This information is for reference use in Underwood Law Library and is not intended as a substitute for obtaining legal advice. Court rules regulate the conduct of business before the courts. The rules establish uniform procedures that provide all parties to a lawsuit with the information necessary to present their cases in court. They provide guidelines for everything from the preparation of papers to be filed to the strict time limitations set by the court. Consequently, it is essential to know where the rules are published, how to find amendments or proposed rules, and how to find secondary sources that provide discussion of a rule’s history, purpose, and general application.
FEDERAL COURT RULES
Rules of general applicability in the federal courts are the Federal Rules of Civil Procedure Federal Rules of Criminal Procedure Federal Rules of Evidence , and the Federal Rules of Appellate Procedure There are also rules governing procedures in particular courts, such as the Supreme Court of the United States, the United States Bankruptcy Courts, and the United States Tax Court.

Unfortunately , Federal government does not require that the states implement any access provisions, not do they require that states enforce access. The statute to which you probably refer is Section 25.03 of the criminal code which was passed as a means of dealing with parental kidnapping, but written in such a manner as to also imply "visitation" denial. The last legislative session rewrote the criminal code and altered the penalties for many crimes, including parental kidnapping (25.03). Some members of the committees through which the enacting bill passed used that opportunity to read legislative intent into the law, making 25.03 apply to "visitation" denial as well as other forms of parental kidnapping. Will the new interpretation be used? The threat of its use by prosecuting attorneys has resulted in some NCPs reestablishing contact with their children. Several assistant district attorneys would like to use it to prosecute denial of "visitation" but have been overruled within their own office meaning that it is only a matter of time until an office begins to make full use of the statute. And, when one does, soon another will. Texas does provide other provisions for enforcing access: the offending party and all that assisted them in the denial can be sued; a lawyer can be appointed to file papers to enforce access by contempt, and the offending party must pay that lawyer; a Friend of the Court can be appointed to enforce access, using counseling, mediation, social workers, contempt, or any other vehicle, and the offending party must pay that attorney's fees; and, of course, now there is 25.03.

TEXAS STATEWIDE SEARCH Source: Texas Juvenile Probation Statistical Report Adjudicated Probation : After going to court for an adjudication hearing on the facts, a judge may order this form of community-based supervision for a specified period of time, based on such reasonable and lawful terms as the court may determine. While on adjudicated probation, the offender may be required to participate in any program deemed appropriate, such as an intensive supervision program or residential placement. Adjudication Hearing : Hearing held after the announcement hearing where it is determined whether the child committed the offense named in the petition; the juvenile equivalent of a criminal trial. Announcement Hearing : The first hearing in the Juvenile Court process at which time the judge determines if the Court needs to appoint an attorney, or if the family can retain their own. Appeal : A complaint to a higher Court urging that it overturn the decision of a lower Court. Certification Hearing : Hearing held to determine whether the juvenile court will waive its jurisdiction so that an accused juvenile felony offender can be prosecuted as an adult. Certification is permissive and not mandatory under Texas law. Depending upon the type of felony committed, a juvenile as young as either 14 or 15 years of age can be certified to stand trial as an adult.

I had second thoughts about ever putting this section on the web. The main reason is because it is easy to be misled by what is in a statute. You can read a statute and think you have the right to do something and only find out later that you were wrong. The law is sometimes referred to as a seamless web. That means many things, but one of them is that nothing exists in isolation. Everything must be understood in "context." In understanding a statute, one must consider the common law, case law, legislative history, other statutes, rules of interpretation, and the political climate (among other things) before one can even begin to understand the effect of a statute. That means that a lay person is apt to go astray if he relies on the literal language of a statute. And when firearms matters are at issue, both your liberty and property are at stake. So use this section as only the most basic introductionas a place for your research to start. Specific questions should be directed to the lawyer of your choice. Please do not take this warning lightly. Statutes are the actual laws passed by the legislature. Many Texas laws are found in "Codes," such as the Government Code, the Penal Code or the Texas Code of Criminal Procedure. Every law library will have a set of these statutes. If you go to a law library (most courthouses have law libraries) ask for the Black Statutes. The "black" refers to the color of the book bindings. The books are also referred to as Vernon's Annotated Statutes.

SEC. 8.09. CONTINUING STATUTORY REVISION PROGRAM. The Texas Legislative Council is required by Section 323.007, Government Code , to carry out a complete nonsubstantive revision of the Texas statutes. The process involves reclassifying and rearranging the statutes in a more logical order, employing a numbering system and format that will accommodate future expansion of the law, eliminating repealed, invalid, duplicative, and other ineffective provisions, and improving the draftsmanship of the law if practicableall toward promoting the stated purpose of making the statutes "more accessible, understandable, and usable" without altering the sense, meaning, or effect of the law. Before the initiation of this program, Texas statutes were last revised in 1925. As the result of this history, the user of Vernon's Texas Civil Statutes must wade through numerous printed statutes that are legally ineffective, must sort out surplus from substance, must adapt to confusing inconsistency of expression, capitalization, spelling, and punctuation, and must try to comprehend an alphabetical arrangement and often bizarre numbering scheme. The statutory revision program was created with the recognition that Texas statutes are difficult to use and difficult to understand. The complexity of modern law further dictates both revision and a sensible statutory arrangement.
