In keeping with the provisions of the Agricultural Credit Act of 1987, Title 5 "State Mediation Programs," the State of Utah has implemented the following voluntary mediation program. It is important for farmers and lenders to understand what farm credit mediation is and how it is being implemented in Utah. Mediation is a process used to solve problems and settle disputed issues related to farm credit, debt restructure and voluntary liquidation of farm property. Mediation introduces a neutral third party into borrower and lender discussions in order to facilitate discussion and generate alternative plans. All decisions are made by the borrowers and lenders. Farmers and creditors come to mediation with the understanding that they will seek a mutually agreeable solution that, in the best way possible, meets the needs of all parties. It is not intended to replace the serious good faith bargaining and discussion inherent in borrow/lender relationships. On behalf of our Agricultural Farm Credit Advisory Committee, we are pleased to offer this voluntary mediation program as an excellent resource for the farmers and lenders who find themselves in a conflicting situation.

7a Loan Program
Loan proceeds can be used for most sound business purposes including working capital, machinery and equipment, furniture and fixtures, land and building (including purchase, renovation and new construction), leasehold improvements, and debt refinancing (under special conditions). Loan maturity is up to 10 years for working capital and generally up to 25 years for fixed assets.
504 Certified Development Company Program
The 504 Program provides long-term, fixed-rate financing to small businesses to acquire real estate or machinery or equipment for expansion or modernization. Typically a 504 project includes a loan secured from a private-sector lender with a senior lien, a loan secured from a CDC (funded by a 100 percent SBA-guaranteed debenture) with a junior lien covering up to 40 percent of the total cost, and a contribution of at least 10 percent equity from the borrower. Assessment of Budget Decentralization Program
  • endorsed the Judiciary's implementation of budget decentralization for the courts and stated that other federal agencies could benefit from similar programs; reported that courts and the AO viewed budget decentralization as an overwhelming success; reported that courts had voluntarily returned over $300 million in unspent funds; praised fair and equitable funding allotments to all court units; remarked that courts have a high regard for the quality of AO support provided; and said that, with decentralization, courts and the AO actively seek to prevent the occurrence of waste, fraud, and abuse.
Financial Accounting System for Tomorrow The Financial Accounting System for Tomorrow (FAS 4T) has been fully implemented in 12 circuits and in 94 districts, thanks to the leadership of numerous court and AO staff. For the first time, courts are operating a single integrated core financial system. More than an accounting system, FAS 4T has become the financial core for national systems that require financial data, such as the Integrated Library System and the Jury Management System. Plans are underway to interface other national systems that require financial data with FAS 4T, such as CM/ECF and PACTS- ECM. Civil/Criminal Accounting Module The Civil/Criminal Accounting Module (CCAM), a component of FAS 4T that supports civil and criminal accounting and cash receipting, is now operational in two alpha courts in the District of Arizona and the District of South Carolina. From the alpha courts' implementations, lessons learned were applied to refine the CCAM for the next wave of beta courts in the District of Maine, the Northern District of New York, the Western District of Kentucky, the Western District of Virginia, the District of Utah, the District of Oregon, and the District of Maryland. The first implementation for the beta courts occurred in September 2004, in the District of Maine and the Northern District of New York. The remaining beta courts will be phased in through early 2005. Best practices will be compiled from the beta courts' experience and applied to implementation for the remaining districts by late 2006.

Dear Bar Members:
by N. George Daines It is timely for a report about the finances of the Bar. The financial situation of the Bar is very good. The changes initiated some fifteen years ago have dramatically improved the Bar's finances and its financial management. What was a weakness has become a pronounced strength. Financial reporting is excellent. Operations are managed within approved budgets. The Bar employs excellent financial and accounting experts. There are adequate reserves. Five and ten year projections are developed and considered. During my service, the budget sessions have included robust discussions about the budget and the costs of new programs and initiatives. It is my personal observation that the Bar Commission is frugal and your money is well spent. The bulk of the Bar revenue is license fees; the primary expense are the salaries and benefits of staff employees. The license fee was set at $350 in 1990 and remains at $350 today, some fifteen years later. It is a remarkable achievement that there have been no increases during that fifteen year period. During that same time the consumer price index has increased 39.2%. During the previous fifteen year period (1975-1990) annual license fees increased 538% from $65 to $350. In fairness, that was a time when the Bar also greatly expanded its mission and programs. Nevertheless, a record of no increases for the last fifteen years is noteworthy. Precisely because of this good management, the Bar Commission now foresees a time when license fees will need to be modestly increased on an annual basis. The alternative is to annually reduce programs. The Bar cannot indefinitely finance ongoing programs with 1990 dollars. The pattern before 1990 was to obtain incremental increases in the license fees almost every year. Under present rules, this process would entail a new petition and approval by the Supreme Court for every step increase, no matter how small. That is one option. The Bar Commission prefers a process where it would approve modest increases in license fees matching the levels of inflation. Such increases are not really increases, but simply keeping pace with the real value of money (license fees).

About the Program Overview The Emerging Leaders Program is intended for the best graduates who are eager to make contributions to HHS. The program will allow you to explore diverse career fields, involving your educational background, within the Department of Health and Human Services, while providing you with the skills and experience needed for a career with the Federal Government. During the program you will have unique professional opportunities, including close interaction with various agency executives, as well as with public, private, non-profit, and advocacy organizations. And in his late teens repaired an old ambulance so he could home-deliver dairy products. He began his professional career as a hardware technician at Datamark Systems, quickly advancing to manager of quality assurance and support. JD also began The Cabling Connection, manufacturing custom cabling harnesses for mini computers. A test engineer and manager for Novell Labs, JD became director of engineering, pioneering behavioral testing for compatibility and interaction of hardware and software. He also designed and managed the world’s largest network test facility, Novell’s SuperLab for testing third party software applications and hardware devices. In January 1996, JD, along with two partners, started KeyLabs, an independent Internet and network-testing facility. In August 1998, he became president and CEO when Altiris, a spin-off software company, was created.

    Overview
    The potential annual energy savings at Hill AFB are estimated between $250,000 and $350,000 for task orders 1 and 2. Implementation of an initiative to replace faulty steam traps throughout the Base will result in annual savings of about $1 million. There may be six or more additional task orders under this contract, worth a total of $1 million in potential energy savings. Actions taken under the first task order are already accruing savings; in the first six months after electrical improvements were made in 25 buildings, use of electricity fell 25 percent in those facilities.
    Background
    There was a need to reduce energy and water use at Hill Air Force Base, which is subjected to extreme temperatures during summer and winter in its desert location north of Salt Lake City. Projects to improve the energy efficiency of lighting and HVAC systems are expected to generate significant savings for the Base over the life of the energy savings performance contract. The Base has some unique features that are suited to other efficiency projects, including industrial operations at its Air Logistics Center and a steam distribution system that could be improved. Water conservation and other projects are expected to generate additional energy savings at Hill AFB.
