Pre-hire personality testing has been a growing trend. Recently, the Seventh Circuit Court of Appeals held that using a test measures job applicants’ personality traits may violate the Americans with Disabilities Act. The test, which included the Minnesota Multiphasic Personality Inventory (MMPI), was used for promotion. In this case, the test could be used to diagnose psychiatric disorders. The Americans with Disabilities Act forbids administering pre-hire examinations, and the court concluded that this test was a medical examination. Karraker v.
Rent-A-Center Inc., Case No.04-2881 (7th Cir. June 14, 2005).

Afghanistan Al Qaeda ... July 2, 2003 "The United States put monetary muscle behind its vehement opposition to the International Criminal Court, suspending more than 47 million dollars in military aid to 35 countries for their failure or refusal to give US citizens immunity from the tribunal." The suspension affects US allies like Brazil, Colombia and South Africa, the Baltic states as well as NATO hopefuls such as Bulgaria, Croatia, Slovakia and Slovenia, officials said. However, they stressed that Washington would continue to press these nations to sign immunity deals, so-called "Article 98" agreements, with the United States so that the assistance could be restored. "Our hope is to continue to work with governments to secure and ratify Article 98 agreements that protect American service members from arbitrary or political prosecution by the international court," State Department spokesman Richard Boucher said. "It remains an important part of national policy," he told reporters. "We have made this an issue. It's an important issue to the United States. It will continue to be an important issue." The United States fears the court, the world's first permanent international court to try cases of warcrimes, crimes against humanity and genocide, could become a forum for politically motivated prosecutions of US citizens and has been on a worldwide campaign to sign immunity deals.

1970: Reviving the fighting spirit of Int'l Women's Day

Published Feb 23, 2005 10:37 AM It's March 7, 1970: A militant crowd of more than 1,000 women and male supporters are surrounding the Women's House of Detention in Greenwich Village, chanting "Free our sisters! Free ourselves!" Women prisoners wave from the windows, shouting, "Power to the people!" Cops push against protesters holding banners demanding free and legal abortions, equal pay for equal work, no job discrimination and freedom for women political prisoners. The crowd yells, "Women, let's unite and fight!" On this day in 1970, the Women's Caucus of Youth Against War and Fascism (YAWF) re-ignited the celebration of International Women's Day as a day of revolutionary struggle in the streets against women's oppression. YAWF was the youth group of Workers World Party during the Vietnam War. The day began with a spirited rally in Union Square, chaired by Deirdre Griswold of the YAWF Women's Caucus. Speakers included representatives from many women's organizations: African American attorney Flo Kennedy, about her work to repeal New York's anti-abortion laws; Sue Davis of the YAWF Women's Caucus on the revolutionary history of IWD; Dr. June Finer of the Medical Committee on Human Rights on health care for women; and Kathy Ellis of the New University Conference on the fight for daycare.

What is unusual is that the government and Charter disagreed in a very fundamental sense on interpretation of the consent decree. This, in turn, raises the issue of the extent to which the scope of "matters addressed" in the decree, an issue usually resolved in separate contribution actions, was required to be determined by the district court in its approval of the consent decree.

204 Offset
Offset is the general right of one party to recover a debt owed by another through a deduction from monies owed by the first party to the second. Basically, there are two types of offsets: setoffs and recoupments. A setoff is an equitable right of offset where the mutually offsetting debts arise out of separate transactions. In contrast, a recoupment is the right of offset when the claim and the debt arise out of the same transaction. The government possesses the same self-help right of recovery through offset as any other creditor. See United States v. Munsey Trust Co., 332 U.S. 234, 239 (1947); Hilburn v. Butz, 463 F.2d 1207 (5th Cir. 1972), cert. denied, 410 U.S. 942 (1973); Burlington Northern Inc. v. United States, 462 F.2d 526 (Ct. Cl. 1972); Aetna Ins. Co. v. United States, 456 F.2d 773 (Ct. Cl. 1972); United States v. Cohen, 389 F.2d 689 (5th Cir. 1967). Thus, the United States can assert a right of offset independent of a statutory grant of authority. See, e.g., United States v. Tafoya, 803 F.2d 140, 141 (5th Cir. 1986). The United States is one party for mutuality purposes and can setoff claims held by different agencies. See, e.g., Cherry Cotton Mills v.
