziland. Their future, a lifetime in captivity.
They were the subject of international media attention, a lawsuit, and widespread pubic concern.
However, the elephants that ended up at the San Diego Wild Animal Park displaced three older animals who were send packing to the Lincoln Park Zoo near Chicago. Their fate attracted less attention - until now.
Just a year later Tatima is dead and animal welfare experts fear for the lives of her surviving companions. Pat Derby of the world-famous PAWS sanctuary explains: PAWS has been challenging AZA's decision to oppose the proposed relocation of Detroit Zoo's elephants to the PAWS sanctuary in San Andreas, CA. "Ron Kagan, the director of the Detroit Zoo, made a compassionate decision based on his concern for the welfare of the two elephants, Winky and Wanda, to send them to a warmer climate. He has been castigated for this decision by AZA although the transfer of Tatima to the Lincoln Park Zoo was approved and supported by AZA. The protests of caring zoo administrators and keepers have been ignored by AZA as they force their insensitive policies on members who are not allowed to disagree," Derby goes on to say.
