home staff projects KAY GOODWIN - CABINET SECRETARY On January 17, 2005, Governor Joe Manchin III named Kay Goodwin Cabinet Secretary for Education and the Arts in West Virginia. She previously served in the same capacity for Governor Bob Wise from January 2001 through January 2005. Secretary Goodwin currently holds seats on the West Virginia Higher Education Policy Commission, the Governor’s P-20 Council, the Martin Luther King, Jr. State Holiday Commission, the Prepaid Tuition Fund Board of Trustees, and the Workforce Development Review Committee. Secretary Goodwin is the current chairman of the Promise Scholarship Board of Control as well as the Professional Staff Development Advisory Council, and is honorary chairman of the Governor’s Council on Literacy. She is the co-chairman of the Center for Professional Development Board.
With both Baccalaureate and Master of Arts degrees in speech and drama, Secretary Goodwin has staged musical theatre and opera productions for high school and community arts groups throughout the state. She has been a faculty member at both West Virginia University and West Virginia State University, and she has received honorary degrees from West Virginia State University and Davis and Elkins College. CHAPTER 18. EDUCATION. ARTICLE 8. COMPULSORY SCHOOL ATTENDANCE. West Virginia Code §18-8-1. Commencement and termination of compulsory school attendance; exemptions. (a) Compulsory school attendance shall begin with the school year in which the sixth birthday is reached prior to the first day of September or upon enrolling in a publicly supported kindergarten program and continue to the sixteenth birthday. Exemption from the foregoing requirements of compulsory public school attendance shall be made on behalf of any child for the causes or conditions set forth in this section. Each cause or condition set forth in this section shall be subject to confirmation by the attendance authority of the county.

Integration
Indian and Negro were names only to me as a boy. I had heard stories of Indian massacres and many references to Black Dock and Aunt Sue - Negroes who had been slaves of Uncle Matthew McClung, who had reared my mother. Those Negroes, to whom McClung had given a house and a small piece of land, were referred to as though they had been members of his family. My father, a Confederate soldier, who had fought in the Seven Days Battle Around Richmond, Second Battle of Bull Run, Antietam, Chancellorsville, Fredericksburg, Petersburg, and many others, seemed not to have any prejudice against Negroes; neither did my mother seem to have any. But there was hatred for the Yankees and President Lincoln. I heard my mother say: "For a number of years following the Civil War, I could think of President Lincoln only as a scoundrel of the meanest kind." I do not recall that I saw a Negro before I was twelve years old. I had no prejudice. I had my first public relationship with Negroes at thirty-six years of age when, as superintendent of the Elkins Public Schools, I supervised two Negro elementary teachers. When I had organized a Negro high school I supervised three. As State Superintendent of Free Schools, I became responsible for both Negro and white pupils, teachers, schools, curricula, and buildings. To my surprise, I learned that Negro teachers were more plentiful than white teachers for their respective schools, and that they were better prepared than were the white teachers. There were few white-collar jobs available to them.

The county boards of education are hereby granted and shall exercise the control, supervision and regulation of all interscholastic athletic events, and other extracurricular activities of the students in public secondary schools, and of said schools of their respective counties. The county board of education may delegate such control, supervision and regulation of interscholastic athletic events and band activities to the "West Virginia secondary school activities commission," which is hereby established.
The West Virginia secondary school activities commission shall promulgate reasonable rules and regulations providing for the control, supervision and regulation of the interscholastic athletic events and other extracurricular activities of such private and parochial secondary schools as elect to delegate to such commission such control, supervision and regulation, upon the same terms and conditions, subject to the same regulations and requirements and upon the payment of the same fees and charges as those provided for public secondary schools. Any such private or parochial secondary school shall receive any monetary or other benefits in the same manner and in the same proportion as any public secondary school.

Equal Pay The Wage Payment and Collection Act requires the payment of wages and fringe benefits within 72 hours to employees who are discharged and payment by the next regular payday for employees who have resigned or are laid off. Although the Act does not require employers to provide fringe benefits to their employees, it does assure that employers follow through by providing the benefits they have included in their own company policy. Other provisions include requiring employers to meet their payroll at least once in every two weeks unless provided a special agreement; prohibiting unauthorized payroll deductions unless the employee has agreed to the deduction through a legal wage assignment and other issues regarding employer-employee responsibilities. Wage Bonds The Act also requires that, with the exception of those who have been doing business in this state for over five consecutive years, and are engaged in construction work or the severance, production or transportation of minerals must furnish a bond to protect the wages and benefits of their employees.

The West Virginia Board of Education is established in the West Virginia Constitution. The Board is vested with general supervision of the state's 834 elementary and secondary schools. Its 12 members include nine citizens appointed by the governor and three non-voting ex-officio members the State Superintendent of Schools, the Chancellor of the West Virginia Higher Education Policy Commission, and the Chancellor of Community and Technical Education. The State Superintendent is a constitutional officer who serves at the will and pleasure of the board. Board members serve overlapping terms of nine years, and no more than five citizen members may belong to the same political party. The board meets monthly to determine the educational policies of the elementary and secondary schools and to establish the rules that carry into effect state law regarding education. The State Board of Education also has general control, supervision and management of the business and educational affairs of the West Virginia Schools for the Deaf and Blind.     June 14, 1943, Decided MR. JUSTICE JACKSON delivered the opinion of the Court. Following the decision by this Court on June 3, 1940, in Minersville School District v. Gobitis , 310 U.S. 586, the West Virginia legislature amended its statutes to require all schools therein to conduct courses of instruction in history, civics, and in the Constitutions of the United States and of the State "for the purpose of teaching, fostering and perpetuating the ideals, principles and spirit of Americanism, and increasing the knowledge of the organization and machinery of the government." Appellant Board of Education was directed, with advice of the State Superintendent of Schools, to "prescribe the courses of study covering these subjects" for public schools. The Act made it the duty of private, parochial and denominational schools to prescribe courses of study "similar to those required for the public schools." The Board of Education on January 9, 1942, adopted a resolution containing recitals taken largely from the Court's

    INTRODUCTION TO THE COURT OPINION ON THE WEST VIRGINIA BOARD OF EDUCATION V. BARNETTE CASE
    There are two clauses regarding religion in the First Amendment. One is the Establishment Clause, which prohibits the government from establishing any sort of official religion (see next document); the other is the Free Exercise Clause, which forbids the government from restricting an individual's religious practices. Free exercise claims often overlap claims to freedom of expression, and several of the most important religion cases mixed issues of free speech and free exercise together. A key element in religion clause jurisprudence is the dichotomy between belief and action originally enunciated by Chief Justice Morrison Waite in 1879. While the First Amendment absolutely prohibits government efforts to restrict beliefs, it does not prevent the state from forbidding practices that threaten public order or safety. In the example Waite used, if a sect believed in human sacrifice, the government could do nothing to restrict that belief; but it could, without violating the Free Exercise Clause, bar the actual sacrifice. While this belief/action analysis remains useful even today, the Court came to recognize that in some areas belief and action overlapped. The Jehovah's Witnesses are a relatively small sect in the United States, but they are responsible for some of the most important cases establishing religious freedom. The Witnesses claimed a right to proselytize, an action, without state regulation, as essential to the free exercise of their creed, a belief. In several cases the Court upheld these claims, but primarily on speech rather than religion clause grounds, yet these decisions are in fact the basis for modern jurisprudence on the Free Exercise Clause.

    West Virginia Board of Registration for Sanitarians
    Pursuant to West Virginia State Code, Chapter 30, Article 17, the Board of Registration for Sanitarians began registering Sanitarians in West Virginia on July 1, 1992. The Board is made up of five members currently employed as a Registered Sanitarian, and two industry members not employed as a Sanitarian. Each of these members is appointed by the Governor and serves a five year term. Each year the members select from among themselves a Chairpersons and Vice-Chairperson. The duties of the Board include reviewing candidates' applications for registration to ensure that they have meet the appropriate educational and experience requirements. In order to obtain a new or renewal Registration, an applicant must complete a Child Support Obligation Disclosure form (available below) in accordance with West Virginia Code 48-15-303.
    Additionally, the Board reviews in-service meeting agendas to determine the number of continuing education credit hours that will be a assigned to the meeting. Sanitarians in West Virginia are required to obtain fifteen (15) continuing education credit hours every year.

    In addition, the African American and low SES subgroups are showing great improvement. Of the 29 schools accountable for the African American subgroup, 93 percent met AYP. Of the 520 schools accountable for the low SES subgroup, 93 percent also met AYP. Meanwhile, 121 schools did not meet AYP in 2005. Of these schools, 36 Title I schools must provide at least school choice.
