Special Needs Children: Pulling Your Child Out of School
By Linda J. Conrad Jansen, Esq. Jennifer* (name and some facts changed to protect her privacy) was enrolled in a school that decided that she needed special education services. The school staff was abusive to her and her parents tried to pull her out of school. Jennifer was denied admission into the public school homeschooling program, charter school programs were unavailable, and her parents decided to homeschool her using the private school option. They filed an R-4 with the county, and the county rejected it, stating that they were not eligible to homeschool their child because she was subject to an IEP (Individualized Education Program) and she was required to be enrolled in the public school to receive the "free appropriate public education" they were providing her. Jennifer's family is homeschooling their children, after filing the R-4 with the state. HSC wrote a letter to the office of education, and the family is prepared to enforce for their right to homeschool their special needs child. Often, administrators are bluffing, or just do not know the law. It is important that you know your rights so you can provide the best educational alternative for your children. Between 300,000 and 1.23 million students in the United States are being home schooled (Lines, 1991; Ray, 1997). According to the U.S. Department of Education, the typical home schooling family is white, has two parents at home, is of above average income and education, and Protestant (Lines, 1991). The average number of children is three, and the mother, regardless of her own level of education, is the primary instructor. Although this description reflects the typical home schooling family, it is not 100 percent representative of the entire home schooling population. It is important to recognize that current home schooling families include single parent families as well as all races, income levels, and religions.
Home Schooling Options Available to Special-Needs Children
The models that I describe in subsequent sections of this article represent some of the options available to parents who choose to educate their children with special needs at home. Information was gathered through interviews with both public and private educators who consult with home schooling families: a private consultant, a special-needs consultant in a legal defense organization, the "director" of a home school with expertise in special education, and the coordinator of a home instruction program for a public school district.

Homeschooled Children with Special Needs I occasionally write about parents who choose to educate their children at home. Critics of homeschoolers sometimes note that parents sacrifice a rewarding career for themselves by staying home to educate their children. Still others might think that it's impossible for one or two adults to teach children enough about all the subjects to insure their success in college and careers. The following letter is from a man who, with his wife, has educated several natural and adopted children at home, including several children with special needs. He tells readers how they have equipped their children for independent, successful lives on their own. Dear Beth, My wife, like many other women, is now into her second (or is it third?) career. She just completed a Masters in Special Education with a 3.95 cumulative grade-point average while homeschooling and running a foster home for premature, medically complex infants for the state of Connecticut. We were two of the 1,000 parents that home schooled our children in Maine in 1992. There are 4,000 today. We now live in Connecticut where statistics are more hidden, but we belong to a support group of nearly 100. Our first five children attended public schools. I then realized I could do no worse. Our oldest daughter had a 140 tested I.Q. and completed elementary school in 7 years and high school in 3. She had horrible experiences. We also had children at the opposite end of the spectrum with 75 I.Q.s and IEPs in Special Ed. They each received an equally poor education.

Home Tuition Service
Home Tuition is available for school age children with a variety of medical problems, who are consequently unable to attend their mainstream school. Support is also provided for pupils excluded from school. Who Authorises Home Tuition? A referral for home tuition must be authorised by the appropriate member(s) of the Health Authority. This would usually be the senior clinical medical officer or consultant paediatrician. A request from a GP is not regarded as sufficient grounds for home tuition to be authorised. Excluded pupils are referred by an education officer (schools) or the moderating panel of the LEA. When Home Tuition has been agreed for a pupil with medical needs a home tutor is appointed to work with the child. It is the home school's responsibility to provide work at the appropriate National Curriculum level for the child. At key stages 1 and 2 the child's class teacher usually takes this responsibility and liaises with the home tutor. At key stage 3, a head of year or special needs co-ordinator is usually asked to take responsibility for obtaining work from subject teachers and liaising with the home tutor. By September 2002 every school should have appointed a teacher with responsibility for pupils with medical needs who will liaise with the home tutors.

Home School: Another Learning Environment for Special Children from Summer 2000 Adoptalk by Cyndie Odya Weis Cyndie Odya-Weis is a freelance writer who specializes in family, educational, and spiritual issues, and an adoptive mom to twin teenage daughters from Korea and a biracial 10-year-old son adopted domestically. She taught in public and private schools before embarking on 25 years of work with adoptive, foster, and other families. When John and Holiday Hays decided to home school their eight adopted children, the decision was based in part on practicality. "Six of the eight have special needs, and the bus ride to their school would have been more than an hour," says John of rural Bearville, Minnesota. Add to that the countless meetings they would have needed to attend to deal with educational and behavioral issues, and they decided it would make more sense to instruct their children at home. They would be able to pack instruction into every one of the limited "high attention" moments special needs kids have, they reasoned. For the Hays family, and many other families, home schooling is a viable and positive alternative to public or private schools.
