A Review of Mississippi's 1997 Welfare Reform Legislation
June 10, 1997
Introduction The Personal Responsibility and Work Opportunity Reconciliation Act of 1996, commonly known as the Federal Welfare Reform Act, mandated significant substantive changes in the operation of public assistance programs administered with federal funds throughout the states. From the states' standpoint, the most significant changes were:
  • termination of the permanent entitlement program (Aid to Families with Dependent Children [AFDC]) and initiation of a temporary assistance block grant program for working participants (Temporary Assistance to Needy Families [TANF]); and,
  • mandated strengthening of state laws dealing with collection of child support.
The Mississippi Governor's Office, in conjunction with the state Department of Human Services, submitted its first TANF state plan for 1996-1997 to the U. S. Department of Health and Human Services on September 30, 1996. This necessitated legislative action during the 1997 session to conform state law with federal TANF legislation so that the state could receive maximum benefit from the block grant program. The PEER Committee authorized the staff to analyze the state's plan for welfare reform, to assist the chairpersons of the Senate and House committees charged with handling subsequent welfare reform legislation, and to prepare a post-session report on welfare reform.

The Personal Responsibility and Work Opportunity Reconciliation Act of 1996, more commonly known as the Welfare Reform Act, was a far-reaching piece of legislation. The law eliminated Aid to Families with Dependent Children (AFDC), Job Opportunity and Basic Skills (JOBS), and Emergency Assistance programs. It replaced these programs with the Temporary Assistance for Needy Families (TANF) program, which provides time-limited Federal assistance to people through block grants to States. The legislation sets a timetable that States must follow to reduce their welfare rolls and establishes mandatory work requirements. Because of these work requirements, the law also contains child care provisions. Under the previous system, people who left the welfare ranks to enter the workforce often were worse-off due to low pay and high child care costs. Because many welfare recipients have children, what the Welfare Reform Act stipulates regarding child care is very important, especially given the work requirements for parents contained in the act. This review article describes the child care provisions of the Welfare Reform Act, discusses some of the issues related to these provisions, and describes selected State initiatives in this area.

Zuckerman [*] The 1996 welfare reform law radically changed welfare as we knew it, after many years of debate and concerns across the ideological spectrum. Research should have provided essential information to revise the program, but instead, research was used as an ideological weapon to support conflicting points of view. President Clinton promised to end welfare as we know it but his welfare reform plan was superceded by the election of a Republican majority of the House and Senate in 1994. The resulting welfare bill included key elements from the Republican Contract with America. The purpose of this article is to describe how political pressures resulted in a dramatic change in law, despite doomsday predictions and almost no solid information about the law's likely impact.

MARGARET WARNER: When Wisconsin Governor Tommy Thompson signed the Wisconsin Works Bill last month, it was just the latest in a long string of efforts he's made to re-shape welfare in his state. The governor has succeeded in getting approval from Washington to implement several of his ideas, which are aimed at dismantling the basis tenets of the welfare system. GOV. TOMMY THOMPSON, (R) Wisconsin: (1992): For every one of my welfare reform programs that I've put into law or was able to get waivers from the federal government there have been the critics and the nay-sayers, but they want to keep the status quo. I don't want to keep the status quo. The status quo doesn't work. Give us in Wisconsin the flexibility, the opportunity to change it, and we'll show the way for the country to follow. MARGARET WARNER: The program that served as predecessor and role model for Wisconsin Works was an experimental one that's been carried out in two counties in Wisconsin since January of 1995. Called Work Not Welfare, the program ended the entitlement to cash assistance and gave money to participants only through work. Job training programs were offered, as well as medical and child care, and the cash equivalent of food stamps.

Some social welfare advocates worried that single mothers would be unable to find work, or that moving from welfare to work would boost their income while decreasing their material standard of living. For example: A single mother might replace her $550 monthly welfare and food stamps with $800 per month from a $6-an-hour job, yet incur $650 monthly expenses for child- and healthcare.

Background
PROWRA devolved the responsibility for the administration of welfare programs from the federal to the state and local levels through the replacement of the Aid to Families with Dependent Children (AFDC) program with the Temporary Assistance to Needy Families (TANF) block grant. Specifically, PRWORA replaced the federal guarantee to cash assistance with a time-limited strategy that emphasizes the value of work and personal responsibility.

University of Kentucky Nationwide, the number of welfare recipients has been declining. While some may herald these declines as evidence of the success of welfare reform, the declines began before the new welfare legislation. Some research indicates that these caseload declines are the result of federal waivers obtained prior to the welfare reform legislation (i.e. Council of Economic Advisors, 1997). Other research has indicated that the declines are the result of good economic times (i.e. Martini and Wiseman, 1997). Using data from the U.S. Department of Health and Human Services website, this article examines the regional distribution of declining welfare recipiency. In this, dramatic changes have been underway in the South. How Do We Define Success?

Pataki today submitted New York State's welfare plan to the federal government, the first step in the Governor's continuing efforts to build on the historic decline in the state's welfare rolls by moving more people to work. "Our efforts to move people from welfare to work, combined with our tough efforts to improve child support enforcement and to weed out welfare cheats with finger imaging and front-end detection programs, has produced real results for taxpayers and welfare recipients alike," Governor Pataki said. "In less than two years, we have cut the state's welfare rolls by more than 200,000 representing a 12 percent decline in the number of New Yorkers trapped by the failed welfare system," the Governor said. "Despite the progress we have made, welfare remains a way of life for far too many New Yorkers." "Federal welfare reform gives us the opportunity to build on our record here by providing hope, removing the lure of dependency, eliminating disincentives to work and restoring personal freedom to those trapped in the welfare system's vicious cycle," Governor Pataki said.

From: Phil Evans of Fight Crime: Invest in Kids, 202-776-0027, ext. 109 (nights, weekends: 301-949-5630) WASHINGTON, April 12 More than 1,500 police chiefs, sheriffs, prosecutors and victims of violence today called on Congress to increase funds for educational child care for preschool-age children as part of reauthorization of a welfare reform package expected to be voted on by a House subcommittee next week. Leaders of Fight Crime: Invest in Kids, a bipartisan, anti-crime organization, told members of the subcommittee that Congress can greatly reduce crime by expanding a child care assistance program that now has funds to serve only one out of seven eligible low- and moderate-income working families. "Every day we fail to help working families afford quality educational child care and after-school programs, we increase the risk that you or someone you love will fall victim to violence," said Seattle Police Chief Gil Kerlikowske, Fight Crime: Invest in Kids' board chairman. Kerlikowske said research showed educational child care prevents future crime. He said a study of Chicago's Child-Parent Centers showed that children from poor neighborhoods who did not attend the centers as preschoolers were 70 percent more likely to be arrested for a violent crime by age 18 than children who attended the centers. Fight Crime: Invest in Kids President Sanford Newman said that, in part because of successful welfare reform legislation signed in 1996, 62 percent of children under six 13 million kids are in the care of someone other than their parents during the work day. "Will Congress consign millions of these kids to be parked in front of TV's, or will it help them get the good child care that's proven to cut their risk of becoming criminals?" he asked.

    On August 22, 1996, President Clinton signed this legislation into law. This comprehensive bipartisan welfare reform plan seeks to change dramatically America's welfare system, newly emphasizing the exchange of work for time-limited assistance. The subject of intensive debate, the law also encompasses new responsibilities on the part of states and new provision regarding the nation's children. Following, in outline form, are highlights of the welfare reform legislation, including changes from previous bills the President vetoed.
    WELFARE: A TRANSITION TO WORK
  • Work requirements. Recipients must work after two years of assistance, with few exceptions. Twenty-five percent of all families in each state must be working or off the welfare roles in fiscal year (FY) 1997, with the number rising to 50 percent by FY 2002. Single parents must work at least 20 hours per week the first year in order to receive assistance, and at least 30 hours weekly by FY 2000. Two-parent families must work 35 hours a week by July 1, 1997.
  • Support for transition. The law provides $14 billion in child care funding over six years to help more mothers move into the workforce. It also guarantees that women on welfare will continue to receive health coverage for their families, including at least one year of transitional Medicaid when they leave welfare for work.

Updated July 23, 1998 Welfare as we knew it no longer exists. The 61-year American tradition of guaranteeing cash assistance to the poor came to an end with the signing of legislation in August 1996. But over time, the system became increasingly unpopular. Political opinion turned against the idea of anyone getting rewarded for being idle. Social critics said welfare was responsible for a permanent underclass of people living off government checks because the incentives to go to work were so weak. Now, a federal system that was once fairly consistent has been turned over to the states, where programs are diverging widely. And it is far from clear whether the poor will be better or worse off.
