Don't Mess with Texas Contractors

Everyone has heard horror stories about home remodeling contractors, and increasingly, many of them seem to be coming from Texas. Consumer advocates say there's a reason for that Texas law does very little to hold contractors accountable, and all too often it's the homeowner left in the lurch. A recent report in the Houston Chronicle detailed complaints from homeowners who've had bad experiences with a contractor, and discovered they have few rights when they looked for recourse. Criminal cases against contractors are almost impossible to make under current Texas law. When homeowners file civil suits, unscrupulous contractors file for bankruptcy, or seek other clever manipulations of the law. Part of the problem, say consumer advocates, is that Texas has almost no licensing requirements for home remodeling contractors, making it very difficult for homeowners to tell the good ones from the bad ones. The situation has gotten so bad that frustrated homeowners formed a chapter of Homeowners Against Deficient Dwellings, which tries to offer some education to consumers before they get in a jam. The group says it would like to see Texas adopt some of the safeguards other states have, like performance bond requirements, a guaranty fund for victims and more thorough licensing procedures.

Missouri A U.S. Supreme Court decision striking down Texas’ anti-sodomy law raises questions about the legality of a similar Missouri law, Attorney General Jay Nixon said Thursday. Gay-rights activists and legal analysts said Thursday’s ruling knocked out laws in Missouri, Kansas, Texas and Oklahoma that barred consensual gay sex, even in private. The ruling “has the effect of invalidating Missouri’s law,” said Denise Lieberman, legal director for the ACLU of Eastern Missouri. “This was a pretty sweeping Supreme Court ruling that recognized all people have a fundamental right to intimate association that cannot be infringed by the state,” she added. Nixon declined to go that far. “Missouri’s law on sexual misconduct in the first degree ... does contain similar language to the Texas law struck down today by the court,” Nixon said in a statement Thursday. “Today’s ruling appears to call into question Missouri’s law prohibiting consensual same-sex sexual activity.” Nixon added that his office was reviewing the decision to determine its impact in Missouri. He said his office would also be talking to county prosecutors about the ruling.

INTRODUCTION
The Office of the Solicitor General was created by the Act to Establish the Department of Justice, ch. 150, 16 Stat. 162 (1870). The Act provided for "an officer learned in the law, to assist the Attorney-General in the performance of his duties, to be called the solicitor-general." The Act provided that both the Attorney General and the Solicitor General had the duty "to conduct and argue" cases coming by appeal to the Supreme Court "before that court as in other cases in which the United States is interested." Originally second in command to the Attorney General, the Solicitor General's position in the Department has changed with the addition of the Deputy Attorneys General and the formation of the Divisions. The Solicitor General is appointed by the President and is subject to confirmation by the Senate. The Attorney General historically has given the Solicitor General the primary responsibility for presenting the Government's case to the Supreme Court. In discharging that function, the Solicitor General has had a great degree of independence. Except for rare authority exercised by the Attorney General, the Solicitor General has had sole discretion to decide which Government cases involve issues important enough to justify appeal to the Supreme Court and to make the final determination whether the Government's case is good enough to win there. The Office of the Solicitor General also files amicus curiae briefs and extraordinary writs with the Supreme Court. In the course of the work, the Solicitor General's Office works with the Divisions of the Department of Justice, the United States Attorneys' Offices, and other government agencies.

As of April 9, there were 136 ATF personnel and six U.S. Customs Service employees in Waco., Local authorities consisted of eighteen persons from the Waco Police Department, seventeen from the McLennan County Sheriff's office, and, from the Texas Department of Public Safety (DPS), 32 Texas Rangers and 131 members of the DPS Patrol. The total number of local law enforcement personnel present at Waco on any given day during the crisis varied. A. The Texas Rangers
Texas Ranger Captain David Byrnes commanded a contingent of 31 Texas Rangers at Waco who assisted in the criminal investigation of the shootings of the ATF agents. The Rangers, working with the United States Attorney's Office and the ATF, were responsible for processing the crime scene. Although one ATF explosives expert, who was escorted on the scene by the Texas Rangers, was used to disarm explosives. No other ATF agents were involved in processing the crime scene. Captain Byrnes organized arrest teams in preparation for a surrender by the Branch Davidians.
Captain Byrnes reported that the Rangers' relationship with the FBI command post deteriorated rapidly. Numerous Rangers complained to him that SAC Jamar and others in the command post had treated them rudely. The Rangers eventually pulled out of what they considered a hostile atmosphere.

Surplus Lines Insurance
(Revised February 2005) Traditional Insurance Markets consisting of Texas-licensed ("admitted") companies aren´t always available for every risk. Texas law recognizes the special needs of these risks by allowing certain non-admitted companies to sell insurance on a "surplus lines" basis. About 200 surplus lines companies operate in Texas, writing more than $1 billion a year in premiums. This publication helps explain the surplus lines market, its purpose, and its limitations.

    Texas attorney general visits UT law school
    By Rachel Stone Daily Texan Staff Texas Attorney General John Cornyn made an appearance at the School of Law Thursday afternoon to discuss current legal issues in the state with the UT School of Law Federalist Society for Law and Public Policy. About 200 law students and faculty members attended the event. Cornyn gave a brief overview of some issues in which his office is involved, including nursing home regulation and the support of local law enforcement agencies, before opening the floor to questions. He fielded questions about the 1996 Hopwood decision, which prohibits Texas public universities from considering race as a factor in the application review process. He recently asked the U.S. Supreme Court to review the decision. "I decided that like any lawyer of any client, my duty required me to defend the state and its policy notwithstanding my personal beliefs, and so that's what we did," Cornyn said.

Our goals are directed toward providing assistance to anyone conducting legal research. The library meets these goals in four distinct ways: 1) a competent and professional library staff 2) a comprehensive collection and access to other collections, 3) legal research training for first year students and organized opportunities for second and third year students to develop their skills and 4) new library facilities. The law library is open over one hundred hours each week and on the average, sixteen hours per day. Reference hours are provided daily and during peak days until nine in the evening. A Competent and Professional Library Staff Eight professional librarians are available to assist law library patrons. The professional library staff is highly trained and skilled in legal research. Although the library staff is relatively young, they have ninety years of collective professional experience. Four librarians have both Law Degrees and Master's Degrees in Library and Information Science. Three librarians have Master's Degrees in Library and Information Science. One librarian has a Law Degree. Three librarians, individually, have more than twenty years of library experience; and three librarians, collectively, twenty years of library experience in the practice of law.

    The Attorney General is responsible for ensuring that Texas government is open and accessible to all citizens. Several divisions of the agency are involved in this effort. The Open Records Division issues rulings and decisions that determine whether information is open to the public under the Public Information Act and other applicable laws. This division also takes action to enforce these decisions and sponsors conferences to educate citizens and government officials about the state's open government laws. The Open Records Division also provides an Open Government Hotline staffed by investigators who specialize in both the Public Information Act and the Open Meetings Act. These investigators can answer questions regarding these laws and can help resolve disputes involving the open government laws. However, the Hotline cannot provide legal advice to private citizens or governmental entities. The Hotline can be reached at (512) 478-OPEN (6736) or toll-free at (877) OPEN TEX The Intergovernmental Relations Division , through its Municipal Affairs and County Affairs Sections, gives legal advice to local governmental entities and officials. Until recently, however, when the classroom was remote, the law's generous terms for face-to-face teaching in Section 110(1) shrank dramatically in Section 110(2) some would say to the vanishing point! The TEACH Act expands the scope of educators' rights to perform and display works and to make the copies integral to such performances and displays for digital distance education, making the rights closer to those we have in face-to-face teaching. But there is still a considerable gap between what the statute authorizes for face-to-face teaching and for distance education. For example, as indicated above, an educator may show or perform any work related to the curriculum, regardless of the medium, face-to-face in the classroom - still images, music of every kind, even movies. There are no limits and no permission required.
