Texas law does protect physicians and others who administer or authorize the administration of vaccines from liability should the vaccine result in injury to a patient, but only to the extent the vaccination is required by law or rule. Raffles, TAMUS, and Texas Law
The OGC receives numerous calls each year from clients inquiring about the state of the law on fundraising raffles. Many student organizations and other affiliated entities use raffles as a means of raising funds for their activities. Alumni and athletic organizations often raffle off prizes in order to generate funds and support for their programs. Often TAMUS Members are asked to provide assistance to such efforts by allowing or promoting ticket sales, or endorsing the event. Raffles are governed by Chapter 2002, Texas Occupations Code . It permits "qualified organizations" to hold raffles under specific legal conditions.
May a TAMUS institution or agency hold raffle?
Components of TAMUS do not qualify under the law to hold raffles because they are not "qualified organizations" as defined by the law.
May student organizations hold raffles?
Some student organizations may be able to qualify, but there are very specific requirements. Even if they do not qualify to sponsor the raffle, however, the law states that student organizations must be permitted to sell raffle tickets on institutional property, subject to reasonable time, place, and manner restrictions. Information on campus regulations is available from the appropriate office on each TAMUS campus.

Public to Have No Access to UTMB Biosafety Committee A Bizarre Texas Law Trumps Federal Guidelines and the Texas Public Information Act

Austin - In a ruling a late yesterday, the Texas Attorney General rejected the Sunshine Project's Public Information Act request to review documents from the University of Texas Medical Branch (UTMB) Institutional Biosafety Committee. UTMB is focusing on biodefense research and was recently awarded new federal grants to become a national center for work with the most dangerous disease agents. The Attorney General's ruling means that the public has zero ability to examine UTMB's measures to try to avoid human health and environmental damage resulting from its research on biological weapons agents. The decision is disappointing; but not surprising, according to Edward Hammond, Director of the Sunshine Project, " Because of a variety of circumstances, I think that this will prove to be a pyrrhic victory for the University of Texas. Arms control, health, and safety advocates from across the country are concerned about the expansion of the US biodefense program and are demanding transparency and explanations of its activities,"

Texas Attorney General's Opinion Results In Horse Slaughter Investigation The last two U.S. horse slaughter facilities, both located in Texas, appear to be operating in violation of Texas law, according to an opinion issued by the Texas Attorney General, John Cornyn. In 1949 the Texas Legislature amended the State's Agriculture Code (section 149.002), making it illegal to slaughter, possess, sell, and transport horsemeat for human consumption. Yet for 53 years the law has been ignored. As part of its campaign to end horse slaughter for human consumption, the Animal Welfare Institute has been working with well-known Dallas Attorney Robert "Skip" Trimble on finding ways to have the State law enforced. The Texas Department of Agriculture had rejected any responsibility on the grounds the State law was superceded by federal law. Mr. Trimble did not accept that answer and with the leadership of State Representative Goolsby, the Texas Attorney General was asked to issue an opinion on enforcement of the State law. The Attorney General's opinion states that "a person who sells horse-meat as food for human consumption or who possesses horse-meat intending to sell it as food for human consumption commits a criminal offense." The Attorney General went on to write that "a person who transfers horse-meat to a person who intends to sell it as food for human consumption or who knows or reasonably should know that the person receiving the horse-meat intends to sell it as food for human consumption commits a criminal offense."

Texas has a statute, which was presumably passed because someone or some group lobbied for it. Whether or not it is enforced, is up to those that need it enforce. There ARE methods of getting things enforced..... almost always requiring one to be more of a pain than the act of bothering to enforce the law. If a visitation denial statute is not enforced in Texas, only reluctant NCPs are to blame.
