Site Map A Brief History of the Diocese of Wilmington The Diocese of Wilmington was established in March of 1868 by Pope Pius IX under the leadership of its first Bishop, the Right Reverend Thomas Andrew Becker, D.D. It comprised at the time the entire State of Delaware, the nine counties of Maryland and the two counties of Virginia east of the Chesapeake Bay. These areas constitute the geographic area known as the Delmarva Peninsula. In 1974, Pope Paul VI transferred the Virginia territory of the Diocese of Wilmington to the Diocese of Richmond after the construction of the Chesapeake Bridge-Tunnel improved convenient travel between the Eastern Shore counties of Virginia and the mainland. When Richmond, Virginia native Bishop Becker was consecrated in August of 1868 as the first Bishop of the Diocese of Wilmington, he had a somewhat discouraging list of resources: eight priests, 18 churches, an orphanage, academy for girls and parochial school, all conducted by the Daughters of Charity at St. Peter, Wilmington; parochial schools at St. Mary, Wilmington and St. Joseph, Brandywine Banks, conducted by the Sisters of St. Joseph, who were immediately recalled to Philadelphia by Bishop James Wood upon learning of the establishment of the new diocese. Harris, Senior Attorney On June 27, 2002, in Zelman v. Simmons-Harris , the United States Supreme Court upheld Ohio’s school voucher initiative, authorizing government aid for students in failing Cleveland public schools to attend, upon independent parental choice, private and parochial schools. Similar education reform initiatives would face distinct challenges in the Commonwealth. Significantly, traditional legal interpretation of Virginia constitutional provisions has been more restrictive than those for federal constitutional provisions addressing government entanglement with religion. While carefully crafted voucher initiatives aiding sectarian private schools may pass muster under the U.S. Constitution, application of the Commonwealth’s constitutional requirements could warrant a different result. In recent years, education reform efforts nationwide have assumed a variety of forms, whether addressing accountability, school choice, or charter schools. Prompting intense judicial scrutiny in recent years, however, are those school choice initiatives—vouchers, tuition tax credits and deductions, and tuition reimbursement programs—involving private sectarian schools and potentially implicating federal as well as specific state constitutional issues regarding the separation of church and state. Called into question within the U.S. Constitution is the establishment clause of the First Amendment, providing that "Congress shall make no law respecting an establishment of religions...."

Anyone joining after 5 A.M. never got in—except those given special seating, including such notables as Senator Edward Kennedy, Health and Human Services secretary Tommy Thompson, and former White House counsel C. Boyden Gray. It was well worth the wait. Persistent questioning, passionate debate, direct self-contradictions, an electric atmosphere—all were there. As the 80-minute conversation came to an end, a pro-voucher resolution seemed to have just barely emerged, the outcome turning as much on educational facts as constitutional questions. The Court seemed as much a national school board as an interpreter of the Constitution’s Establishment Clause. Questions seldom focused on past jurisprudence—probably because earlier decisions have constructed a wall of separation between church and state as serpentine as the one Thomas Jefferson designed for the University of Virginia’s campus. Instead, the day’s focus was on vouchers, charter schools, and the woeful state of public education in Cleveland. The justices seemed to realize that they were discussing the future of low-income, inner-city children, not just fine points of legal doctrine. It was Justice David Souter who first posed the central question to Ohio assistant attorney general Judith French: “Isn’t it true that something like 99 percent of the students who were receiving these vouchers are in religious schools?” Such restricted choice was very different from the “choice from [among] the great universe of colleges and universities,” where federal aid to religious institutions has been generally regarded as constitutional.
