Duke pleads guilty to fraud, false tax claims

NEW ORLEANS, Louisiana (CNN) Former Ku Klux Klan leader David Duke pleaded guilty Wednesday to charges of mail fraud and filing a false tax return. Duke faces up to 15 months in prison and $10,000 in fines at his sentencing March 19, The Associated Press reported. The plea came on the same day an indictment was filed, and followed Duke's lawyer's announcement Monday that Duke had returned to Louisiana to negotiate with prosecutors after three years out of the country. U.S. Attorney Jim Letten filed charges alleging Duke made a false statement on his 1998 federal income tax return when he understated his gross income for that year. Duke also was charged with devising "a scheme to bilk his supporters of money by issuing a series of solicitations through the United States mail," beginning in 1993 and continuing through 1999, Letten said. Duke admitted in court Wednesday that he used large portions of the money he solicited for casino gaming, the U.S. attorney said.

Grimaldi Washington Post Staff Writers Thursday, June 23, 2005; Page A01 Lobbyist Jack Abramoff used money from a Mississippi tribal client to set up bogus Christian anti-gambling groups and to fund pet projects including gear for a "sniper school" in the Israeli-occupied West Bank, according to documents released yesterday by Senate investigators. The revelations came in e-mails and testimony made public yesterday by the Senate Indian Affairs Committee at its third hearing on the activities of Abramoff and Michael Scanlon, a public relations executive and former spokesman for House Majority Leader Tom DeLay (R-Tex.).

Three tax shelters sold by the accounting firm KPMG to wealthy individuals are reportedly the subject of federal investigations. The shelters were marketed under the acronyms FLIP, OPIS and BLIPS. All have been described as convoluted strategies to create investment losses to offset taxable income. The Wall Street Journal
Remedies for Individual Investors
The full extent of the alleged tax shelter fraud is not presently known. It is expected that the IRS will seek to disallow losses claimed and impose penalties on investors. At the same time, government prosecutors are investigating the firms that sold these products for possible criminal charges. Investors who purchased the tax shelters in good faith and in reliance on opinion letters that the investments complied with the tax code should consider pursuing legal claims against the firms that sold these products. It is unlikely that any actions by governmental agencies will result in a return to investors of the substantial fees that they paid for the tax shelters under investigation.

Tax Preparer Fraud
Return Preparer Fraud generally involves the preparation and filing of false income tax returns by preparers who claim inflated personal or business expenses, false deductions, unallowable credits or excessive exemptions on returns prepared for their clients. Preparers may also manipulate income figures to obtain fraudulent tax credits, such as the Earned Income Tax Credit. In some situations, the client (taxpayer) may not have knowledge of the false expenses, deductions, exemptions and/or credits shown on their tax returns. However, when the IRS detects the false return, the taxpayer must pay the additional taxes and interest and may be subject to penalties and criminal prosecution. The IRS Return Preparer Program focuses on enhancing compliance in the return-preparer community by investigating and referring criminal activity by return preparers to the Department of Justice for prosecution and/or asserting appropriate civil penalties against unscrupulous return preparers. While most preparers provide excellent service to their clients, the IRS urges taxpayers to be very careful when choosing a tax preparer. You should be as careful as you would in choosing a doctor or a lawyer. It is important to know that even if someone else prepares your return, you are ultimately responsible for all the information on the tax return.

The philanthropist, Herbert Axelrod, sobbed and expressed his remorse for helping a former executive of his pet supply and pet-related publishing company set up a Swiss bank account to hide taxable income from the Internal Revenue Service. "It was always my goal to be remembered as an outstanding philanthropist," said Axelrod, 77, standing before Judge Garrett Brown in US District Court. "Instead I will be remembered as someone who disrespected the law and this court."
