Texas Statutes and Codes Underwood Law Library Southern Methodist University Guide 301 Revised July 2005 Legislative Process in Texas The Texas Legislature meets regularly in odd-numbered years for a maximum of 140 days beginning on the second Tuesday in January. Along with this 140-day session, the Governor may call one or more special sessions to consider only those matters approved by the Governor. Consequently, for every legislature there is a “Regular” session, and there may be one or more “Special Called” sessions. Both House and Senate members introduce thousands of bills each session during the first 60 days. After 60 days, there are certain restrictions on introducing a bill. Starting in November, members of the Legislature may also file bills preceding the regular session. How a Bill Becomes Law When a bill is introduced, it is assigned a bill number, e.g., S.B. 1 or H.B. 1. However, if a special session is called, the ensuing bills are numbered separately, starting with bill number one. For example, during the 71st Legislature there was a regular session and six called sessions, resulting in seven bills assigned H.B. 1—none of which necessarily concerned the same subject matter. Only a small percentage of bills are actually enacted into law. The version of a bill that is passed by both houses is called the “enrolled bill.” This is the version sent to the Governor for his signature and, if signed, is later published in the state’s session laws. LOBBYIST INFORMATION AVAILABLE TO THE PUBLIC THE LOBBY LAW Chapter 305 of the Government Code requires a person who crosses either a compensation or expenditure threshold to register with the Texas Ethics Commission and to file periodic reports of lobbying activity. Chapter 305 also contains restrictions applicable to persons required to register as lobbyists. This lobby law is administered and enforced by the Ethics Commission. Texas No Call - Telephone Solicitor FAQ House Bill 472, passed during the 2001 Texas Legislative session, created the Texas Telemarketing Disclosure and Privacy Act. The Act enabled the Public Utility Commission of Texas (PUC) to implement a statewide “Do Not Call List” for residential customers who wish to stop telemarketing calls to their homes. In addition, Senate Bill 7, which restructured the retail electric market, included an “Electric No Call List” for Retail Electric Providers (REPs) and telemarketers that make calls on their behalf. The Texas Legislative Council is required by Section 323.007, Government Code , to carry out a complete nonsubstantive revision of the Texas statutes. The process involves reclassifying and rearranging the statutes in a more logical order, employing a numbering system and format that will accommodate future expansion of the law, eliminating repealed, invalid, duplicative, and other ineffective provisions, and improving the draftsmanship of the law if practicableall toward promoting the stated purpose of making the statutes "more accessible, understandable, and usable" without altering the sense, meaning, or effect of the law. Before the initiation of this program, Texas statutes were last revised in 1925. As the result of this history, the user of Vernon's Texas Civil Statutes must wade through numerous printed statutes that are legally ineffective, must sort out surplus from substance, must adapt to confusing inconsistency of expression, capitalization, spelling, and punctuation, and must try to comprehend an alphabetical arrangement and often bizarre numbering scheme. The statutory revision program was created with the recognition that Texas statutes are difficult to use and difficult to understand. The complexity of modern law further dictates both revision and a sensible statutory arrangement.
