Discussion of the Issues:
Under the direction of the Federal Communications Commission, the Schools and Libraries Corporation (SLC) has established an intricate application procedure to insure that all applicants comply with program regulations. The following flow chart, based on information from the SLC web site www.slcfund.org, illustrates this process:

Applicants “advertise” their requests for services which are posted on the SLC web site. Vendors review requests for services on web site and submit bids. Applicants list the specific contracts or tariff services on which they seek E-Rate discounts. SLC reviews each Form 471 and approves/ rejects discounts for each line item request.

R605-3. Effective Date - These revised policies and procedures are effective July 1, 2004. R605-4. Policy
    4.1. Program Description - UCOPE is a State supplement to increasingly inadequate grant and work assistance from Federal Government student financial aid programs. In Utah Code , the Legislature finds "that the general welfare and well-being of the state are directly related to the educational levels and skills of the citizens of the state, and that limited financial aid for students with demonstrated financial need to help finance costs of attendance at Utah postsecondary institutions is a necessary component for ensuring access to postsecondary education and training as the state enters its second century of statehood." Program funds may be used for either grants or work-study awards to students with demonstrated financial need, with no more than 3.0% of funds allocated to an eligible institution permitted to be used for administrative costs. These are the only purposes for which program funds may be used.

R607-1. Purpose
    To provide Utah Higher Education Assistance Authority ("UHEAA") policy and procedures for implementing the Utah Higher Education Tuition Assistance Program ("UTAP," or "program"), Utah Code Title 53B, Chapter 7, Part 5, enacted in H.B. 135 by the 1998 General Session of the Utah Legislature.

R607-3. Effective Date 3.1. Effective Date of Policy - These policies and procedures are effective January 4, 1999. R607-4. Policy 4.1. Program Description - UTAP is a matching grant program to provide incentives for Utah System of Higher Education community colleges and Utah State University to raise money for scholarships at the community colleges and at centers of the Utah State University. In Utah Code 53B-7-501, the Legislature recognizes "that tuition and general fee costs to students at Utah community colleges and established branch campuses and centers represent significant challenges for many of the students they serve, and that additional scholarship moneys for financially needy students attending those institutions is needed to ensure financial access to higher education. Program funds may be used only for matching grants for scholarship endowments to higher education institutions as provided herein.
