FIFTY YEARS AFTER BROWN V. BOARD OF EDUCATION Publication Link A complete copy of the research publication, "And Miles to Go Before I Sleep," a research project of the Institute for Public Service and Policy Research on the status of African-Americans in South Carolina, fifty years after Brown v. Board of Education, is available through this link. Executive Summary On May 17, 1954, the United States Supreme Court issued a decision in Brown v. Board of Education that declared separate schools for whites and blacks were inherently unequal and, therefore, unconstitutional. The impact of this decision went far beyond education and coincided with the civil rights movement in the mid-1950's and 1960's. To observe the fifty-year anniversary of this momentous decision, the Institute for Public Service and Policy Research at the University of South Carolina plans to conduct research and develop policy recommendations related to the current status of African Americans in South Carolina.

Brown v. Board of Education
Background On May 17, 1954, U.S. Supreme Court Justice Earl Warren delivered the unanimous ruling in the landmark civil rights case Brown v. Board of Education of Topeka, Kansas . State-sanctioned segregation of public schools was a violation of the 14th Amendment and was therefore unconstitutional. This historic decision marked the end of the "separate but equal" precedent set by the Supreme Court nearly 60 years earlier and served as a catalyst for the expanding civil rights movement during the decade of the 1950s. By the late 1800s, segregation laws became almost universal in the South where previous legislation and amendments were, for all practical purposes, ignored. The races were separated in schools, in restaurants, in restrooms, on public transportation, and even in voting and holding office. In 1896 the Supreme Court upheld the lower courts' decision in the case of

    Five cases from Delaware, Kansas, Washington, D.C., South Carolina and Virginia were appealed to the United States Supreme Court when none of the cases was successful in the lower courts. The Supreme Court combined these cases into a single case which eventually became Brown v. Board of Education . The following summarizes the South Carolina case.
    Overview
    Twenty African Americans from Clarendon County, South Carolina first filed a suit in 1951 against school officials on behalf of their children. With the help of the NAACP, they sought to secure better schools, equal to those provided for white children. The U.S. District Court found the black schools were clearly inferior compared to white schools: buildings were no more than wooden shacks, transportation and educational provisions did not meet basic needs, and teachers' salaries were less than those received in white schools. Further, the lower court "...ordered the defendants to immediately equalize the facilities...[but the children were] denied admission to the white schools during the equalization program." As a result their case was appealed to the U.S. Supreme Court.
    Discussion
    The legal action in Summerton, South Carolina began in 1947. Ironically the push to take action derived from a fortuitous encounter between Rev. James Hinton, president of the South Carolina NAACP and Rev. J.A. DeLaine a local school teacher. The NAACP leader, through a speech attended by DeLaine, issued a challenge to find the courage to test the legality of the discriminatory practices aimed at African American school children.

    About The Case
    The 1954 United States Supreme Court decision in Oliver L. Brown et.al. v. the Board of Education of Topeka (KS) et.al. is among the most significant judicial turning points in the development of our country. Originally led by Charles H. Houston, and later Thurgood Marshall and a formidable legal team, it dismantled the legal basis for racial segregation in schools and other public facilities. By declaring that the discriminatory nature of racial segregation ... "violates the 14th amendment to the U.S. Constitution, which guarantees all citizens equal protection of the laws," Brown v. Board of Education laid the foundation for shaping future national and international policies regarding human rights. Brown v. Board of Education was not simply about children and education. The laws and policies struck down by this court decision were products of the human tendencies to prejudge, discriminate against, and stereotype other people by their ethnic, religious, physical, or cultural characteristics. Ending this behavior as a legal practice caused far reaching social and ideological implications, which continue to be felt throughout our country. The Brown decision inspired and galvanized human rights struggles across the country and around the world.

    (May 22, 1997) Notwithstanding the apology by Dr. Henry Jordan, a member of the South Carolina Board of Education, for his proposal to "screw theBuddhists and kill the Muslims" rather than consider their objections to placing the Ten Commandments in South Carolina's public school classrooms, the American Jewish Congress today declared that official classroom display of the Commandments "is inherently divisive and exclusionary even if its advocates are usually more circumspect than Dr. Jordan in advancing their cause." "No amount of careful speech nor polite wording can hide the inevitable message the official display of the Commandments sends that those who believe in them enjoy a favored position and those who do not are second class citizens," said AJCongress Executive Director Phil Baum in a statement. The display has also been declared unconstitutional by the U.S. Supreme Court. Baum noted the similarity of Dr. Jordan's comment, "This nation was founded to worship, honor and glorify Jesus Christ, not Mohammed, not Buddha," to the claim of Alabama Judge Roy Moore defending his courtroom display of the Commandments that his "duty under the Constitution is to acknowledge the Judeo- Christian god, not the gods of other faiths. We are not a nation founded upon the Hindu god or Buddha," Judge Moore said.

It also focuses on methods of evaluating the functions of these systems and on the selection and application of appropriate therapeutic interventions to alleviate pain; to maintain, improve, or restore function; and to prevent dysfunction. The Profession Physical therapists are specialists in evaluating and treating disorders of the human body by using physical means rather than drugs. They are legally and ethically responsible for planning, implementing and evaluating a physical therapy program. This responsibility often includes instructing patients and their families and supervising physical therapist assistants, physical therapy aides, students, and other healthcare workers in carrying out the program or selected parts of it.
