GOVERNMENT AND POLITICAL CONDITIONS
A new state constitution was approved in April 1992, reaffirming the central role of the Communist Party of Vietnam (CPV) in politics and society, and outlining government reorganization and increased economic freedom. Though Vietnam remains a one-party state, adherence to ideological orthodoxy has become less important than economic development as a national priority.
The most important powers within the Vietnamese Governmentin addition to the Communist Partyare the executive agencies created by the 1992 constitution: the offices of the president and the prime minister. The Vietnamese President, presently Tran Duc Luong, functions as head of state but also serves as the nominal commander of the armed forces and chairman of the Council on National Defense and Security. The Prime Minister of Vietnam, presently Phan Van Khai, heads a cabinet currently composed of three deputy prime ministers and the heads of 26 ministries and commissions, all confirmed by the National Assembly.
The present 15-member Politburo, elected in April 2001 and headed by Communist Party General Secretary Nong Duc Manh, determines government policy, and its Secretariat oversees day-to-day policy implementation. Although there has been some effort to discourage membership in overlapping party and state positions, this practice continues. Five of the Politburo membersPresident Tran Duc Luong, Prime Minister Phan Van Khai, Deputy Prime Minister Nguyen Tan Dung, Minister of Public Security Le Hong Anh, and Defense Minister Pham Van Traconcurrently hold high positions in the government, while anotherNguyen Van Anserves as Chairman of the National Assembly. In addition, the Party's Central Military Commission, which is composed of select Politburo members and additional military leaders, determines military policy.

GOVERNMENT AND POLITICS
Party and Government : Democratic Republic of (North) and former Republic of (South) Vietnam united to form Socialist Republic of Vietnam on July 2, 1976. Constitution adapted in 1980 stipulates National Assembly as highest governing body. Members serve five-year terms and nominally directly elected by electorate. Council of State, which serves as collective presidency, and Council of Ministers, which manages governmental activities, nominally accountable to, and elected by, National Assembly. Political power effectively in hands of Vietnamese Communist Party (VCP, Viet Nam Cong San Dang). Most government positions filled by party members, who act at direction of party. Party led by National Party Congress, which meets infrequently. Congress elects Central Committee, which in turn elects Political Bureau, party's highest policy-making body. Administrative Divisions: Country divided into thirtysix provinces, three autonomous municipalities, and one special zone. Provinces divided into districts, towns, and capitals. Judicial System : Supreme People's Court; local People's Courts at provincial, district, and city levels; military tribunals; and People's Supreme Organ of Control. National Assembly elects Procurator General, who heads People's Supreme Organ of Control and performs overall administration of justice.

The National Assembly
Despite its many formal duties, the National Assembly exists mainly as a legislative arm of the VCP's Political Bureau. It converts Political Bureau resolutions into laws and decrees and mobilizes popular support for them. In this role, the National Assembly is led by the Council of Ministers acting through the Council of State and a variable number of special-purpose committees. Actual debate on legislation does not occur. Instead, a bill originates in the Council of Ministers, which registers the bill and assigns a key party member to present it on the floor. Before presentation, the member will have received detailed instructions from the party caucus in the assembly, which has held study sessions regarding the proposed legislation. Once the legislation is presented, members vote according to party guidelines. A general national election to choose National Assembly delegates is held every five years. The first election following the reunification of the North and South was held in April 1976 and the voters selected 492 members, of which 243 represented the South and 249 the North. In 1987 the Eighth National Assembly numbered 496 members. Because successful candidates were chosen in advance, the electoral process was not genuine. No one could run for office unless approved by the party, and in many cases the local body of the party simply appointed the candidates. Nevertheless, every citizen had a duty to vote, and, although the balloting was secret, the electorate, through electoral study sessions, received directives from the party concerning who should be elected. The elections in 1987, however, were comparatively open by Vietnamese standards. It was evident that the party was tolerating a wider choice in candidates and more debate.

Vietnam's government continues to suppress freedom of expression. Its latest target: the growing use of the Internet by Vietnamese dissidents such as Le Chi Quang [lay chee kwahng]. Le Chi Quang is a young lawyer and human rights activist. Soon after graduating from law school in 2000, he began to write about human rights abuses by Vietnam's Communist regime. His articles were banned by Vietnam's government-controlled press but were published abroad and on the Internet. He was placed under house arrest in September 2001. His phone service was cut off. Friends and relatives were warned by authorities to stay away from him. He was prevented from finding work as an attorney. Le Chi Quang continued to publish criticism of the Vietnamese government on the Internet. In February 2002, he was arrested at an Internet caf© in Hanoi. In October, he was sentenced to four years in prison for so-called "acts of propaganda against the state." Friends and supporters fear for his life. Physicians from around the world sent an open letter to Vietnamese authorities in November warning that Le Chi Quang suffers from kidney disease and needs immediate treatment.

Capital Market Roadmap
In September 2003, the State Securities Commission, in close partnership with the Asian Development Bank, issued a 10-year Capital Market Roadmap to build sophisticated capital markets in Viet Nam. The Roadmap outlines a number of critical reforms that focus on demand and supply of securities, market intermediaries and infrastructure, and the legal and regulatory framework.
The chapter on Implementation Framework details the various reforms slated for the three separate phases of the Roadmap. Phase I will be implemented by 2006, Phase II from 2007-2009, and Phase III from 2010-2012. The complete document is linked below. It states that, to have the capacity to work and sign work contract, a female worker must be at least fifteen years old (article I.1). Moreover, enterprises must consult with trade unions to determine reserve occupations for women workers (a job different from the one a woman worker is practising which is to be used, until retirement, when she can no longer continue her current job). The enterprise must provide training for women for these reserve occupations (article III.1 and 2). Article IV provides methods to determine the enterprises that are to be considered as employing many female workers, as stipulated in article 5 of Decree No. 23-CP of 18 April 1996.
