Austin, Texas 78711 Opinion No. JC-0091 Re: Whether legislature constitutionally may exclude home schools from voucher system for private and parochial schools ( RQ-0023 Dear Senator Ratliff: You ask whether the legislature constitutionally may exclude home schools from a voucher system for private and parochial schools. Because you ask in particular about the effect of the Texas Supreme Court's decision in Texas Education Agency v Leeper , 893 S.W.2d 432 (Tex. 1994), we address the constitutional provision raised by the court of appeals in that case: the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution. The Equal Protection Clause prohibits a state from denying "to any person within its jurisdiction the equal protection of the laws." U.S. Const. amend. XIV, § 1. But it does not prohibit states from treating different classes of people in different ways. Rather, it prohibits laws that treat different classes differently on the basis of criteria unrelated to the objectives of the statute. See Plyler v Doe , 457 U.S. 202, 216 (1982). "In applying the Equal Protection Clause to most forms of state action," the United States Supreme Court has said, "we thus seek only the assurance that the classification at issue bears some fair relationship to a legitimate public purpose."

Public Education
The effects of the voucher program show that vouchers have not worked as promised. While the state has yet to see gains in student achievement, it has seen vouchers drain millions from public schools, give preferential treatment to private school students and the brightest public school students, and place students in substandard schools.
  • A state-commissioned, five-year evaluation of the Milwaukee program found that public school students performed at least as well as voucher students.[4] No comprehensive academic data has been collected on the program since 1995. In 1995, the legislature eliminated funds for data collection and program evaluation when it expanded the voucher program to include religious schools.
Milwaukee's program fails to taget populations it purports to help.
  • The integrity of the voucher program lies in the promise that eligible students will be selected at random to receive scholarships. A review during the 1998-99 school year, however, found that some voucher schools were in fact giving preference to parishioners or admitting students based on religious, academic or other considerations.[6] Less than one in four students receiving vouchers in the 2003-04 school year actually attended Milwaukee public schools the previous year.[7]

Required Subjects:
Good citizenship, math, reading, spelling, and grammar.
Home schools can legally operate as private schools in Texas. Home schools must be conducted in a bona fide manner, using a written curriculum consisting of reading, spelling, grammar, math and a course in good citizenship.
No other requirements apply.
School Districts:
As a result of the Leeper decision, home schools do not have to initiate contact with a school district, submit to home visits, have curriculum approved or have any specific teacher certification. Home schools need only have a written curriculum, conduct it in a bona fide manner and teach math, reading, spelling, grammar, and good citizenship.
In 1989, The Texas legislature exempted private and parochial schools from new requirements for schools, and in the process, confirmed that the term "private school" includes home schools: "Nothing in this act applies to students in attendance upon a private or parochial school, which includes home schools, in accordance with § 25.085, Education Code."

Why does GreatSchools.net have less information about private schools than about public schools?
GreatSchools.net has less detailed School Profiles for private schools than for public schools because public schools are funded with tax dollars and, therefore, are required to report detailed data, including test scores, class size, attendance and graduation rates. Private schools, which are not funded with public money, do not have to report data about their schools or make it available to the public. GreatSchools.net accesses information about public schools from individual state departments of education and national organizations such as the National Center for Education Statistics and the American Institutes for Research, but these organizations do not have information about private schools.

Regional News Region 12 Report for January 30, 2005 Hill Country Archeological Association New HCAA officers for 2005: Paul Smith, Pres.; V-P Woody Woodward; Secr. Vonie Evans; Treas. David Shelley; Diretors - Bryant Saner, Jose Contreras, Edward Rendon. Committee chairs are: Membership, Woody; Field and Program Coordinator, Bryant; Publicity/Historian, Kay Woodward; Hospitality, Adele Junkin. HCAA has five work projects lined up for 2005, including a salvage excavation and closure on looted property. Several new members have been welcomed in the group and most are taking part in the field work. A "Quick Response Team" has been formed to go into the field or take on jobs of some nature without too much notice. This is proving to be successful. HCAA will be meeting the third Saturday at 1 p.m., every other month in 2005. (no more Wed. meetings) They will probably be meeting at the Kerrville Public library also - since KACC is being renovated inside upstairs. Future meetings: 3/19, 5/21, 7/17, 9/17, and 11/19/2005.
