MEMBERS Special Education Individuals with Disabilities Education Act (IDEA '97) Reauthorization Although Congress is due to reauthorize the Individuals with Disabilities Education Act by the end of 2002, it appears unlikely that it will be completed until the next legislative session. The report of the President’s Commission on Excellence in Special Education, released in July, was examined in hearings held by the House and Senate education committees. Many of the recommendations were well received, including post-secondary transition services for students with disabilities. Many of the recommendations, however, proved controversial, including proposals to provide vouchers for students with disabilities and block grant IDEA funding to 10 states. Legislation has not yet been introduced in either the House or Senate. We expect the major issues to include discipline, vouchers, professional development, disproportionate minority representation, and full funding. In some cases, their academic difficulties can be directly attributed to deficiencies in the teaching and learning environment. For example, students with limited English may fail because they do not have access to effective bilingual or English as a second language (ESL) instruction. Students from lower socioeconomic backgrounds may have difficulty if instruction presumes middle-class experiences. Other students may have learning difficulties stemming from linguistic or cultural differences. These difficulties may become more serious over time if instruction is not modified to address the students' specific needs. Unless these students receive appropriate intervention, they will continue to struggle, and the gap between their achievement and that of their peers will widen over time. Improving the academic performance of students who from non-English backgrounds requires a focus on the prevention of failure and on early intervention for struggling learners. This digest presents a framework for meeting the needs of these students in general education and suggests ways to operationalize prevention and early intervention to ensure that students meet their academic potential.

The first step in applying for any type of coverage is a process, called "underwriting," whereby the coverage issuer assesses the value of the items to be insured, if applicable, and the potential risk of a claim of loss, damage, or injury. These factors combined with the level of coverage provided, will primarily determine the rate, or "premium," the carrier will charge. In general, the greater the value of the thing insured and the greater the risk of the claim, the higher the premium rate will be. A carrier may determine that certain risks are too high and decline to issue coverage entirely, or only issue coverage on the condition that certain items or causes of loss are excluded from the policy. Most policies will contain exclusions for some causes of loss. It is extremely important to understand a policy´s terms completely; because unless a loss is within the terms set by the policy, the carrier will not pay.

Minow, Professor at Harvard Law School and Co-Director on Policy for the National Center on Accessing the General Curriculum Background We've just celebrated the 25th anniversary of the federal law in this area, now carrying the inspired acronym of IDEA - for the Individuals with Disabilities Education Act . Similar laws have been adopted by most states. The federal law requires all states accepting federal funding for their educational programs to make sure that all children with disabilities receive a "free appropriate public education" in the setting that is the least removed from regular classrooms as possible. Congressional hearings in 1966 indicated that two-thirds of children with disabilities in the country were either totally excluded from public education or else "sitting idly in regular classrooms awaiting the time when they were old enough to drop out." The federal law sought to ensure a free appropriate public education for all children, and also dramatically altered the tradition considered the most enlightened path between the years 1820 and 1960 of segregated education for children with blindness, deafness, epilepsy, or other disabilities. The civil rights struggle against racial oppression helped to galvanize an equality movement for people with disabilities challenging not only exclusion but also segregation.
