THE SITUATION IN SRI LANKA
1. International Educational Development/Humanitarian Law Project fervently hoped that the election of the Peoples' Alliance government in August 1994 and the later election of the new president of Sri Lanka would result in a viable peace process to end the 40 year oppression of the Tamil people and their justifiable armed resistance. We applauded the Peoples' Alliance platform, clearly supported by the majority of the Sinhala people of Sri Lanka, in which a commitment to the peace process was fundamental. During her successful campaign candidate Chandrika Kumaratunga proclaimed that her first priority was to restore peace. Following her election, a Sinhala from Sri Lanka and a long-time friend of our organization hand-delivered a letter from our UN chief representative to President Kumaratunga in support of the peace process. 4. A climate of increasing apprehension by the Tamil people led to out and out disillusionment when several offers of the LTTE leadership for a federal-type political structure were met with silence from the Sri Lankan government. With no proposal on the table from the government and with failure to carry out main components of the cessation of hostilities agreement, the LTTE leadership issued notice in mid-March that without urgent action to address some of these problem areas, the LTTE would consider the cessation of hostilities to have expired. The LTTE gave a two-week deadline, later extended by another three weeks. Because there was still no effective response from the Sri Lankan government, the LTTE considered the cessation of hostilities agreement expired as of April 19. Armed conflict between the Sri Lankan armed forces and the LTTE and Tamil people commenced when the Sea Tigers sank two naval gunboats in Trincomalee harbour.

In mid-2004, the cease-fire agreement was threatened by a split within the LTTE. Vinayagamoorthy Muralitharan, the eastern commander, broke away from the main faction on March 3, 2004, citing poor treatment of eastern Tamils in the group. Heavy fighting between the two factions erupted along the Verugal River in early April, the first fighting since the 2002 ceasefire. The eastern group was defeated by the main faction but Muralitharan escaped and went underground, continuing attacks on the mainstream group. The situation was intensified by the death of Vinayakamoorthy Sivanesadurai, the older brother of Muralitharan, on September 23 during a gunfight in Karathiyanaru. Hours later, Somasundaram Varnakulasingham, a member of Eelam’s People’s Democratic Party, an opponent of the LTTE, was killed in Colombo by unidentified gunmen. The killings and acts of violence escalated in the following months. In December 2004, the situation deteriorated further when the leader of the LTTE, Velupillai Prabhakaran, reiterated the demand of self-rule for the Tamils in northeast Sri Lanka. There has not been a declaration of war yet; rather, the LTTE has been involved in several acts of civil disobedience. Analysts believe that the threats are just meant to force the government to negotiate, as a civil war would hurt the LTTE economically. Since the cease-fire, the LTTE has been rebuilding Kilinochchi, their administrative capital, and have invested in several businesses.

In political terms, of course, the Tamils of Sri Lanka are Sri Lankans and the Indians of Fiji are Fijians. But if that were truly so, there would be no battles. The Indian identity, linked in core terms around religion and culture, is at the center of the conflict. On a recent visit to Colombo, Sri Lanka, a taxi driver asked me where I was from. India? Where? Bengal, Calcutta, yes, but are you Hindu? The answer Hindu immediately put me in the enemy camp. The driver did not speak to me again. In its most stark terms, the fight in northern Sri Lanka is a fight between Tamil culture and Sinhalese culture, cultures whose principal difference is religion. The Tamils are Hindus and the Sinhalese are Buddhists. This puts India in a dilemma should it back Sri Lanka's government because it is a friendly neighbor, or support the separatist rebel Tamils, who have ethnic, religious, cultural and linguistic links with one of India's southern states, Tamil Nadu? Such links cannot be discounted by saying they are with but one region of India. Any segment is part of the whole of India. To choose not to support the Tamils in Sri Lanka because Tamils are only one ethnic group in India, and predominant in only one state, is to alienate one's own population and invite secession.

Sri Lanka: Conflict
The country has enjoyed nearly three years of peace following two decades of bloody war between the Sri Lankan government, representing the Sinhala majority, and the LTTE, who were fighting for a separate Tamil Elam state. Nearly 60,000 people were killed during the war while nearly 600,000 were displaced to refugee camps in India and southern parts of Sri Lanka.
The present peace was secured by a Ceasefire Agreement signed between the participants in early 2002. However, after 6 rounds of discussions held around the world under Norwegian mediation, peace talks were deferred as squabbling politicians fought a general election in April 2004. The devastating tsunami that struck the coasts of Sri Lanka in December 2004 has left the peace process even more fragile, with disputes over the distribution of aid aggravated by the government’s insistence on centralised decision-making. Nevertheless, pressure from donors to seek a solution in parallel with reconstruction will be overwhelming in the post-tsunami period.
