(802) 828-2481 Facsimile LEGISLATIVE ACTIVITY Among the responsibilities with which the Legislature has charged the Human Rights Commission is the duty to .examine and evaluate. the effectiveness of Vermont.s civil rights laws and .the existence of practices of discrimination which detract from the enjoyment of full civil and human rights.. The Commission is further mandated to .recommend measures designed to protect those rights.. 9 V.S.A. § 4552(a). The Commission fulfills this mandate by, among other things, suggesting legislation designed to protect Vermonters. civil rights, commenting on proposed legislation that would affect civil rights, and providing information and advice to the Legislature. During the 2003 Legislative Session, the Human Rights Commission worked to secure the passage of the bills described below.

The Current and Desired States
The Vermont educational community, in order to survive and prosper in the future, must implement significant fundamental change. Educators must adapt to an evolving global community and corresponding technological advancements and applications.
The Vermont State Technology Council believes that educators must utilize modern information technology tools in the effort to reinvent Vermont schools. With this in mind, VSTC has prepared this document. Its goal is to provide direction and a framework for Vermont Educational leaders and stakeholders in the implementation of a joint new vision.
This document is divided into three sections.
Section 1 describes the "present state" of information technology tools in Vermont's educational community. This section presents a "picture" comprised from many sources including VSTC member comments, personal experiences of VSTC board members, and from data collected at recent conferences.
Section 2 describes the "desired state." In this section, the Council outlines what role information technology should play in the future educational environment.

The American Music Conference (AMC) in their third annual survey conducted in conjunction with the Music Teachers National Association; the National School Boards Associations, Perseus Development Corporation, VHl Save the Music Foundation, and Yamaha Corporation of America named Rutland City Schools as one of the best places in the nation to learn about music. “Seeing so many new communities on the list this year is encouraging,” says Bill Everitt, President of AMC. “It tells us how dynamic the state of music education is.” Everitt added that the data collected in the survey will help establish a current “snapshot” of music education in America and help point the way to greater success in every community. “In a year when President Bush signed the landmark No Child Left Behind Act, which finally recognizes music and the arts as core subjects, it’s more important than ever that we know how to move forward in providing quality music education for every child,” he explained. The webbased survey reviewed communities funding, enrollment, student-teacher ratios, participation in music classes, instruction time, facilities, support for the music program, participation in private lessons and other factors in their communities’ quality of music education.

Act 125, the School Environmental Health Act, was signed into law by Gov. Dean in the spring of 2000. The law requires the Vermont Departments of Health, Education, and Buildings and General Services to create a program that will protect children at school from low level exposures to harmful chemicals, and to improve environmental health at schools. Schools are not required to sign up for this program, the law only "encourages" schools to be involved.

Leland and Gray’s Asian Studies Academy
and Sino-American Performing Arts Exchange Based on the success of Journey East I , the Freeman Foundation has given Leland and Gray $433,446 for an innovative three-year program that includes, among other components, a high-school based semester-long program of study and a Sino-American performing arts exchange in both Spring of 2002 and Spring of 2004. What will the high-school based part of the program be like?
    The program for the spring semesters of 2002 and 2004 will involve several adults and two groups of 22 different students including up to five students from outside our district - in a school-within-a-school type learning environment. Students in this Asian studies "academy" will dive into learning focused on Asia. In addition, they will engage in collective creation of a performance piece to be presented at various venues in China.

Health Education
One of the five goals
Education Statute Title 16, Part 2, Chapter 23, Subchapter 1, Section 906 requires "Physical education and comprehensive health education including the effects of tobacco, alcoholic drinks, and drugs on the human system and on society;" however grades, levels, or amount of instruction time are not specified. Education Statute Title 16, Part 1, Chapter 1, Subchapter 7, Section 131 (1987) defines a comprehensive health education program as "a systematic and extensive elementary and secondary educational program designed to provide a variety of learning experiences based upon knowledge of the human organism as it functions within its environment;" but again this statute does not specify grades, levels, or amounts of instruction. Health education is not a coursework requirement for high school graduation.
Vermont's Frameworks for Standards and Learning Opportunities
(2000), which includes healthy choices, were approved by the State Board of Education. The state does not require schools to follow a specific curriculum.

State General Fund Transfer
The General Fund pays for most of the services that state government provides, such as the state police or the Health Department.
Money transferred from the General Fund is the second-largest revenue source for Vermont schools.
Of the many tax sources that are deposited in the General Fund, the largest is the income tax.
State law provides that the legislature and Governor must transfer a certain amount from the General Fund to the Education Fund each year.
For FY-05 the amount to be transferred is $249.3 million. This amount is adjusted each year, rising and falling at the same rate as total General Fund spending. While the law provides the amount that will be transferred each year, the legislature and the Governor can change the law.
Every dollar the legislature transfers from the General Fund to the Education Fund is a dollar that does not need to be raised in property taxes.
Attempts to reduce this transfer to make money available for other uses end up increasing property taxes. Similarly, shifting costs to the Education Fund that previously had been funded from the General Fund also increases property taxes.

Abigail Thernstrom Les Jin, Staff Director The Vermont Advisory Committee submits this report, Racial Harassment in Vermont Public Schools: A Progress Report, as part of its responsibility to advise the Commission on civil rights issues in the state. The Committee approved this report in a vote of 13 to 0, 1 abstention. Beginning in the mid-1990s, the Committee received allegations that a racially hostile environment and discrimination were widespread throughout the state’s school system. Despite state law requiring local school boards to adopt policies and procedures to address harassment, many did not comply. Following a two-day forum in November 1997 designed to address these issues, the Committee released its report, Racial Harassment in Vermont Public Schools
