Florida's program drains millions of tax dollars from public schools.
  • One in four students who took vouchers returned to public schools during the 2002-2003 school year, forcing the public schools to educate all returning students without any financial support from the state.[4]
Florida's private schools have been reluctant to take voucher students due to limits on space and the use of preferenctial admissions.
  • Many private schools early on said they had waiting lists and could not accommodate public school students.[10] Florida private school administrators also objected to the provision that private schools must accept all eligible applicants for available seats. [11]
Florida's program fails children with special needs.
  • About 77 percent of Florida private schools taking tax dollars to educate disabled students do not offer special classes for those children. The state does not require private school teachers to be certified to teach special education or even to teach at all. [12] Even though McKay vouchers are funded by public tax dollars, once parents use a voucher to transfer their children to private schools, they have effectively opted out of the legal rights and educational services guaranteed under the federal Individuals with Disabilities Education Act.[13]

  • Even though McKay vouchers are funded by public tax dollars, once parents use a voucher to transfer their children to private schools, they have effectively opted out of the legal rights and educational services guaranteed under the Individuals with Disabilities Education Act.[8] Private schools are not required to accept the state voucher as full payment. The additional costs are often prohibitive for low-income students and students with special needs. Public schools, on the other hand, are required to meet the needs of a student with disabilities or pay the full cost for that student to attend another school offering adequate services.[9] Unlike public schools, McKay schools are free to discriminate on the basis of religion, gender or type of disability.[10]

Saturday :: April 23, 2005 Bush Administration Fines Texas by TChris Apparently secure in the belief that Texas will forever be a red state, the Bush administration slapped the state for defying the mandates of the administration's signature piece of legislation: No Child Left Behind. For the last two years, the Texas Education Agency has exceeded the federal cap on how many students with learning disabilities can be exempted from regular state testing, mandated by the act, in favor of an easier exam. To quash the defiance, Education Secretary Margaret Spellings fined Texas $444,282 yesterday, a relatively small chunk of the state's $1.1 billion allotment of federal education funds, "and a sliver of the state's $33 billion annual public education budget." That letter imposing the fine was released yesterday evening, the administration's favored time for disclosing unpleasant news. Texas isn't standing alone in its rebellion.

Introduction to the Issues As increasing numbers of students with disabilities apply for admission to institutions of higher education, many are seeking modifications during admissions testing to accommodate for their disabilities. Many of these accommodations are granted. The most common modification is extended time for test administration, although large print versions of tests, readers for tests, and other types of accommodations are also provided. When these accommodations are granted, many of those taking the tests with modifications are unaware that the score reports for such testing usually are sent to colleges or universities with a "flag" or other designation indicating that the test was given under nonstandard conditions. This nation currently embraces important social policy goals of allowing persons with disabilities to participate as fully as possible in society without having to face negative bias or stereotypes. For too long, many individuals with disabilities have had to confront unfair presumptions about their abilities to succeed in education and employment. There are now laws in many states and two federal laws designed to prohibit discrimination against individuals with disabilities.

School Discipline and Children with Serious Emotional Disturbances Disciplinary Educational Placements
In 1995, the Texas legislature created two new separate disciplinary placements for students committing serious offenses. The legislature required counties with over 125,000 residents to develop a juvenile justice alternative education program (JJAEP). The JJAEP is responsible for educating juveniles who receive mandatory expulsions from school for conduct found by a court to constitute one of the serious offenses detailed in the Texas Education Code. The court (not the school district) will refer the juvenile to the JJAEP. A school district may also contract with the JJAEP to educate juveniles receiving a discretionary expulsion for other serious offenses listed by statute or students who persistently misbehave in another disciplinary placement.
