State Regulations on Coaching Authorization The following Coaching Authorization Regulations (Title 126 Legislative Rule Series 136) were enacted in July 1997 by the West Virginia Board of Education. 23.1 Initial Authorizations and Renewal. 23.1.1. General Criteria - An authorization may be issued to a person who has completed: 1) the minimum degree specified in Appendix A through an accredited institution of higher education as defined in §126-136-4.2, if applicable; (not applicable to coaches) 2) the general requirements specified in §126-136-13.1: General Requirements - A license to work in the public schools of WV may be granted to an applicant who is 1) a United States citizen, 2) of good moral character, 3) physically, mentally, and emotionally qualified to perform the duties to which he/she is assigned, and 4) has attained the age of eighteen years on or before the first day of October of the year in which the license is issued (WV Code §18A-3-2a). 3) the minimum grade point average specified in §126-136-13.2, if applicable (not applicable to coaches); and

Scholarship § 127-2-6 Scholarship A student is required to do passing work in the equivalent of at least 20 periods (four subjects with full credit toward graduation) per week. Failure to earn passing marks in four full credit subjects during a semester shall render a student ineligible for the following semester. A semester course that constitutes 8100 minutes of instruction (block schedule) will count as two subjects. The student may select four full credits from any area of the curriculum offered by the school. If a student is taking a multiple period subject, such as block or vocational courses for a full morning or afternoon, it may be counted as more than one subject. The number of subjects counted will be equal to the units of full credits given. If a student has been declared ineligible according to the standards outlined above, the student may attend summer school and have eligibility reinstated if the student meets the standards at the conclusion of summer school. If a student has been declared ineligible according to the standards outlined above, the student may have eligibility reinstated at midsemester if the student is meeting the standards at that time.

At its September 2001 meeting, the Board of Education authorized the Department of Education to prepare revised Standards for School Counseling Programs in Virginia Public Schools. The department convened a writing team that included representation from the Board of Education, the Department of Education, and school counselors across the Commonwealth. State standards adopted in 1984 were used to provide the basis for this revision.
These standards are consistent with Board of Education regulations in that they are comprised of three domains: academic, career, and personal/social. Specifically, the Board regulations provide the following description of guidance and counseling services across these domains:

    President Virginia Board of Education 227 North Main Street Hillsville, Virginia 24343 Dear Mr. Jackson: This is in response to your March 26, 2004 request for a three-year exception to the 1.0 percent statewide cap on the number of proficient and advanced scores from alternate assessments based on alternate achievement standards that can be included in adequate yearly progress (AYP) decisions. You have requested a cap of 3.5 percent. Because your request is intended to enable students without the most significant cognitive disabilities to be considered proficient when they are assessed below grade-level, we must disapprove your request. Virginia administers the Virginia Alternate Assessment Program (VAAP) to certain students with disabilities. Based on the two years of data that were submitted for review, less than one percent of students in the grades tested participated in the VAAP. Specifically:

    Shenandoah County GATE Program Gifted Regulations Gifted Education in Virginia Local Program Services for Gifted, grades K-12 Go to the above site to find out about Gifted Education in Virginia. Gifted program services in the Shenandoah County are regulated by several standards, including: Shenandoah County Public Schools' Local Plan for the Education of Gifted Students The GATE Resource Specialists, school personnel, parents, and a School Board representative completed work on revisions and corrections of the current Local Plan in April 2005. It will be presented to the School Board and hopefully approved at the June 2005 board meeting. During the summer, it will be evaluated through a peer review process. Next it will be sent to the Department of Education in September 2005 for approval.     INTRODUCTION TO THE COURT OPINION ON THE WEST VIRGINIA BOARD OF EDUCATION V. BARNETTE CASE
    There are two clauses regarding religion in the First Amendment. One is the Establishment Clause, which prohibits the government from establishing any sort of official religion (see next document); the other is the Free Exercise Clause, which forbids the government from restricting an individual's religious practices. Free exercise claims often overlap claims to freedom of expression, and several of the most important religion cases mixed issues of free speech and free exercise together. A key element in religion clause jurisprudence is the dichotomy between belief and action originally enunciated by Chief Justice Morrison Waite in 1879. While the First Amendment absolutely prohibits government efforts to restrict beliefs, it does not prevent the state from forbidding practices that threaten public order or safety. In the example Waite used, if a sect believed in human sacrifice, the government could do nothing to restrict that belief; but it could, without violating the Free Exercise Clause, bar the actual sacrifice. While this belief/action analysis remains useful even today, the Court came to recognize that in some areas belief and action overlapped. The Jehovah's Witnesses are a relatively small sect in the United States, but they are responsible for some of the most important cases establishing religious freedom. The Witnesses claimed a right to proselytize, an action, without state regulation, as essential to the free exercise of their creed, a belief. In several cases the Court upheld these claims, but primarily on speech rather than religion clause grounds, yet these decisions are in fact the basis for modern jurisprudence on the Free Exercise Clause.
