OTEC Home Page Special Education Talented and Gifted Students In 1987, the Oregon Legislature passed legislation requiring schools to have TAG programs. "Smooth seas do not make skillful sailors." African Proverb Unlike children with disabilities, Talented and Gifted children receive relativley little protection under U.S. Fedenral Law. Without a federal law to protect the legal rights of gifted children, the responsibility for such mandates rests with the states. Approximately 30 states have a mandate to serve gifted children, while the remaining ones have permissive legislation (Council of State Directors of Programs for the Gifted, 1994). The National Association for Gifted Children has written a position paper supporting the concept that each state should mandate by law educational opportunities for gifted children. (Karnes and Marquardt). In 1987, the Oregon Legislature passed legislation requiring schools to have TAG programs. TAG funding from the state legislature and the Oregon Department of Education has been at a very very low level. It currently amounts to about $2.50 per such student per year. This estimate is based on about 8% of Oregon students being identified as TAG, and a funding level of $100,000 a year. This certainly provides a good example of a Legislature not adequately funding one of its mandates!

One time the animals had a school. The curriculum consisted of running, climbing, flying and swimming, and all the animals took all the subjects. The duck was good in swimming, better than his instructor, and he made passing grades in flying, but was practically hopeless in running. He was made to stay after school and drop his swimming class in order to practice running. He kept this up until he was only average in swimming. But, average is acceptable, so nobody worried about that but the duck. The eagle was considered a problem pupil and was disciplined severely. He beat all the others to the top of the tree in the climbing class, but he had used his own way of getting there. The rabbit started out at the top of his class in running, but had a nervous breakdown and had to drop out of school on account of so much makeup work in swimming.
