Also in keeping with the Hispanic law was a statute enacted in 1856, which allowed anyone "of sound mind" to make a last will and testament. Even though she could not witness the will of another person, a matron had the right to leave her separate property, as well as her share of the community property qv to whomever she chose. Control of their own property came slowly to married women, creeping through five acts of legislation passed over more than fifty years. In 1913 Houston attorney Hortense S. Ward, qv The Family Code carried benefits for women in addition to those affecting property. After 1967 both spouses had the right to select their respective domiciles, and in the event of separation or divorce, mothers retained equal rights with fathers regarding custody of the children. As parents, each had the legal duty to support their children. For the first time the wife, if employed, acquired the responsibility of providing for a husband unable to support himself; a housewife was not, however, required by law to take a job. The law also recognized the wife's right to retain her birth name after marriage. The Spanish law required a married woman to take her husband's name, but from the earliest days of the Republic of Texas qv the practice was never mandatory: the changing of a bride's name was always more a matter of custom than of law.

In our Jan. 15 column, we learned that West Publishing Company("West") prints Texas statutory law in two arrangements: the civil statutes in Vernon's Texas Revised Civil Statutes Annotated ("civil statutes"), and the codified statutes in Vernon's Texas Codes Annotated ("Codes") [ See " Making Vernon's Volumes Work for You , " page 26]. Now let's test your legal research acumen. Question 1: What is the origin of a civil statute? Question 2: How and why is a civil statute enacted into a code?
    THE 1925 BULK REVISION Answer to Question 1: The 1876 Texas Constitution contains the following provision: "The first session of the Legislature under the Constitution shall provide for revising, digesting and publishing the laws civil and criminal; and a like revision, digest and publication may be made every ten years thereafter; . . . ." Since the adoption of the 1876 Constitution, Texas has had four bulk revisions of its statutes. A "bulk revision" involves major changes to the substance of the law by re­enactment of all of the statutes (in contrast to those statutes on a particular subject), eliminating repealed, invalid, duplicative and other ineffective provisions. The four bulk revisions occurred in 1879, 1895, 1911 and 1925. See Joseph H. Pool, "Bulk Revision of Texas Statutes," 39 Tex. L. Rev. 469 (1961). The civil statutes are the statutes enacted in the 1925 bulk revision, and subsequently amended.

    Nuisance Abatement: Civil Suits a Powerful Tool for Law Enforcement

    Picture this: a motel and convenience store sit on either side of I-35. The motel is well known as a place where drugs are sold. Sexual assaults, murders, and robberies have been reported at that location. At the convenience store across the street, gangs recruit new members, and the store sells alcohol to minors. Criminal activity is rampant at both properties. As law enforcement professionals, you know exactly what this kind of situation is like. You are forced to spend a disproportionate amount of time patrolling these two properties, making countless arrests. Yet the crime continues despite the conviction and incarceration of many individuals. The surrounding neighborhood is suffering. What can be done to clean up properties like these? The answer lies in a little known legal tool called “nuisance abatement.” A nuisance abatement suit is a civil action filed against a property and/or a person who maintains it, when the property serves as a safe haven for crime. Statutes governing nuisance abatement are found in Chapter 125 of the Texas Civil Practice and Remedies Code as well as in Section 101.70 of the Texas Alcoholic Beverage Code.
