Government The Republic of China was founded in 1912, and was Asia's first constitutional republic. Under the able leadership of Dr. Sun Yat Sen in the early 20th Century, Taiwan's governing system is made 'of the people, by the people, and for the people'. The president, being the head of state, manages the five branches of the central government called 'Yuan'. They are the Executive Yuan, Legislative Yuan, Judicial Yuan, Examination Yuan, and the Control Yuan. Executive Yuan - includes ministries, and other offices and departments. Legislative Yuan - law-making body. Judicial Yuan - Courts, Council of Grand Justices, other bodies that uphold and interpret the law. Examination Yuan - supervises examinations and personnel.

Taiwan's International Legal Position GENERAL BACKGROUND INFORMATION
As most people know, at the present time Taiwan is not recognized as a sovereign independent nation by the world community. Over the last six years I have been researching this curious fact in detail. According to the historical record, the "major participants" in Taiwanese history after WWII up through the signing of the peace treaty in 1951 were Japan, the United States, and the Republic of China. The People's Republic of China, founded in 1949, was still not a major player in world politics at that time. In the peace treaty, Japan gave Taiwan up, but it wasn't given to the Republic of China. Interestingly, the United States was the principal occupying power of all areas spoken of in the treaty. How do all these facts fit together? Please read on.
Included in this research I have overviewed the US occupation of Cuba (after the Spanish American War), certain areas of Mexico (during the Mexican American War), and West Berlin (after WWII), and analyzed how this all corresponds and dovetails with the situation of Taiwan. I also looked at the legal details of the British occupation of certain areas of Maine during the War of 1812. I have pieced this together with recent Chinese history, the Shanghai Communiques, and all other pronouncements of the US government including the Three Nos, Six Assurances, Taiwan Relations Act, the policies of the current Bush administration toward Taiwan, and a large number of US Supreme Court cases . . . . . . and it all fits together quite nicely. The 1992 "Cross Straits Consensus" also fits in. In particular, (a) Taiwan's entry to the WTO as a "separate customs territory", (b) the

Holidays and Festivals in the Republic of China have a distinctive quality and are closely interwoven with the lives of the people.
The main holidays and festivals in Taiwan may be divided into two major categories : Festivals are associated with the traditional lunar calendar whereas official holidays are celebrated according to the western calendar . The lunar festivals developed from the customs of China's past, and to the celebrants, these occasions are a time for recalling one's cultural origins and remembering the wisdom of early ages. Such festivals include the Chinese New Year Festival, and Lantern Festival, all symbolic of discarding the old and ushering in the new; the Dragon Boat Festival, a time for warding off evil and strengthening the body; the Ghost Festival, when the outcasts from the underworld are given salvation; the Mid-Autumn Festival a celebration of the full moon and unity of mankind; and Double Ninth Festival is to remember the olders.

ADMINISTRATION
The authorities in Taipei exercise control over Taiwan, Kinmen, Matsu, and the Penghus (Pescadores) and several of the smaller islands. Taiwan's two major cities, Taipei and Kaohsiung, are centrally administered municipalities. At the end of 1998, the Constitution was amended to make all counties and cities directly administered by the Executive Yuan. From 1949 until 1991, the authorities on Taiwan claimed to be the sole legitimate government of all of China, including the mainland. In keeping with that claim, when the Nationalists moved to Taiwan in 1949, they re-established the full array of central political bodies, which had existed on the mainland. While much of this structure remains in place, the authorities on Taiwan in 1991 abandoned their claim of governing mainland China, stating that they do not 'dispute the fact that the P.R.C. controls mainland China.'
The first National Assembly, elected on the mainland in 1947 to carry out the duties of choosing the president and amending the constitution, was re-established on Taiwan when the KMT moved. Because it was impossible to hold subsequent elections to represent constituencies on the mainland, representatives elected in 1947-48 held these seats 'indefinitely.' In June l990, however, the Council of Grand Justices mandated the retirement, effective December 1991, of all remaining 'indefinitely' elected members of the National Assembly and other bodies.

The elections on March 18 will have crucial implications for the island's future, and its tense relations with China. Yao Kuei, Canada: Mr. Chao, after the presidential election, regardless of the result, do you see an increase in the division of the people on Taiwan? Can the Conflict between the mainlanders, who came to Taiwan after the civil war, and the native Taiwanese be resolved? Dr. Chao Yi: In fact, President Lee Teng-hui has proposed the concept of "new Taiwanese," which encourages people of every ethnic group to look toward the future, identify with Taiwan, and co-operate with each other, while remembering the lessons of history. Thus, no matter who came to Taiwan earlier, everyone should concurrently consider themselves Taiwanese and Chinese. This is the concept of being a part of the same organic body. Frankly speaking, after decades of intermarriage and assimilation, it is difficult to tell the difference between "native Taiwanese" and "mainlanders." I sincerely believe that social and democratic forces will help to reduce or eliminate questions of ethnic differences. I am very optimistic that we can achieve this result.
