CHARTER SCHOOL STUDY COMMITTEE MEETS AT LAST The first meeting of the charter school study committee took place on Wednesday, September 26. Legislative Council staff member Anne Winchester made a presentation on the committee's charge and an overview of how the committee could work. She was followed by John Nelson of the department of education (DOE) who spoke about special education issues. Next up was the DOE's Bud Myers who talked about standards in Vermont schools and how they might have an impact on charter schools. After a break for lunch, Education Commissioner David Wolk spoke very positively about charter schools, but he was followed by presentations from charter opponents Edie Miller of the Vermont School Boards Association and Joel Cook of the Vermont NEA.

Many school choice opponents say there is no evidence that it works. That they don't know of such evidence does not mean it doesn't exist, it only shows that they are ignorant of the facts. As often indicated here, school choice in developed nations is the rule not the exception, and it exists in the U.S., such as the G.I. Bill. Both the federal and state governments have education programs using vouchers so its general application at the K-12 level would not be the "radical" idea some charge but merely the extension of what has been shown to work. Even at the K-12 level funding students has a longer history than is generally recognized. Five of the six New England states have had such an experience, all but Rhode Island, and vestiges still remain in Connecticut, Maine and New Hampshire. Vermont, however, has maintained this practice, sometimes termed as "tuitioning," on the most extensive basis of any of the states. One reason for this is that the state has perhaps an ideal education mandate in its constitution. If there must be mandates they should be as flexible as possible and not, as many states have them, too prescriptive in what must or must not be done.

At Lyndon Institute
In January of 2003, Lyndon Institute (LI) added dance to the performing arts department. Over the course of a year and a half, the program has doubled in size with 63 enrolled for the fall semester of 2004 and held numerous events for the school and community. Dance is a full time position at Lyndon Institute now offering 5 classes a day. Ms. Rebecca Smith teaches Dance I, Dance II, Jazz Dance I and II, and Lyrical Ballet. In each class, the students get a chance to explore technique as well as experiment with the elements of movement and the choreographic process. Not only is dance offered during the day at LI, but after school too. Students have the chance to join dance club and a new group for boys in hip hop style movement. Those participating in dance have the chance to perform at football games, talent shows, airband competitions, travel to performances and classes at the Flynn Center and the Hopkins Center, perform and teach in area schools, and bring in artists and performers. Last September, LI hosted guest artist Clyde Evans and his professional hip hop company, Chosen. They offered master classes for area schools, an evening session for teachers and

NO. 120. AN ACT RELATING TO THE CRIME OF HAZING. (S.76) It is hereby enacted by the General Assembly of the State of Vermont: Sec. 1. STATEMENT OF POLICY The general assembly has been made increasingly aware that harassment and hazing have become a major and pervasive problem within our schools, and that students who are continually filled with apprehension and anxiety are unable to learn and unlikely to succeed. Therefore, it is the policy of the state of Vermont that all Vermont educational institutions provide safe, orderly, civil and positive learning environments. Harassment, hazing and bullying have no place and will not be tolerated in Vermont schools. No Vermont student should feel threatened or be discriminated against while enrolled in a Vermont school.

I. GOVERNANCE, LOCAL AND STATE
A. ROLE OF SCHOOL BOARDS
RESOLUTION
The 2005-2007 Vermont Legislature should review and revise existing statutory roles prescribed for school boards, superintendents, and principals. The laws should expressly charge school boards with the four primary functions: defining vision, establishing structure, providing for accountability, and advocating for students and public schools. Overlapping duties should be reviewed and simplified, if possible. Duties that are time-consuming but not essential to core board duties should be optional. School boards should be permitted by law to delegate duties as they see fit to administrators, subcommittees and other panels that are accountable to school boards.
B. LOCAL DECISION MAKING
RESOLUTION
Local school boards have been given responsibilities by state statute to oversee public education in their districts and to make the important decisions necessary to assure the provision of high quality education in an efficient and effective manner. As local boards are accountable, they must be assured that there is no state interference in their statutory decision-making responsibilities.

Dealing with School Violence A Vermont Superior Court decision, while a victory for public school districts, exemplifies some of the difficulties public schools must face when protecting themselves from liability for student-on-student assaults. In Cheney v. North Country Union High School, et al., the Orleans County Superior Court recently dismissed claims against a high school and supervisory union brought by a student who was severely injured when another student allegedly struck her and threw her down a flight of stairs. The Superior Court ruled that there was no evidence the school district had any reason to believe that the aggressor student was a threat to other students before the incident, and therefore dismissed the claims.
In Cheney, the injured student claimed that she was the victim of an unprovoked attack, and that the high school and supervisory union were negligent in failing to supervise students in the hallways between classes. She also alleged that such failure encouraged the aggressor to commit the assault and that, had monitors or teachers been present, they would have prevented the aggressor from acting. Finally, the student alleged that the school knew the aggressor was violent.

At the three-way stop sign, continue straight for another 1/4 mile. Take the second right onto Regwood Drive, then turn left onto Mansion Drive. Proceed up the road to the Field House, which is the first building on the right.
From Massachusetts - Take Route 7 North to Bennington. Turn left onto Elm Street (across from Friendly's Restaurant), and continue until the street ends. Turn left onto Monument Avenue and go about 1/4 of a mile. Take the second right onto Regwood Drive, then turn left onto Mansion Drive.
