Overview
The Bureau of Industry and Security (BIS) is responsible for implementing and enforcing the Export Administration Regulations (EAR), which regulate the export and reexport of most commercial items. We often refer to the items that BIS regulates as "dual-use" - items that have both commercial and military or proliferation applications - but purely commercial items without an obvious military use are also subject to the EAR. The EAR do not control all goods, services, and technologies. Other U.S. government agencies regulate more specialized exports. For example, the U.S. Department of State has authority over defense articles and defense services. A list of other agencies involved in export controls can be found on this Web site or in Supplement No. 3 to Part 730 of the EAR which is available on the Government Printing Office Web site. This page is designed to give people who are new to exporting, and, in particular, new to export controls, a general understanding of our regulations and how to use them. However, nothing provided here can substitute for consulting the EAR. The EAR include answers to frequently asked questions, detailed step-by-step instructions for determining if a transaction is subject to the regulations, how to request a commodity classification or advisory opinion, and how to apply for a license. In using the EAR, you may want to first look at Part 732 for the steps you follow to determine your obligations.

O'Neill has been out of the Administration for two years The US Treasury Department has called for an investigation into whether its former head leaked secret documents in a new book.
Former Treasury Secretary Paul O'Neill appeared on a US news programme to promote the book in which documents marked "secret" were shown. A Treasury department spokesman said it had asked its inspector general to see if disclosure laws were violated. Mr O'Neill was sacked from the US Government in December 2002. Not since Julius Caesar have I seen such a blatant stab in the back - et tu, Mr O'Neill?

US Treasury Department Drops Charges Against Methodists for Visiting Church in Cuba RHC The US Treasury Department has ordered federal charges dropped against three members of a Methodist church in Milwaukee, Wisconsin who were accused of spending US dollars during a visit to Cuba. At a news conference called by the Wisconsin Coalition to Normalize Relations with Cuba, attorney Art Heitzer said that Washington will end nearly six years of threats and legal prosecution of the Methodist 3, as they became known in Milwaukee, without requiring any fines or other penalties. They were among six members of Milwaukee's oldest Methodist Church, Central United Methodist, who visited their sister church in Havana to help celebrate its 100th anniversary. Earlier this year, they were charged with spending between 40 and 70 dollars each, resulting in government demands for penalties totally $22,500. Supporters of the Methodist 3 say the US Treasury Department's only condition on dropping the charges was that they drop their counterclaims against the government.

The "clarification" released by OFAC yesterday unilaterally alters the payment terms of existing contracts, and therefore effectively voids them. Since the export of U.S. rice and other agriculture commodities to Cuba resumed in December 2001, Cuban buyers to our knowledge have honored all of their obligations under contracts with U.S. sellers. It is disappointing that our government has chosen to disrupt this trade relationship through the abrogation of millions of dollars worth of existing sales contracts.

Interpol and the U.S. Department of Treasury Forge New Partnership in the Fight Against Terrorist Financing
Meeting at Interpol Headquarters in Lyon, France, on the three month anniversary of the September 11th attacks, Treasury Under Secretary for Enforcement Jimmy Gurulé and Interpol Secretary General Ronald K. Noble announced a new joint Treasury-Interpol partnership to crack down on terrorist financing. The two law enforcement officials announced their intention to establish an international terrorist financing database and Secretary General Noble publicly called on each of Interpol's 179 member countries to identify important information regarding the financial support of terrorism that would also be incorporated into the database. The Interpol database would consolidate international and national lists of terrorist financiers and make it available to police around the world to prevent the flow of funds to terrorist groups and to assist in criminal investigations. The Treasury Department will work closely with Interpol to develop the foundations for this new tool to fight terrorism. "The fight against terrorist financing can only be successful by pooling together all available resources to crack down on those choosing to fund acts of terror against innocent people," said Treasury Under Secretary Gurulé. "Today Interpol joined us in strengthening that effort by bringing their law enforcement expertise and global infrastructure to the war on terrorist financing."

US FEDERAL EXECUTIVE 1943 The United States Government is constitutionally divided into three branches: the legislative, the judicial, and the executive. The legislative branch comprises the Congress, in 1943 elected by popular suffrage. The judicial power is vested in the Supreme Court. The executive power is vested in the President and the Executive of US government includes 10 departments. Both the departments of State and Treasury are among these.
THE PRESIDENT OF THE UNITED STATES Article II, section 1, of the Constitution provides that "the executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four years,...together with the Vice President, chosen for the same term...". In addition to the powers set forth in the Constitution, the statutes have conferred upon the President specific authority and responsibility covering a wide range of matters ( United States Code Index ). 'The President is the administrative head of the Executive Branch of the Government, which includes numerous agencies, both temporary permanent, as well as the 10 executive departments. The heads of the 10 executive departments form the Cabinet and serve in an advisory capacity to the President. They are the Secretary of State, the Secretary of the Treasury, the Secretary of War, the Attorney General, the Postmaster General, the Secretary of the Navy, the Secretary of the Interior, the Secretary of Agriculture, the Secretary of Commerce, and the Secretary of Labor. Upon invitation of the President, other Federal executives may attend Cabinet meetings.'
