TITLE 127 LEGISLATIVE RULE WEST VIRGINIA SECONDARY SCHOOL ACTIVITIES COMMISSION SERIES 5 BAND ACTIVITIES §127-5-1. General. 1.1. Scope - These rules and regulations govern band activities. 1.2. Authority - W.Va. Constitution, Article XII, §2 and W.Va. Code §18-2-5. 1.3. Filing Date - June 7, 2002. 1.4. Effective Date - August 6, 2002. §127-5-2. Enrollment and Membership - Band. 2.1. All members of a member school band must be enrolled in that school. Rule 127-5-2.3 and 127-5-2.4 will be the only exception. 2.2. Majorettes, flag corps, drill teams, etc. are considered an integral part of the band and shall be adjudicated and governed accordingly. Any performance by a majorette, member of a flag corps or drill team, without the band, shall not be considered a band activity. 2.3. Instrumental music students in seventh and eighth grades of feeder elementary schools or any grade of a feeder junior high school who receive their instruction from the band director of the senior high band in which said students will eventually enroll and which feeder school does not have a band of its own shall be eligible to participate in the band directed by their instructor.

Ms. Garcia is also a scholar at the University of California at Berkeley for the Foundation for Teaching Economics.
Ms. Morgan is also an Ashbrook scholar at Ashland University. Introduction Schools around the United States are now faced with education a growing number of children who lack basic English skills. According to the National Clearinghouse for Bilingual Education , there are 2,437,723 Limited English Proficiency students in the U.S.1 Only a few years ago, many schools had never dealt with a language minority child. Today, an increasing number do. The challenge of providing a quality education to all students is doubled when schools must also teach a child an entire new language as well as academic courses. Over the last 30 years, elected officials, education agencies, and the courts have established guidelines for the education of these students. Federal requirements allow states a wide deal of latitude in selecting the most effective programs for their limited-English-proficient (LEP) students. Many states have enacted their own laws governing the management and style of programs for LEPs. These laws have been developed in cooperation with, or under coercion from, federal agencies and/or activist organizations. The result has been a patchwork of laws and regulations that can vary greatly from state to state.

Designed to Prepare Educational Leaders for the Challenges of Tomorrow
The Administration and Supervision of Special Education (EDSE) program is a post-master's preparation program, which can lead to an Ed.S., Ed.D. or Ph.D. in special education administration. It is an integral part of the Department of Educational Leadership and Policy Studies at Virginia Tech. Students follow an interdisciplinary course of study offering licensure as a school administrator. In addition to course work in educational leadership and special education administration, a wide range of university studies is available to doctoral students including theories and techniques of teaching and learning, human development, early childhood education, psychology, business administration, and public policy. Throughout their course of study, students participate in a variety of field study and internship experiences in public schools, community colleges, state departments of education, nonprofit agencies, state and federal agencies and legislative bodies.

The informal item bank is to be used as informal classroom assessment to re-direct instruction based on student mastery of the CSOs. CTB/McGraw-Hill is the vendor for the Informal Item Bank. The purpose of the WESTEST is to measure student mastery of the CSO's. The assessment results are used to re-direct instruction and assist in school improvement efforts in reading/language arts, mathematics, science and social studies. §32-9-1. General.
1.1. Scope. This establishes continuing education requirements for renewal of licensure pursuant to W. Va. Code §30-36-14(d).
1.2. Authority. W. Va. Code §§30-36-7(a) and 30-36-14(c).
1.3. Filing Date. May 21, 1999.
1.4. Effective Date. May 21, 1999. §32-9-2. Application.
This legislative rule applies to renewal licensees and instructors of continuing education courses. §32-9-3. Definitions.
3.1. Approved Provider. Those persons or organizations offering continuing education in West Virginia, who are approved by the Board.
3.2. Course. A systematic learning experience, at least one hour in length, which deals with and is designed for the acquisition of knowledge, skills and information relevant to the practice of acupuncture.
3.3. Hour. A period of time spent in a course, lasting at least fifty (50) minutes, where participation in an organized learning experience occurs. §32-9-4. Criteria for Provider Approval.

ARTICLE 23. LOCAL GOVERNMENT FLEXIBILITY ACT.
This article may be cited as the Local Government Flexibility Act of 2005. No inference, implication or presumption of legislative construction shall be drawn or made by reason of the location or grouping of any particular section, provision or portion of this article. No legal effect shall be given to any descriptive matter or heading relating to any part, section, subdivision or paragraph of this article.
(a) Legislative intent . It is the intent of the Legislature in enacting this article to provide a framework within which new ideas can be explored to see if they can or should be implemented on a statewide basis. (b) Legislative findings . The Legislature finds and declares that: (1) County commissions, municipalities and county boards of education today face numerous challenges managing their budgets and other resources and delivering services required by federal or state law or demanded by their constituents. (2) Local units of government are sometimes restricted by policies, rules and regulations that prevent them from carrying out their duties and responsibilities in a cost effective, efficient and timely manner. To address this concern, this pilot program includes a waiver program whereby county commissions, municipalities and county boards of education may apply to the Governor for waiver of a specific policy, rule or regulation.

DeYoung, Alan. (1995). The Life and Death of a Rural American High School: Farewell Little Kanawha . New York: Garland. 342 pp. $50.00, hardcover (800/627-6273)
Alan DeYoung's story of the circumstances surrounding the birth, growth, and death of a high school in rural West Virginia is an intellectual contribution of the first order. And Farewell Little Kanawha is certainly one of the best stories to be told by an educational researcher in recent decades. Its strength derives in large measure from DeYoung's deftness in crossing disciplinary borders. The interplay of economics, sociology, history (both oral and documentary), anthropology, and biography render this story far more compelling than most educational research. DeYoung bases his narrative, in fact, on C. Wright Mills' precept that social science worth doing must interpret the intersection of biography and history. Mills was the wisest and best American sociologist and DeYoung is among a very small contingent of scholars concerned with rural education to embrace his advice.

By Rebekah Saul An intensive effort to reinstate Virginia's policy mandating sexuality education in the public schools came to a screeching halt on April 22 when the legislature failed to override Gov. James Gilmore's (R) veto of the legislation. Gilmore's veto came despite the last-minute adoption of an amendment, sponsored by an ultraconservative representative, that would have required all family life education (FLE) in the state to "present sexual abstinence before marriage and fidelity within monogamous marriage as moral obligations and not matters of personal opinion or personal choice." Indeed, the Virginia case points up an eternally vexing question for those who work in the political process: How much compromise is too much? Or, in this case, is a half-bad sexuality education mandate really better than no mandate at all?

State environmental regulators said that they've finally got a way to control the thick haze hanging over parts of West Virginia, a haze that has nothing to do with forest fire smoke, reported The State Journal. The West Virginia Department of Environmental Protection (WVDEP) introduced new agency rules that would give regulators more power to curb the spread of industrial dust, a byproduct of some coal and industrial plants.
