If an individual is convicted of a capital felony, he or she may be subject to punishment by death, if the State sought such punishment. A capital felony is one in which an individual "intentionally or knowingly causes the death of an individual," under special circumstances. In particular, the:

    Chapter 58. Records; Juvenile Justice Information System
    Subchapter C. Automatic Restriction of Access to Records.
    In this subchapter, "department" means the Department of Public Safety of the State of Texas.
    The following records are exempt from this subchapter:
    sex offender registration records maintained by the department or a local law enforcement agency under Chapter 62, Code of Criminal Procedure; and records relating to a criminal combination or criminal street gang maintained by the department or a local law enforcement agency under Chapter 61, Code of Criminal Procedure.
    The department shall certify to the juvenile court or the juvenile probation department to which a referral was made that resulted in information being submitted to the juvenile justice information system that the records relating to a person's juvenile case are subject to automatic restriction of access if: the person is at least 21 years of age;
