Wireless phones are everywhere. Businesses depend on them. Family members call each other to keep in touch. People use them in public places and when driving. The down side is that all those beeping noises and loud conversations are downright annoying, and drivers who pay more attention to the phone than the traffic create a hazard to other drivers. Do we need new regulations to protect the public from these problems?
Do Cell Phones Cause Collisions?
As more drivers use wireless phones, there are more collisions where an at-fault driver was on the phone. Today, drivers have a very high exposure to cell phones. Concerns that use of wireless phones can cause collisions have led to calls to ban or regulate their use in cars. Advocates cite a 1997 article in the New England Journal of Medicine. That report made no claim to prove the devices caused collisions. Moreover, it had several shortcomings. For example:

Except as noted below within specific bills, each of the following driving-related laws took effect on September 1, 2003. Bills may be viewed in more detail on the Legislative Reference Library of Texas website at www.lrl.state.tx.us/isaf/lrlhome.cfm (78th Regular Session, Text Enrolled Version).
SENATE BILLS SB 45 makes it a felony offense to operate a motor vehicle in a public place while intoxicated with a passenger younger than 15. The offense is punishable as a state jail felony.
SB 193
is known as the “Move Over Act”. This law requires drivers nearing a stopped emergency vehicle that has lights activated, unless otherwise directed by a law enforcement officer, to:
o vacate the lane closest to the emergency vehicle when driving on a highway with two or more lanes traveling the direction of the emergency vehicle; or
o slow to a speed not to exceed: - 20 mph less than the posted speed limit when the posted speed limit is 25 mph or more; or - 5 mph when the posted speed limit is less than 25 mph.

The following bills from the 79th Regular Session have become (or will become) laws.
Except as noted below within specific bills, each of the following laws will take effect on September 1, 2005. The full or amended text of each bill may be accessed by clicking on the bill number, and the history of each bill may be viewed in more detail at www.capitol.state.tx.us/ (change the default to 79th Regular Session). SENATE BILLS SB 129 amends Section 361.252, Transportation Code and authorizes TXDOT to waive the payment of a toll or to authorize the payment of a reduced toll for any vehicle or class of vehicles. SB 217 specifies the reporting responsibilities of an employer who is required by federal safety regulations to conduct alcohol and drug testing on CDL employees. The employer must report valid positive results; refusal to submit a specimen; and adulterated, diluted, or substituted specimens to DPS. A valid positive result is a BAC at or above 0.04, or a confirmation drug test result at or above the cutoff concentration. Information maintained in DPS under this section is confidential and only subject to release as provided by Section 521.053 of the Texas Transportation Code. SB 569 amends Section 201.207 of the Transportation Code to require DPS to initiate efforts to meet at least quarterly with the department's counterparts in those states of the United Mexican States that border Texas to discuss issues relating to truck inspections and transportation.

Drivers under 18 who apply for a full license on or after October 1, 2005, must submit a written log of the dates and times of their behind-the-wheel experience. This will be required even if your instruction permit was issued prior to October 1. This new publication contains specific skills and lessons that teens should practice during their behind-the-wheel experience. The new laws passed by the 2005 Nevada Legislature will raise the minimum license age to 16. Drunk driving or drinking and driving is the act of operating a motor vehicle after having consumed alcohol ethanol ) or other drugs , to the degree that mental and motor skills are impaired. It is illegal in most jurisdictions within the U.S. The specific criminal offence is usually called driving while intoxicated DWI ) or driving under the influence [of alcohol or other drugs] ( DUI ). Such laws may also apply to boating or piloting aircraft. According to the National Highway Traffic Safety Administration (NHTSA), 17,013 people died in in alcohol-related collisions, representing 40 percent of total traffic deaths in the United States. Over 500,000 people were injured in alcohol-related accidents in the US in . Alcohol-related is defined to include any driver, passenger or pedestrian involved in a fatal crash who has any trace of alcohol or suspicion of alcohol usage. According to the NHTSA, no other country uses these criteria in their statistical computations.
