FILING A COMPLAINT WITH
THE TEXAS EDUCATION AGENCY July, 1999 Introduction
Parents, and other interested persons, who have complaints about the special education services being provided by a school district may file a complaint with the Texas Education Agency (TEA). TEA is required to operate a complaint management system for addressing any violation of Part B the Individuals with Disabilities Education Act (IDEA), including the identification, evaluation, or placement of a student with a disability, or the provision of a free appropriate public education (FAPE) to the student. Organizations may also file complaints. Complaints may be about services being provided to one student with a disability or to a group of students with disabilities. While a parent, organization, or any other interested person may file a complaint, this handout will refer to the person sending the complaint as "parent." The Office of Special Education Programs (OSEP) has specifically stated that the complaint management system is supposed to be a less costly, but equally effective, alternative to filing a request for a due process hearing. Therefore, any issue that would be appropriate to take to a hearing is also appropriate for the complaint management system. In many instances, the parent should try to resolve the complaint with the school district by going to an Admission, Review and Dismissal (ARD) meeting before filing a complaint with TEA. For example, if the parent believes that the school district staff is not implementing the modifications called for in the Individualized Education Program (IEP), the parent should bring that to the attention of the ARD Committee and complain to TEA if it continues to be a problem.

Texas deregulated its telecommunications services in 1995. The Texas bill included many of the elements found in the subsequent federal Telecommunications Act of 1996. Of particular importance to rural areas are the universal service guarantees of 1996 HB 2128 State Efforts
The Texas state government outlined its vision for telecommunications in the State Strategic Plan for Information Management . The plan calls for broad public-private partnership in bringing the benefits of telecommunications to the people of Texas. The core of the plan is the use of the state fiber optic network (which consists of state-owned and leased lines) which connects hundreds of government agencies and offices around the state. One of the primary goals outlined in the plan is to expand the reach of government services by making them available online. Part of this effort has been the development of extensive WWW resources for government and state information, located on the State of Texas Homepage HB 2128 includes special provisions for schools and health care clinics. These entities are guaranteed discounted access to certain telecommunication services (T1 and T3 connections are priced at 105% of the Total System Long Run Incremental Cost, or TSLRIC. For entities in the territory of SBC [formerly Southwestern Bell], this means that T1 pricing is available for $260/month). The deregulation bill also set up a Telecommunications Infrastructure Fund to promote the use of telecommunications services in schools. This fund (which is $150 million per year for ten years) is designed to help defray the cost of setting up local and wide area networks and the costs of purchasing computers for use in classrooms. It gives priority to schools who form consortia with other schools, libraries, universities, and those who have matching funds. Recognition is also given to projects that seek to include the local community and those that serve more rural areas. The latter fund recognizes the need to set up local infrastructure in order to make the broader infrastructure useful, as outlined in the

SEDL Streamlines E-Plans for Texas Education Agency
Districts, charter schools, and education service centers in Texas-more than 1,400 entities-are required to submit their technology plans to the Texas Education Agency (TEA). In collaboration with the Texas Education Agency, staff of both SEDL's regional education laboratory and SouthCentral Regional Technology in Education Consortium developed E-Plan, an online system for developing, submitting, reviewing, and approving technology plans. Texas e-Plan "went online" as of January 2004 SEDL REL Web administrator Brian Litke and RTEC program associate Kim Hughes designed the Texas e-Plan with several features that support online creation of technology plans. First, it creates a uniform template that clarifies technology planning expectations for districts. Second, Texas e-Plan integrates data from the state PEIMS (Public Education Information Management System) and STaR (School Technology and Readiness) Chart into the plans. Finally, it provides automated feedback that highlights the components of a plan that align to federal E-Rate criteria, No Child Left Behind requirements, and the Texas Long Range Plan for Technology recommendations. The new automated planning system allows TEA and the 20 regional services centers to monitor the status of plan development in any district and search and locate information on specific plan elements.

US State Government Aid The Free Application for Federal Student Aid (FAFSA) is used to apply for most state loan, grant and scholarship programs, in addition to the federal loans and grants. When you submit the FAFSA to the US Department of Education, they forward the information on the form to the state student assistance agency. Each state has a different FAFSA submission deadline. If you submit your FAFSA by March 1, you will be in time for all state deadlines, other than Michigan. If you miss the deadline, you will be ineligible to receive state aid for the entire academic year. Procedures for applying for state prepaid tuition programs and the national guard differ from state to state. The amount of information provided on the state web sites varies from state to states. Some states provide comprehensive information about residency requirements , loan, grant, scholarship and prepaid tuition programs and other state aid programs. Others provide minimal information. Operating and personnel costs are also lower in the consolidated school option, with savings approaching $3,500 per student over 40 years in Maine. State Department of Education Requirements Although all states must comply with the federal provision of No Child Left Behind, many states have programs for mid-career changers individuals who already have a bachelor's degree—that are alternatives to the traditional route to teacher certification. Just as teacher certification requirements differ from state to state, so do alternative certification program offerings. In the State Departments of Education directory, RNT provides resources developed by the National Center for Alternative Certification: a coded list of alternative certification programs offered in each state, and an alternative licensure key that describes details about the types of programs offered by each state.
As this information about alternative certification is subject to change, you will still want to call for the most up-to-date information. Some states offer this information online and others will mail you a packet about state-approved alternative certification programs and requirements.

BRIEFING PAPER: Texas Charter Schools
Supporters have touted charter schools as a cure-all for public education. Those proponents have promised that loosening regulations and eliminating certification requirements for teachers will help charters do a better job than traditional public schools of educating students (particularly for diverse populations) and help them hire better teachers. They also say charters will improve traditional public schools through competition. Since its inception in 1995, however, the charter school system in Texas has been characterized by poor academic performance, a lack of accountability and irregular financial practices. As a result, the charter school system has squandered huge sums of taxpayer money while trapping many students in situations that range from dismal to dangerous.
Charter schools fall short of traditional schools in student achievement.
  • Traditional public schools in Texas meet state performance standards at higher rates than do charter schools. A U.S. Department of Education study found that this fact did not change after controlling for the proportion of low-income students, the proportion of minority students, student mobility and student enrollment.
