By Prof. Chen Lung-chu et al This article is an open letter from Chen Lung-chu, president and CEO of the Taiwan New Century Foundation, Huang Chao-tang, a presidential advisor and chairman of World United Formosans for Independence, Yao Chia-wen, former chairman of the DPP and currently a senior adviser to the president, Chen Li-tung; Hung Mao-hsiung, an international relations graduate research fellow at National Chengchi University, Yang Chi-chuan, Hsu Shih-kai, an author, and Liao Fu-te, an assistant research fellow of the Institute of European and American Studies at Academia Sinica. The Taiwan New Century Foundation, the Taiwan National Security Institute, the Taiwan Care Foundation and the International Cultural Foundation held a joint seminar on 23 September 2001 to mark the 50th anniversary of the San Francisco Peace Treaty. After vigorous and comprehensive discussion, the scholars and experts arrived at a number of conclusions. We are of the unequivocal opinion that Taiwan is an independent sovereign state, and hereby publicly demand that the people and the government of Taiwan adopt the necessary measures to guarantee Taiwan's international status.

Taiwan government addresses China's 'anti-separation law'
On December 29, 2004, in a plenary meeting during the Thirteenth Session of the 10th PRC National People's Congress (NPC), the NPC Standing Committee approved the "anti-separation law" draft bill. The bill will be submitted to the NPC in March for further deliberation and passage. In a statement dated February 1, 2005, Taiwan's Mainland Affairs Council, Executive Yuan published a statement regarding contents and implications of this bill. A summary of that statement follows:
As of February 1, 2005, the government of China has not presented any concrete details or text of the "anti-separation law" draft bill, which leads to the assumption that Communist authorities are observing external reactions to the proposed law and will consider these reactions when drafting the final version of the bill. However, judging from comments by Chinese officials, we believe that the bill has been drafted within the framework of the PRC constitution under the principles of "peaceful unification" and "one country, two systems," in strict adherence to the so-called "one China" principle.
It is likely that the specific contents of this bill will present "unification" as the only valid option in cross-Strait relations. It will also probably define the scope of "anti-separatist" activities and explicitly stipulate which actions and conditions constitute de facto independence and thus separation from China. The law would also enforce legal responsibility and punishment for such actions. In short, the law can be seen as legalizing war against Taiwan, at the same time defining the "Taiwan problem" as an internal affair that no external force should interfere with.

Halting the construction of NPP4 is the first step to curtailing nuclear exportation in Asia. It is about choosing an alternative model of political and economic development. This demonstrates the waves that mainland businesses are making with their buying spree even on the de facto independent island which is still trying to shut them out. According to Taiwan government officials, Lenovo has applied for and will be granted approval to convert into a subsidiary a one-man company which was registered in Taipei more than three years ago and did not have any legal links to Lenovo. The Chinese company had made the move to “legalise its presence here” on the occasion of transferring the PC business of IBM Taiwan to Lenovo, said a senior official at the Mainland Affairs Council, Taipei's cabinet-level China policy body. The Taiwan government still clings to a ban on mainland investments on the island for the fear that its politically hostile neighbour could take control of its economy. Legislation passed two years ago allows Chinese companies to invest in Taiwan in principle, but the government does not intend to pass detailed regulations any time soon which would allow an overall opening in practice.

The Nationalist Party was unseated from the presidency by Chen Shui-bian and his Democratic Progressive Party last year. The less burdened new government has a responsibility to go a step further, and make a higher level of effort, Mr Chen said. The government will strive to reach international standards of human rights. He said efforts to move beyond the tragedy would include compensating victims, including the incident in history textbooks and opening relevant government archives. The 1947 riot erupted after the woman cigarette vendor was beaten and enraged residents chased the alcohol and tobacco monopoly inspector, who fired shots at his pursuers in panic. Records show that thousands of Taiwanese were killed in the subsequent crackdown, leaving a legacy of deep mistrust towards what was seen as an occupying Nationalist Government and the hundreds of thousands of displaced mainlanders who flooded the island.

Taiwan's two major cities, Taipei and Kaohsiung, are centrally administered municipalities. At the end of 1998, the Constitution was amended to make all counties and cities directly administered by the Executive Yuan. From 1949 until 1991, the authorities on Taiwan claimed to be the sole legitimate government of all of China, including the mainland. In keeping with that claim, when the Nationalists moved to Taiwan in 1949, they re-established the full array of central political bodies, which had existed on the mainland. While much of this structure remains in place, the authorities on Taiwan in 1991 abandoned their claim of governing mainland China, stating that they do not "dispute the fact that the P.R.C. controls mainland China."
The first National Assembly, elected on the mainland in 1947 to carry out the duties of choosing the president and amending the constitution, was re-established on Taiwan when the KMT moved. Because it was impossible to hold subsequent elections to represent constituencies on the mainland, representatives elected in 1947-48 held these seats "indefinitely." In June l990, however, the Council of Grand Justices mandated the retirement, effective December 1991, of all remaining "indefinitely" elected members of the National Assembly and other bodies.

Taiwan has yet to formally accede to the WTO's Agreement on Government Procurement (GPA) due to procedural issues, although it promised to do so in Taiwan's WTO Working Party Report. The ECCT urges Taiwan to immediately make effective dormant provisions in Taiwan's Government Procurement Law, which would prohibit exclusion of foreign firms and set offs, in order to meet its WTO Working Party Report promises. The ECCT commends Taiwan for recently passing a law encouraging private participation in infrastructure projects and, in particular, encouraging private parties to submit unsolicited proposals in order to generally improve the creativity, quality and costs of infrastructure projects. However, to be successful, improved government coordination is needed in the case of unsolicited private-entity proposals involving multiple government agencies. International experience should be utilized to assist Taiwan in planning and coordinating major projects. It is crucial at this early stage to get it right. The ECCT commends the efforts of the Public Construction Commission (PCC) to set the standards for construction, equipment procurement and service procurement contracts by creating model contracts based on the law. Adoption of the model contract legal framework sets the stage for Taiwan's system to reflect international standards and attract the full range of reputable international vendors. The PCC should be encouraged to promote more bids for large projects where 'rice' is not the sole decider, with other factors being considered in selecting the successful contractor

Taiwan government to auction 3% Chunghwa Telecom shares
TAIPEI : The Taiwanese government will auction 289.43 million shares in Chunghwa Telecom Co, or three percent of the shares outstanding, as part of official measures to privatize the island's leading telecom operator. According to the Taiwan Stock Exchange, the transportation and communications ministry, through its agent Capital Securities Corp, has applied to auction the shares in Chunghwa Telecom next Tuesday. The floor price will be set at a 6.0 percent discount to its average closing price over 10 trading sessions ahead of the auction, it said.

    China [LatelineNews: 2005-5-25] TAIPEI - The leader of Taiwan's main opposition party, Lien Chan, urged the government on Wednesday to re-open dialogue with arch-rival China, saying he found Chinese President Hu Jintao a "friendly and sincere" man to deal with. Lien made a historic trip to China in April to become the first Nationalist or Kuomintang (KMT) chief to set foot there since 1949, when the Communists toppled the KMT and forced it into exile on Taiwan. Lien and Hu ended decades of hostility between their parties, and agreed to work together to avoid war and improve trade ties. The pact put pressure on Taiwan's pro-independence President Chen Shui-bian to resume dialogue with Beijing, suspended since 1999.
