West Virginia Boating Regulations and Laws
The West Virginia Boating Safety Education Card (also referred to as the West Virginia boating license) is proof that a boater has taken and passed an approved boater education course. The West Virginia Division of Natural Resources Law Enforcement Section currently has a mandatory boater education requirement that has been law since January 1, 2001 requiring all boaters born on or after December 31, 1986 to have the West Virginia boating license on board when the vessel is underway to satisfy the West Virginia boating regulations. Many boating fatalities occur because boaters aren't educated about boating safety. The West Virginia DNR Law Enforcement Section believes that an educated boater is a safer boater.

D E C I S I O N

Doris Rowe (hereinafter Grievant) filed this grievance on April 28, 1994, against her employer, the Kanawha County Board of Education (hereinafter Board), pursuant to the provisions of West Virginia Code et seq . This claim was denied at the lower two levels of the grievance procedure and appeal was made to level four by form dated October 3, 1994. The statement of grievance relied upon at level four is as follows: "Transferred from a position that I had held for two years to accommodate a less seniored - less qualified employee who was hired under a federal grant to assist me and the other special educator due to a 'heavy caseload'." Grievant seeks reassignment to her previous position. The parties agreed that this Decision could be based upon theevidence presented at the level two hearing and the statements and arguments presented to the Board at Grievant's transfer hearing held on April 15, 1994. The case became mature for decision on March 3, 1995, after receipt of the record.
The following findings of fact have been properly deduced from the evidentiary record developed in the case.

MANDATORY CLE IN WEST VIRGINIA Rules and State Bar By-Law Amendments Effective July 1, 1986 2. CONTINUING LEGAL EDUCATION COMMISSION. There is hereby established a Continuing Legal Education Commission ("Commission") to administer the program of mandatory continuing legal education established by these rules. 2.l The Commission shall consist of nine members, at least seven of which shall be active members of The West Virginia State Bar. It will elect its own chairperson. 2.2 Members of the Commission shall be appointed by the Board of Governors of The West Virginia State Bar, and confirmed by the Supreme Court of Appeals. Any vacancy occurring on the Commission shall be filled by the same appointment procedure. Members shall continue to serve until their successors are appointed and confirmed notwithstanding any age restrictions. 2.3 At least three members of the Commission shall be under the age of 36 or admitted to The West Virginia State Bar for less than ten years.

CHAPTER 18. EDUCATION. ARTICLE 8. COMPULSORY SCHOOL ATTENDANCE. West Virginia Code §18-8-1. Commencement and termination of compulsory school attendance; exemptions. (a) Compulsory school attendance shall begin with the school year in which the sixth birthday is reached prior to the first day of September or upon enrolling in a publicly supported kindergarten program and continue to the sixteenth birthday. Exemption from the foregoing requirements of compulsory public school attendance shall be made on behalf of any child for the causes or conditions set forth in this section. Each cause or condition set forth in this section shall be subject to confirmation by the attendance authority of the county.

Adopted by the Board of Education, Commonwealth of Virginia
February 25, 1993 PREAMBLE Article VIII, Section 1 of the Virginia Constitution delineates the General Assembly's responsibility for education as follows:
"... shall provide for a system of free public elementary and secondary schools for all children of school age throughout the Commonwealth and shall seek to ensure that an educational program of high quality is established and continually maintained." Section 2 of Article VIII requires the Board of Education to prescribe ". . . Standards of Quality for the several school divisions. . ." Standard 1 of such Standards of Quality, as enacted by the General Assembly, requires each school division to "...conduct a program acceptable to the Board of Education for the early identification of gifted and talented students." It is further stated that "...each school division shall offer appropriately differentiated instructional opportunities in accordance with guidelines of the Board of Education for identified gifted and talented students." The requirements which follow set forth procedures for the development and operation of division-wide special services for gifted students. These requirements, when coupled with the Virginia Plan for the Gifted, provide guidelines to meet the aforesaid statutory requirements.

Policy 2520.16 Alternate Academic Standards for WV Schools
Background: ESEA/NCLB requires that states adopt challenging alternate academic achievement standards that are linked to their grade-level academic content standards, promote access to the general curriculum and reflect professional judment of the highest achievement standards possible. The WV Alternate Assessment, currently under revision, must align with the state's alternate achievement standards. 2520.16 is a new policy that defines the alternate academic achievement standards for students with the most significant cognitive impairments as required by Policy 2510 and ESEA/NCLB.
