    Bullying and Student Harassment
    Legislative responses to school violence are multifaceted and involve several systems including education, juvenile justice, mental health and health. This compilation presents examples of recent state enactments and is not inclusive of all legislative actions. For more information on specific issues, contact NCSL's Denver office. AR 2003 Arkansas Act 681, HB 2274 - Requires school districts to adopt policies to prevent student harassment and bullying. Policies must define bullying, prohibit bullying on school property, at school-sponsored activities and on school buses and state the consequences of engaging in bullying behavior. Also requires school employees to report incidents of bullying to the school principal and provides for immunity from tort liability for those who report but fail to remedy the incident. Requires the policy to be clearly communicated and available, reviewed by the State Board of Education and filed with the State Department of Education. Also adds bully prevention programs to the list of student services provided by school guidance counselors. CA 2001 Cal. Stats., A.B. 79, Chap. 646 -

    Nutrition and Physical Education
    "A healthy and effective environment for learning involves school cafeterias and nutrition programs; high-quality, standards-based, daily physical education and competitive sports; and family and community involvement." National Association of State Boards of Education (NASBE). Approximately 15 percent of adolescents ages 12 to 19 are overweight. This number has nearly tripled in the last 20 years. Without proper nutrition and physical activity, the tendency to gain weight increases. As long as poor diet and sedentary behavior continue, the chances of becoming overweight or obese climbs higher. Youth who are overweight or obese are more likely to become overweight and obese adults with significant health problems. The number of youth who are diagnosed with "adult" diseases such as Type 2 diabetes, or suffer from risk factors for heart disease, such as high cholesterol, and high blood pressure, have grown to record numbers over the years. In addition to the physical problems, youth can suffer from psychological problems such as depression, eating disorders and low self-esteem. According to the Centers for Disease Control and Prevention (CDC), the estimated total annual health costs attributed to obesity is $117 billion. Nutrition and physical activity are tied together and provide the back drop for, or the ability to prevent, obesity for any age group.

Staff in Wells, Vermont The aliens, competent and uncompromising, sucked out the brainpower of the education populace. Decimating the town’s ability to academically lead the next generation into knowledgeable adulthood, the aliens left behind an institution shy on personnel and a village wondering "why?" Other World The reality of the world today combines traditional education with technology. There are those, however, who stubbornly cling to romanticized images of the one-room schoolhouse - images from a bygone era best suited for placement as curiosities in cute tourist books. . Wells, a town just shy of 1,000 people in southwestern Vermont, is a wonderful, geographically and strategically well-situated small town. Vermont and its half-a-million people, invite three-to-four times that number to visit each year in order to financially help support the State through tourism. Vermont is considered by many throughout the nation to be an "other world." The description of Vermont as a "socialist" state is recognition and respect for an ideology accepted by a broad spectrum of working people.

The Vermont court system is administered by the Supreme Court. The court administrator, the administrative judge for trial courts and court appointed boards and committees assist the Supreme Court by seeing that administrative policies adopted by the court are carried out.
  • The Office of the Court Administrator has overall responsibility for the management of Vermont's trial, probate and environmental courts as well as the Vermont Judicial Bureau. The administrative judge assigns judges among the trial courts, investigates and resolves complaints about the operation of the trial courts, resolves scheduling conflicts of trial attorneys and oversees judicial education. Boards and committees established by the Supreme Court perform other administrative functions.

NARROWED TO THREE CANDIDATES
Montpelier, VT - The field of candidates to become Vermont's next commissioner of education has been winnowed to three finalists, according to the National Association of State Boards of Education (NASBE), which is facilitating the nationwide search on behalf of the Vermont State Board of Education.
"In the State Board of Education's search to find the best individual to lead Vermont in providing a quality education for all of our children, we have chosen three excellent finalists," said Diane Mueller, chairwoman of the State Board.
Governor Douglas said he is pleased with the work of the State Board and its willingness to include his office early in the selection process. "The level of collaboration in this process speaks to the importance of finding the best possible candidate to lead the education department. The Board has done an excellent job narrowing the field to these finalists," he said.
"The three individuals were selected from national pool of candidates," said NASBE Executive Director Brenda Welburn. "Each is a highly-qualified educator with the knowledge and experience to manage the state's public education system."

The Vermont Board of Education, along with Governor Howard Dean, conducted personal interviews with candidates on October 8, 2001, resulting in the selection of the three finalists.
David Larsen, Chairman of the State Board, said the interviews "focused on each individual's educational philosophy, management style, and leadership abilities. The Board was impressed with the credentials of all of the applicants for the position, but we identified three candidates with truly exceptional qualifications."
The three finalists are:
  • Peter A. Clarke , who currently serves as Principal of Bronxville High School in Bronxville, New York.
  • Dr. James D. Lombardo , who is the Superintendent of Schools in Addison Central and Northeast Supervisory Union, Middlebury, Vermont.
  • Raymond J. McNulty , who is the Superintendent of Schools in Windham Southeast Supervisory Union, Battleboro, Vermont.
In the final phase of the interview process, the Vermont Board of Education, along with Governor Dean and focus groups from around the state, will conduct candidate interviews

MONTPELIER Steadily over the course of his three years in office, Republican Gov. Jim Douglas has built a majority of appointees on the state Board of Education.
That scares some members of the Democratic-controlled Legislature. This week, the House Education Committee will discuss a bill that would add four legislators to the board, a move that has generated debate over who should have control of Vermont's education system. Sen. Peter Welch, D-Windsor, Senate president pro tempore, claims Douglas has a litmus test for appointing only those who favor school choice to the board. The board has six Douglas-appointed voting members and three appointed by former Gov. Howard Dean, a Democrat. Douglas counters that he never specifically asked any of his appointees for their views on school choice or any other single issue, but adds, "Why wouldn't I appoint people to positions of power whose positions I agree with?"
