Dallas, TX, Aug. 6 (UPI) At the same time students are reporting for the first classes of the year across Texas, teams of lawyers are preparing for a courtroom showdown in Austin that will determine the future of the state's $30 billion school-funding system. Nearly 300 of the state's school districts have joined in a massive lawsuit that goes to trial Monday in the court of State District Judge John Dietz, charging that the current so-called Robin Hood system violates the Texas Constitution. The courtroom shootout comes after the state Legislature, called into special session by Republican Gov. Rick Perry, failed to take any action during a 30-day session. Perry has talked of calling another session, but time is running out. It appears the state's legislators will now wait until the regular session early next year to take up the hottest issue in the state. By that time, they will most likely have some direction from the courts, which is what some of them want. Groups of school districts, some property-rich and a few property-poor, along with urban districts like Dallas, Austin and Houston, have joined in the lawsuit against the current system, which was enacted in 1993 after another lawsuit.

The 2005 Legislature wrapped up its session without finding a solution for the school finance reform. Governor Perry stated he will call a special session once the senate and the house reach an agreement. On the horizon, the Texas Supreme Court will hear arguments in an appeal of a school-finance case on July 6th. Friday, May 27, 2005

"A general diffusion of knowledge being essential to the preservation of the liberties and rights of the people, it shall be the duty of the Legislature of the State to establish and make suitable provision for the support and maintenance of an efficient system of public free schools" (emphasis added). Texas School Finance - The Current State :
  • For the 2002-2003 school year, the Texas Education Agency reports spending per pupil as $7,088. The U.S. Department of Education's National Center for Education Statistics reports spending per student in Texas at $6,549 for 2000-2001 which places Texas 37th in the nation on education spending. The state share for public education has decreased to 38 percent, the lowest level since WWII, while the local share has increased to 62 percent. In 1945, the state share for funding public schools was at 55 percent. ( Legislative Budget Board 494 school districts have a tax rate of $1.50 or higher representing 39 percent of all districts and 46.4 percent of all students enrolled in Texas public schools. Over 691 school districts, or approximately 70 percent of all school districts, have a tax rate ranging between $1.45 or higher (

Students who earn GED, leave to go to prison not counted
Crystal Gonzalez, 17, studies at a non-profit reading center in Houston Aug 27. Gonzalez left school earlier this year but is now working toward a General Equivalency Diploma.
HOUSTON - Crystal Gonzalez, 17, gave up on high school in Houston's East End neighborhood earlier this year. She never made it past ninth-grade. ''They told me there was no hope. It would take me so many years to graduate,'' said Gonzalez, held back twice at Channelview High School because of poor attendance. ''They told me it would be better for me to get my GED. They probably had other students that needed to be in school more.'' She left a system that doesn't consider her a dropout since she is working toward a General Equivalency Diploma. Some say Texas schools are nudging out low performing students who may drag down standardized test scores.
