Barnette In 1940 the Supreme Court of the United States handed down a decision that made saluting the flag compulsory in public schools. Children of Jehovah’s Witnesses, for whom the flag salute conflicts with a religious belief that forbids them to worship graven images, refused to follow the court’s mandate. Walter Barnette and other Jehovah’s Witnesses filed suit against the West Virginia State Board of Education, and the lower courts found in favor of Barnette. In 1943, despite the patriotic fervor prevalent during World War II (1939-1945), the Supreme Court overturned its earlier decision by a margin of 6 to 3, invoking the free speech clause of the First Amendment to the Constitution. Justice Robert Jackson delivered the majority view, while Justice Felix Frankfurter, the author of the 1940 opinion, dissented. Want more Encarta?

Policy 2520.16 Alternate Academic Standards for WV Schools
Background: ESEA/NCLB requires that states adopt challenging alternate academic achievement standards that are linked to their grade-level academic content standards, promote access to the general curriculum and reflect professional judment of the highest achievement standards possible. The WV Alternate Assessment, currently under revision, must align with the state's alternate achievement standards. 2520.16 is a new policy that defines the alternate academic achievement standards for students with the most significant cognitive impairments as required by Policy 2510 and ESEA/NCLB.

Mr. Justice JACKSON delivered the opinion of the Court. Following the decision by this Court on June 3, 1940, in Minersville School District v. Gobitis, 310 U.S. 586, 60 S.Ct. 1010, 127 A.L.R. 1493, the West Virginia legislature amended its statutes to require all schools therein to conduct courses of instruction in history, civics, and in the Constitutions of the United States and of the State 'for the purpose of teaching, fostering and perpetuating the ideals, principles and spirit of Americanism, and increasing the knowledge of the organization and machinery of the government.' Appellant Board of Education was directed, with advice of the State Superintendent of Schools, to 'prescribe the courses of study covering these subjects' for public schools. The Act made it the duty of private, parochial and denominational schools to prescribe courses of study 'similar to those required for the public schools.' Failure to conform is 'insubordination' dealt with by expulsion. Readmission is denied by statute until compliance. Meanwhile the expelled child is 'unlawfully absent'5 and may be proceeded against as a delinquent. 6 His parents or guardians are liable to prosecution, and if convicted are subject to fine not exceeding $50 and jail term not exceeding thirty days.

, Section 1, 1868 INTRODUCTION In 1896 the United States Supreme Court and the West Virginia Supreme Court of Appeals handed down decisions that were to have important implications for the nation and the state. This brief essay will compare and contrast the Plessy v. Ferguson decision of May 18, 1896 and the Martin v. Board of Education decision of November 28, 1896. The Martin case remains virtually unknown. No standard works on West Virginia history or education cite the decision; yet it remains, along with numerous other tragic and obscure incidents, as part of the mosaic that is West Virginia history. The period following the Civil War has been interpreted by C. Vann Woodward as an era in which significant achievements were made by blacks seeking legal and economic human rights. Blacks living in the South were encouraged to vote and white politicians tended to solicit their support. Numerous positions of political leadership were held by Negroes and not until the 1890s was segregation as it is defined today a normal part of American life.

West Virginia Board of Education Continues to Strengthen Early Childhood Education Posted: July 29th, 2005
Charleston, W. Va. – West Virginia’s youngest students are getting a high quality
education much to the credit of the West Virginia Board of Education (WVBOE).
Board members recently approved revised Policy 2525: West Virginia’s Universal
Access to Quality Early Education System. Policy 2525 sets the standards for
implementing high quality universal pre-kindergarten programs. This policy covers
all public school preschool programs and any community program such as Head Start or
child care that contracts with the county school system to provide a WV Pre-k classroom.
Health and safety standards are now a part of the policy. Included in these standards are requirements that meals must be provided if a pre-k classroom is in operation for more than four hours; all children who enter a program must have age appropriate immunizations; and classroom size will be limited to no more than 20 children. All pre-k classrooms not administered by the West Virginia Department of Education (WVDE) must be licensed through the West Virginia Department of Health and Human Resources (WVDHHR) Day Care Licensing.
Other revisions include a more defined composition of the review team to include three representatives from the WVDE, three from WVDHHR and three from Head Start. This review team will evaluate the quality and content of the county plans and whether counties are maximizing funding. Local Education Agencies (LEA) will have oversight for the WV Pre-k classrooms in their counties; however, the WVBOE and the Secretary for the WVDHHR will maintain state oversight.

Please contact the approved education provider of your choice for their current schedules.
WEST VIRGINIA DOES NOT APPROVE DISTANT EDUCATION FOR CONTINUING EDUCATION OR QUALIFYING EDUCATION Each qualifying course must be a minimum of 15 hours of classroom education. Students must take and successfully complete the course exam. An apprentice is required to work under the direct supervision of a licensed/certified appraiser throughout the apprentice program. After 500 hours of appraisal experience, the supervisor and apprentice may jointly apply for an Exemption from Supervisory Accompaniment. This applies to inspections of residential property only.
To apply for an upgrade to become a licensed residential appraiser, an apprentice must have completed all required education and have successfully completed the National Test and the WV State exam. An application for upgrade and Experience Log reflecting a minimum of 2000 experience hours must be submitted. Apprentices who received their permit prior to 1/1/98 with a submission of 75 hours of required education, please remember that 90 hours of qualifying education was required effective 1/1/98.

30-1-1. Application of article. Unless otherwise specifically provided, every board of examination or registration referred to in this chapter shall conform to the requirements prescribed in the following sections of this article. 30-1-1a.
