for school board Dear Mr. Steele: Your request for a legal opinion of this office on two questions has been referred to me for response. The questions are: 1) whether Utah law prohibits a person who is a school teacher in Vernal, Utah from running for the local school board of the district in which the person teaches and 2) whether, if the person were elected to the local school board, the person is barred by law from holding both the position of school teacher and the position of school board
In my opinion, the answers to your questions are: 1) "No," and 2) "Yes."
ANALYSIS First, I will address the question whether a school teacher is barred from running for a position on the school board of the district in which he teaches. It is the general policy of

(a) a curriculum program and delivery system which allows students the option to complete high school graduation requirements and prepares them to meet college admission requirements at the conclusion of the eleventh grade, but does not preclude a student involved in accelerated learning programs from graduating at an earlier time;
(b) a program of selected college credit courses in general and applied technology education which would be made available in cooperation with the State Board of Regents, as resources allow, through concurrent enrollment with one or more of the state's institutions of higher education;
(c) a course of study for a student who decides to continue on through the twelfth grade that would allow the student to take courses necessary to graduate from high school, and at the student's option, to become better prepared for the world of work, or complete selected college level courses corresponding to the first year of course work at a university, college, or community college in the state system of higher education; and
(d) a program for advanced placement which permits students to earn high school credits while qualifying to take advanced placement examinations for college credit.

CREATION Granite School District was created through a unanimous resolution passed by the Board of County Commissioners of Salt Lake County on December 15, 1904. The newly created district had a population of about 15,000 and served approximately 4,258 students residing in Salt Lake County school representative districts 1, 2, 3, 4, and 5. In the fall of 1992, the board adopted the following mission statement to lead the district into the twenty-first century: "To prepare every student with the knowledge and skills needed for lifelong success in a changing world." [Granite School District Adopted Budget 2001-2002, p. 24.] FUNCTIONS ADMINISTRATION The district is governed by an elected Board of Education comprised of five board members. Each board member is independently elected from a geographic precinct in the district. Board members serve for a period of four years, at which time they may run for re-election. School Board elections are held in November in conjunction with the general election. Board members elect a president and vice president at the time new members are sworn into office. The board directly appoints two principal officers, the superintendent and the business administrator/treasurer. Both positions are established and required by state law. Other administrative employees are recommended by the superintendency and are then approved by the board. The district is also subject to the general oversight of the Utah State Office of Education. This includes a budget approval process that is compliance oriented and is more ministerial in nature than substantive. The district is fiscally independent.

Deseret Morning News If human evolution is taught in biology class, then the idea of an intelligent force creating the universe ought to be taught in philosophy or another required class, a Utah senator told state school officials Wednesday.
But State Office of Education leaders, who met with Sen. Chris Buttars, R-West Jordan, on the matter, don't want to add that instruction, curriculum director Brett Moulding said.
If the two sides can't compromise, Buttars says he'll carry a legislative bill to make sure that they do.
"Legislation is a last resort," Buttars said. "I'm still working on it, but I'm really not highly hopeful we'll come to a consensus."
The issue surrounds human evolution and the concept of "intelligent design," based on the idea that life is too complex to be explained solely by Charles Darwin's theory of natural selection and evolution.
Critics say intelligent design is a thinly veiled reference to God and divine creation. And state education officials say that can't be taught in public schools under a 1987 U.S. Supreme Court decision.
Buttars, however, says intelligent design says nothing about God. Intelligent design reportedly has gained support in school districts in 20 states.

Berrett The Church of Jesus Christ of Latter-day Saints has established educational programs throughout the United States and in some ninety other countries to provide an effective combination of religious and secular education to its members. The primary aim shared by these programs is to assist students in gaining an understanding and personal witness of the restored gospel of Jesus Christ at the same time as they pursue their secular studies. Latter-day Saints are taught by their leaders and their scriptures to seek after truth in every sphere. CES comprises the various educational programs of the Church. Brigham Young University , Ricks College, and LDS business college provide higher education balanced with religious instruction for students attending these Church-owned institutions. Seminaries offer weekday religious instruction for high school students, and institutes offer similar instruction for college students attending non-LDS colleges and universities. Extensive adult and continuing education programs with headquarters at BYU provide educational opportunities for those not officially enrolled in the formal institutions. Coordinating Board for Higher Education Dr. Gregory G. Fitch - Commissioner Summary of Background Dr. Gregory G. Fitch assumed the duties of Commissioner of Higher Education for the state of Missouri in January 2005. Fitch most recently served as the founding president of the Utah College of Applied Technology (UCAT), which was created by the Utah Legislature and is comprised of nine campuses and several technical sites serving over 60,000 students in an open-entry, open-exit competency based format. The institution reports directly to the Utah Legislature rather than the Board of Regents in dealing with budgets, facilities, and economic efforts. Fitch interacted extensively with the Governor and legislators to assure goals were defined and met. His work required that he seat ten boards (trustees and directors), hire campus presidents, direct accreditation activities, and collaborate with public education (K-12), business and industry, and government. The primary mission of the college is economic development through the creation and support of a qualified workforce. Prior to his role in Idaho, Fitch served in chancellor and president roles in two large community college systems, and was the vice president and dean for academic affairs in a two-year institution (that was later granted four-year degree options) in South Dakota. He started his career in education and elementary and high school teacher roles in Topeka, Kansas.

The Utah School Boards Association is legally "...recognized as an organization and agency of the school boards of Utah and representative of said boards." It is a voluntary, non-profit organization; dues to the association are paid by either the local boards or the state board from district or state funds as authorized by law. There are two major purposes of the association.
  • To develop, strengthen and correlate the work of the school boards of the public schools of the State of Utah in their efforts to promote the educational opportunities for children. To deal with problems that develop or exist that are related to the operation of the public schools in whatever manner may be deemed advisable by the board of directors at the time.
  • The association is governed by a board of directors whose members are elected by and from various regions of the state and by executive officers - a president, first vice-president and second vice-president - who are elected at the annual state convention. The policy-making body of the organization is the Delegate Assembly, which is comprised of the elected officers and representatives from each of the school districts of the state. A Delegate Assembly may be called as needed by the executive officers.
