    Finding Texas law in the Tarlton Law Library
    Prepared by Beth Youngdale Researching “the law” on a particular topic is generally a multi-step process that involves checking a number of sources - statutes, cases, and, sometimes, administrative rules or regulations. Very rarely is there a simple answer to a legal question or a single book that will provide an answer. Discovering what “the law” is in a given situation means finding the rule that is applicable - usually a statute, or in some instances a case - and then applying the rule to the facts of the situation. Case law is generally used to see how courts have applied the rule in other situations. The key is finding a case with facts that are analogous to your own.
    Getting started
    Where you start depends largely on what information you already have about the area of law you are researching. If you already have a citation - to a statute or a case - you are, to a certain extent, ahead of the game. Statutes and cases provide excellent jumping off points to additional sources of the law. If you don't have a citation, or are unfamiliar with an area of law, secondary sources are a good place to start. These sources, which are not the law, provide background information, an introduction to the terminology of a particular topic, and valuable citations to primary sources of law (statutes, cases, administrative rules).

    Texas Law
    This chapter outlines some criminal law issues and focuses on misdemeanors, for which punishments are relatively less severe than for felonies. Felonies are covered in the Chapter, along with white collar crimes, the rights of persons accused of crimes, and the rights of crime victims. This chapter also discusses driving-while-intoxicated violations. Domestic abuse is covered in the Family Law Chapter. Criminal procedure is covered in the Process of a Lawsuit Chapter, and private causes of action that result from criminal conduct are covered in the Personal Injury Law Chapters.
    Criminal Codes
    Criminal law defines conduct that is prohibited by the government and the range of penalties that can be imposed for violating these prohibitions. Persons who violate criminal laws incur penalties ranging from fines to imprisonment or, in some states such as Texas, execution. Punishment for committing a misdemeanor may include jail time and/or a fine. Punishment for an infraction does not include jail time. The law also allows authorities to seize property connected with the commission of a crime. For example, a person charged with violating laws connected with controlled substances must forfeit the substances as well as the raw materials used to make the drugs, vehicles and property used to further the crime, and any money or other proceeds from the sale of the controlled substances.

    United States Supreme Court ruling: Roe v. Wade (1973):
    Prior to the U.S. Supreme Court's famous Roe v. Wade decision, abortions were permitted in certain states but banned in others. The court ruled in 1973 that, anywhere in the U.S.: a woman and her doctor may freely decide to terminate a pregnancy during the first trimester, state governments can restrict abortion access after the first trimester with laws intended to protect the woman's health. abortions after fetal viability must be available if the woman's health or life are at risk; state governments can prohibit other abortions. The Roe v. Criminal law offences range from "traditional" crimes such as murder, assault, robbery and theft, to newer crimes such as driving with a blood alcohol level "over 80." Criminal Procedure: An Overview In Canada, criminal law is enacted by the federal Parliament. Criminal procedure in Canada is concerned with criminal proceedings in the criminal courts and such matters as conduct within the courtroom, competency of witnesses, oaths and affirmations, and presentation of evidence. In a narrow sense, criminal procedure covers pleading, evidence, and practice. In a broader sense, it encompasses rules in the Criminal Code which deal with police powers, right to counsel, search warrants, interim release, witnesses, etc. In the United States, most criminal law is set by the individual states, although the Federal government has adopted its own criminal code in Title 18 which deals with activities that extend beyond state boundaries or have special impact on Federal government operations. Criminal procedure in the United States consists of the law governing the series of proceedings through which the substantive criminal law is enforced.     REPORTING PROGRAM Purpose of UCR The objective of the Uniform Crime Reporting program is to produce reliable crime statistics for law enforcement administration, operation, and management. This information is also available as a measure of the fluctuations in the type and volume of crime in Texas. The means utilized to obtain these objectives are: to measure the extent, fluctuation, distribution, and nature of crime through the collection of data on the eight serious Crime Index Offenses; to measure the total volume of serious crime known to police; to show the activity and coverage of law enforcement agencies through arrest counts and police employee strength data. History of UCR The National Program The Uniform Crime Reporting program of the Federal Bureau of Investigation grew from the need for a national view of law enforcement statistics. In the 1920’s, the International Association of Chief’s of Police (IACP) formed the Committee on Uniform Crime Records to develop a uniform system of police statistics. The IACP’s voluntary national crime collection program began, in 1930, with the participation of 400 police agencies representing some 20 million citizens in 43 states. In that same year, the U.S. Congress authorized the Federal Bureau of Investigation to serve as the national clearinghouse for the crime statistical information collected by the program.

Text (a) A person commits an offense if the person operates a passenger vehicle, transports a child who is younger than five years of age and less than 36 inches in height, and does not keep the child secured during the operation of the vehicle in a child passenger safety seat system according to the instructions of the manufacturer of the safety seat system. (b) An offense under this section is a misdemeanor punishable by a fine of not less than $100 or more than $200. (c) It is a defense to prosecution under this section that the person was operating the vehicle in an emergency or for a law enforcement purpose.
