    Researching the Law of France
    I. Background
    France is a civil law system. Thus, the most important sources of French law are the five basic codes (Code civil, Le nouveau code de la procedure civile, Code de commerce, Code pénal, and Code de procedure pénal) and the French Constitution. These sources, along with custom, are primary sources of law. Persuasive sources of law include jurisprudence (court decisions) and doctrine (legal writings). An important distinction in French law lies between "public law" and "private law." Public law includes questions relating to government, the constitution, public administration, and criminal law; private law includes questions of justice between private persons or corporations. France is a federal parliamentary republic organized into three branches of government, with a strong executive branch. The president appoints the Council of Ministers, which is commonly referred to as the government. The legislative branch (Parlement) is bicameral, consisting of l'Assemblée nationale (National Assembly) and le Sénat (Senate).     Researching the Law of Germany
    Throughout this guide, Germany refers to the unified Federal Republic of Germany. This means that sources will focus on West German legal materials. Please consult a librarian in the Reference Office if you need to do research on the former German Democratic Republic. I. Background Unification occurred on October 3, 1990. The successor state of the Federal Republic of Germany is a federation of 16 states or Lander, five from the former German Democratic Republic. Germany is federal parliamentary republic organized into three branches of government. The executive is headed by the President, who is more than a figurehead, but has less authority than the President of the French Republic. Executive power is centered in the Chancellor and his cabinet. The legislative branch is bicameral, consisting of the lower house (the Federal Assembly or Bundestag) and the upper house (the Bundesrat). The Bundestag is the more powerful of the houses.

    Additions and Changes through the 78th Legislature, Regular Session
    In 2002, a list of Texas statutes restricting, or limiting, some activities of convicted felons was published and widely distributed to parole and probation officers, attorneys, inmates, libraries, schools, counselors, ministers and inmate families. The intent of the list is to identify laws which impact a former inmate upon his/her re-entry into society. Procedures available to a convicted individual and outlined in the statutes, such as the Code of Criminal Procedure, are excluded. For example, the procedures for expunging criminal records or restoring civil rights are excluded. Users are reminded to consult the entire law cited instead of relying on the annotation in the list. Texas laws are available on the Internet at http://www.capitol.state.tx.us . Copies of the 2002 list may be purchased.
