PREPARING TO PRACTICE BEFORE TEXAS ADMINISTRATIVE AGENCIES STATUTORY LAW
  • Codified in 1993. The predecessor was Tex. Rev. Civ. Stat. Ann art. 6252-13a, which was passed initially in 1975.
  • Purpose: (1) to provide minimum standards of uniform practice and procedure for state agencies, (2) to provide for public participation in the rulemaking process, and (3) to enunciate the law of judicial review for state agency actions.
  • Provides for State Office of Administrative Hearings, which conducts administrative hearings of contested cases in which an agency does not employ its own hearing officer. The Office also conducts alternative dispute proceedings. The State Office of Administrative Hearings website is located at http://www.soah.state.tx.us/
  • The Occupation Code is a new code that contains provisions for the licensing and performance parameters of individuals in various occupations including the health professions and accountancy, among others.

Landlord-tenant disputes are common and can become very emotional. Knowing the legal rights and obligations described below will help you avoid these types of disputes.
The Lease
The relationship between Texas landlords and their tenants is governed by several statutes and court rulings. However, the most important source of information about your relationship with your landlord is your rental agreement, whether it is written or oral. Some landlords prefer oral agreements, but it is more common for them to require your signature on a written lease. Be sure to read the lease carefully before you sign it. If you want to change a part of the lease, discuss it with the landlord. If the landlord agrees, the two of you should decide how you want to word the change, and then write it into the agreement. Both you and the landlord should then initial the change. For example, many standard leases prohibit pets, but your landlord may be willing to accept a pet if you put down extra money as security.
Your rights as a tenant include the right to "quiet enjoyment" as it is called in the law. This means the landlord cannot evict you without cause or otherwise disturb your right to live in peace and quiet.

Finding Texas law in the Tarlton Law Library
Prepared by Beth Youngdale Researching “the law” on a particular topic is generally a multi-step process that involves checking a number of sources - statutes, cases, and, sometimes, administrative rules or regulations. Very rarely is there a simple answer to a legal question or a single book that will provide an answer. Discovering what “the law” is in a given situation means finding the rule that is applicable - usually a statute, or in some instances a case - and then applying the rule to the facts of the situation. Case law is generally used to see how courts have applied the rule in other situations. The key is finding a case with facts that are analogous to your own.
Getting started
Where you start depends largely on what information you already have about the area of law you are researching. If you already have a citation - to a statute or a case - you are, to a certain extent, ahead of the game. Statutes and cases provide excellent jumping off points to additional sources of the law. If you don't have a citation, or are unfamiliar with an area of law, secondary sources are a good place to start. These sources, which are not the law, provide background information, an introduction to the terminology of a particular topic, and valuable citations to primary sources of law (statutes, cases, administrative rules).

Attorney at Law Types of Business Entities in Texas NOTE: This article discusses business law matters of current note in the State of Texas according to Texas law. The General Partnership A general partnership is exactly that: An enterprise between two or more partners. It is perhaps the simplest of business entities. In Texas, two statutes are especially important concerning partnerships; The Texas Uniform Partnership Act and the Texas Revised Partnership Act. On this page, the term "partnership" means a general partnership. Different rules apply for limited partnerships. Forming a partnership is easy. All that one has to have is an association between two or more partners that they will associate for a common enterprise, and share the profits and losses from that enterprise. A partnership does not have to use a special name, and it does not have to file anything with the Secretary of State of Texas to begin its existence. A partnership may exist even when there is no written or oral agreement to form one; the mere association and sharing of profits and losses can create a partnership. A partnership may be perpetual in nature, although typically the partnership agreement limits its term.
