From the beginning there was considerable controversy surrounding Sutherland's definition of white-collar crime, and his claims that it could be explained by a theory that simultaneously explained street crime. Many argued that the definition was either too vague and/or too broad. For instance, Sutherland's definition included both organizations and individuals as "criminal actors." It also included violations of the criminal code and regulatory codes. Finally, at different times he emphasized the social standing of the offender and at others the opportunity to commit crime based on their occupation. Most often, however, Sutherland argued it was both
social standing and the opportunity of occupation that lead to individuals committing white-collar crimes. Some have argued that this is the essence of white-collar crime, and criminologists should therefore limit their inquiry to those of positions and power rather than middle-class or working-class offenders who commit crimes while "on the job" (Geis 1992). On the other hand, there are those like the current authors who have noted that limiting the study of white-collar crimes by these criteria would exclude the vast majority of those arrested for white-collar offenses. As they note, most white-collar offenders differ in marked ways from elite offenders, and their crimes are "frequently as mundane as their social class backgrounds" (p. 10).

    One in three U.S. households is now the victim of white collar crime, according to new research conducted by the National White Collar Crime Center. The findings also reveal a growing public concern with the seriousness of white collar crime and the criminal justice system's ability to control it. The survey, which was conducted between January and April 1999 by the Training and Research Institute of the National White Collar Crime Center in Morgantown, West Virginia, is the first of its kind in nearly two decades. Findings from the report show that during a 12-month period, one in every three households (36 percent) was victimized by a form of white collar crime. With regard to perceptions of the seriousness of white collar crime, the survey dispels early work that indicated the public was not concerned about fraud and white collar crime affecting them. The research shows that the public now views certain white collar crime offenses as equal to or more serious than certain traditional street crimes. The Center asked: Which is more serious, armed robbery causing serious injury, or neglecting to recall a vehicle that results in a serious injury? Forty-eight percent said armed robbery, 39 percent said defective products and 13 percent said "equal."

    E-Mail This Article Published on Friday, March 7, 2003 by CommonDreams.org What About Three-Strikes-and-You're-Out for Corporate Criminals? by Lee Drutman Say what you will about California's three-strikes law, but one thing's for sure: Many Californians voted for it in 1994 because they were sick and tired of recidivist criminals breaking the law over and over. They wanted to get tough and put a real deterrent on criminal behavior. "Our goal in California is to have no more victims," said former California Secretary of State Bill Jones, the chief author of state's three-strikes law. On March 5, the Supreme Court affirmed the constitutionality of the law by a 5-to-4 vote. It was a close vote because a life sentence for a third crime that's relatively minor borders on cruel and unusual punishment. In practice, it means that Gary Albert Ewing, an AIDS patient, will get 25 years in prison for stealing $1,200 worth of golf clubs from a pro shop and Leandro Andrade will get 50 years for shoplifting $153 worth of children's videos from K-Mart. Meanwhile, a theft millions of times as large as either Ewing's or Andrade's remains unpunished and largely undeterred. Just a few days prior to the Supreme Court ruling, California officials sent federal regulators 1,000 pages of evidence that they felt proved once and for all that more than a dozen power companies had conspired to manipulate energy prices in 2000 and 2001, gouging California ratepayers by $9 billion. Nine billion dollars. Kind of makes $1,200 worth of golf clubs or $153 worth of kid's videos seem like small potatoes. In fact, that's more than twice the $3.8 billion that the FBI estimates street crime costs its victims each year across the entire country.
