The intent of the law is to provide intensive outpatient rehabilitation and treatment to the sexually violent predator. Civil commitment is different than a criminal sentence in that a criminal sentence has a definitive time frame. Civil commitment continues until it is determined that the person’s behavioral abnormality has changed to the extent that the person is no longer likely to engage in a predatory act of sexual violence. A sexually violent offense is defined as (Title 11 Texas Health and Safety Code Section 841.002) Indecency with a Child, Sexual Assault, Aggravated Sexual Assault, Sexually Motivated Capital Murder, Sexually Motivated Murder, Aggravated Kidnapping with Intent, Burglary with Intent, any attempt, conspiracy, or solicitation of the latter, or any offense under the law of another state, federal law, or the Uniform Code of Military Justice that contains elements substantially similar.

Spoliation of Evidence: A Survey of Texas Law Oliver Wendell Holmes once said that "[t]he law embodies the story of a nation's development through many centuries, and it cannot be dealt with as if it contained only the axioms and corollaries of a book of mathematics." Unfortunately, this statement accurately describes the current Texas law on spoliation of evidence in that there are few hard and fast rules concerning the destruction of evidence. The best way to determine the law in your jurisdiction is to review the specific history of the court you are in. A. What is Spoliation? Though the Texas Supreme Court has not defined the term spoliation and different jurisdictions have applied different definitions to the term, the term broadly refers to the intentional, reckless, or negligent destruction, loss, material alteration or obstruction of evidence that is relevant to litigation. It is, however, still unclear if spoliation includes both negligent and intentional destruction of evidence, the loss of evidence, and/or evidence that was destroyed before litigation began. B. It is hard to believe that it has been ten years since the U.S. Department of Labor (DOL) issued its final regulations implementing the federal Family and Medical Leave Act of 1993 (FMLA). Unfortunately, the passage of time has not made complying with the statute and regulations any easier. Even after years of DOL opinions and court decisions, much of the regulations remain confusing and non-intuitive. However, because of the passage of time, a pattern of common issues has emerged. [SEX DISCRIMINATION] Lipstick and Lawsuits: Can Sexual Stereotyping Claims Successfully Combat "Appearance Discrimination" At a time when many employers in the United States are placing greater emphasis on employees’ personal appearance, employee advocates have ratcheted up their efforts to have many types of employment actions based on appearance deemed illegal. What is commonly referred to as “appearance discrimination” has even earned a new catch-phrase: “look-ism.” One of the bows in the quiver of employee advocates is the legal theory of sexual/genderbased stereotyping, which originates, in large part, from a plurality opinion in the United States Supreme Court case of Price Waterhouse v. Hopkins, 490 U.S. 228 (1989). This Article traces the development of the sexual stereotyping cause of action from Price Waterhouse to possible applications in current appearance discrimination claims.

Section 7.01. General Warranty Complaints Section 3.08(i). The owner of a motor vehicle or the owner's designated agent may make a complaint concerning defects in a motor vehicle which are covered by a manufacturer's, converter's, or distributor's warranty agreement applicable to the vehicle. Any such complaint must be made in writing to the applicable dealer, manufacturer, converter, or distributor and must specify the defects in the vehicle which are covered by the warranty. The owner may also invoke the Commission's jurisdiction by sending the Commission a copy of the complaint. A hearing may be scheduled on all complaints arising under this subsection which are not privately resolved between the owner and the dealer, manufacturer, converter, or distributor.

(Law 900) The Lawyering Process - 3 Credits
This course has tree distinct components. Legal Process, Legal Writing, and Legal Research. Legal Process involves the study of the sources of United States law and an analysis and synthesis of court decisions. This part of the course also includes an introduction to statutes. The Legal Writing component meets once a week. There are two writing assignments, (one of which is rewritten) and a law office memorandum. The Legal Research component is taught through a combination of guided exercises and classroom discussion on research techniques. Training on Lexis and Westlaw is provided through the law library. (Law 901) Moot Court - 2 Credits
Students may enroll in this course in their last semester in law school based upon participation points accumulated through prior moot court activity. Student have responsibility to manage the moot court program, prepare briefs for competitions, and assist in the appellate litigation program. These significant responsibilities, in part, justify the credit given in this course.

Texas Oklahoma New Mexico Your State Search IPM Site: School IPM Coordinators in Texas HISTORY OF TEXAS LAW: Have you ever wondered why Texas has one of the most comprehensive school IPM laws in the country? In 1981, the Chillicothe Independent School District (ISD) was forced to close its doors for four weeks because students experienced adverse reactions to chemicals sprayed to control an ongoing head lice infestation (Wichita Falls Times April 27, 1981).  Lindane and toxaphene, two potent agricultural insecticides not approved for such use, were applied by unlicensed persons. Students reportedly suffered rashes, headaches, and nausea after the application.  When was the law passed? In order to avoid a repeat of the Chillicothe problem, State Representative John Hirshi of Wichita Falls submitted House Bill 2751 during the 72 nd legislative session in 1991. The Texas Legislature passed HB 2751 requiring all Texas school districts to adopt Integrated Pest Management (IPM) programs.
