1. My child has been arrested will he be taken to jail and treated like an adult? A child over the age of 10 and under the age of 17, though arrested, will NOT be taken to adult jail. Counties have separate Juvenile Detention Centers to accommodate children under the age of 17 who are alleged to have committed a crime. Though your child may be held in custody by the authorities he or she will not be held with adults. Your child is not entitled to post bond to regain his or her freedom but, a child is entitled to a hearing as to whether he or she should be released within 72 hours of the detention. 2. Why would a Judge keep my child in the County Juvenile Detention Center? There are 5 legal reasons a Judge will continue the detention of a child:
  • He/she is likely to abscond or be removed from the jurisdiction of the court;
    suitable supervision, care, or protection for him/her is not being provided by a parent, guardian, custodian, or other person;
    he/she has no parent, guardian, custodian, or other person able to return him to court when required;
    he/she maybe be a danger to himself/herself or may threaten the safety of the public if released; or

    Statutory Restrictions on Convicted Felons in Texas
    Additions and Changes through the 78th Legislature, Regular Session
    In 2002, a list of Texas statutes restricting, or limiting, some activities of convicted felons was published and widely distributed to parole and probation officers, attorneys, inmates, libraries, schools, counselors, ministers and inmate families. The intent of the list is to identify laws which impact a former inmate upon his/her re-entry into society. Procedures available to a convicted individual and outlined in the statutes, such as the Code of Criminal Procedure, are excluded. For example, the procedures for expunging criminal records or restoring civil rights are excluded. Users are reminded to consult the entire law cited instead of relying on the annotation in the list. Texas laws are available on the Internet at http://www.capitol.state.tx.us . Copies of the 2002 list may be purchased.     http://danielpipes.org/article/1975 Today, July 26, 2004, is the day any of you who are students at the University of Pennsylvania Law School must get in your resumé and a grade sheet if you want to participate in the newly-announced seminar on "Islamic Criminal Law: Drafting a Criminal Code for the Maldives." The law school's registrar, Gloria Watts, sent out a notice informing students of changes in the fall semester's course offerings, as first noted at LittleGreenFootballs.com . One of the them is that Paul H. Robinson, Colin S. Diver Distinguished Professor of Law, cancelled his "Criminal Law Theory Seminar" and replaced it with the three-credit Maldive project. Robinson's course description explains the reasons for the shift in the seminar's topic and its urgency: The seminar will revolve around a single project: drafting a new criminal code for the Maldives. The work has been requested by the Maldivian government and is sponsored by the United Nations Development Program. Because the Maldives is by constitutional mandate an Islamic nation and, as a matter of law, all citizens are Muslim, the code will be the world's first criminal code of modern format that is based upon the principles of Shari‘a. After studying the existing Maldivian criminal law statutes and the criminal law principles contained in Shari'a, student teams will propose criminal code provisions and critique the proposals of others.

    DUI/DWI charges are an ever increasing fact of our society. Thanks to organizations like Mothers Against Drunk Driving (MADD), our law makers continue to strap us, the citizens, with tighter and tighter penalties and regulations. The myriad of penalties include everything from mandates for longer driver's license suspensions for citizens who have not even been convicted of a crime, to mandatory jail sentences, to permanent, lifetime criminal records, to massive financial burdens, like "keep your driver's license" surcharges in excess of $1,000.00 per year for three years for anyone convicted of DWI, even a first time offender. We are also seeing a dramatic increase in the number of DUI/DWI Task Forces emerging throughout Texas and the rest of the United States. These task forces are often federally funded and the officers themselves required to make arrests in order to keep the funding available.

    Alcohol and Minors in Texas; Zero Tolerance for Children of the Lone Star State The following information, as taken from chapter 106 of the Texas Alcoholic Beverages Code, is provided as a general introduction to alcohol related offenses for minors in the State of Texas. Under Texas law a minor, for purposes of alcohol-related offenses, is any person under the age of twenty-one (21), which is the minimum drinking age. To understand how any of the following statutory provisions might apply to the specific facts of your case you should consult with a licensed attorney who can answer your questions. CHAPTER 106 PROVISIONS RELATING TO AGE Definition of Minor (106.01) In this code, "minor" means a person under 21 years of age. Purchase of Alcohol by a Minor (106.02) (a) A minor commits an offense if the minor purchases an alcoholic beverage. A minor does not commit an offense if the minor purchases an alcoholic beverage under the immediate supervision of a commissioned peace officer engaged in enforcing the provisions of this code.

MICHAEL PAUL MAHONEY was convicted of selling methamphetamine in 1980 and served 22 months in a Texas prison. Upon his release, he went straight, opening a pool hall in Jackson, Tennessee. After closing up each night, he would deposit the day's receipts at the bank, carrying a small .22-caliber pistol for protection. In 1992, after the pistol was stolen, Mahoney bought a new one at a pawnshop, filling out the required paperwork. After the Bureau of Alcohol, Tobacco, and Firearms investigated the purchase, the U.S. Attorney's Office in western Tennessee charged him with violating a federal law that bars "career criminals" from owning a gun. (He qualified as a career criminal because he had sold methamphetamine to an undercover officer three times.) Although the judge at Mahoney's trial protested that it was pointless to pursue such a case against a now-law-abiding citizen, federal sentencing rules tied his hands. Mahoney, who was 39 when he was convicted in 1993, received a 15-year sentence. By contrast, people convicted under Tennessee's law prohibiting gun ownership by felons (which did not apply to Mahoney, since his drug conviction was more than 10 years old) can receive sentences of less than a year.
