The petitioner has filed a petition and affidavit in support claiming that her rights under S.14 of Schedule 7, Part III of the Constitution has been infringed. The respondents have filed a defence and an affidavit in reply. A motion to amend the petition was allowed by the majority judgment of this court. The application which remains before this court is therefore by virtue of the original petition as filed.

Bird conservation
The NPTS works to conserve bird species in Seychelles through the following projects:
Roche Caiman Bird Sanctuary
The establishment and management of the Roche Caiman Bird Sanctuary was the first project undertaken by the NPTS. In 1986, 4km of coral reef were dredged on the east coast of Mahe and used to create a large area of land. While this reclamation destroyed a considerable area of living coral it inadvertently created an area of habitat that is rare in Seychelles. The settlement pond used during dredging remained as a depression in the coral rubble and partly filled with water at the start of 1987. This coincided with the presence of migratory shorebirds in the region and the open area of shallow water attracted unexpectedly large numbers of birds. In 1991 plans were made to fill in the settlement pond with rubbish and coral. A campaign was launched to save the small wetland and protect it as an important site for migratory birds. This campaign was successful and 29,000m of the area were set aside as a reserve in 1992. From that date until 2001 management of the Roche Caiman Bird Sanctuary was the responsibility of NPTS and the Seychelles Government. NPTS passed full management responsibility for the Bird Sanctuary to the Seychelles Government in 2001.

Seychelles's Torches Turtle Shell Stockpile at Miss World 1998 Contest : In a press release, the Government of the Seychelles reported today that in front of the world press and the contestants of the Miss World 1998 Pageant it has burned all the turtle shell it had collected from artisans four years ago when it banned sea turtle exploitation. The Seychelles has a tradition of sea turtle exploitation, but in recent years the Seychelles Government has acted to protect the animals. The shell stockpile, weighing 2.5 tonnes, represents the shell of approximately 3,300 highly endangered sea turtles. It has been in storage on Mahe since July 1994 when it was acquired from local tortoiseshell artisans. The shell was prized for its use in making everything from collector's cigarette boxes to frames of designer glasses. The press release quotes Maurice Loustau-Lalanne, Principal Secretary in the Ministry of Environment, as saying: "The stock we have burned today represents about US$115,000. The artisans have been compensated with Seychelles Government funds as well as funds provided by the Global Environment Facility administered by the World Bank. Our actions today put paid to an aspect of our people's cultural past and sets a firm course for Seychelles to be the leader in environment conservation. We wish through today's event to send out this important message to the world."

Editors’ note: The term terrapin in this article applies to a freshwater turtle. Turtles of the genus Pelusios are commonly called African side-necked mud turtles. The Seychelles islands support three native taxa of freshwater turtle, two are endemic subspecies of African species ( Pelusios subniger parietalis and P. castanoides intergularis ) and the third a full endemic species ( P. seychellensis ). Both P. s. parietalis and P. c. intergularis are well-known and well-defined taxa, but P. seychellensis is very poorly known (being recognised from only three museum specimens collected in 1894). P. seychellensis appears to intergrade with P. c. intergularis , and continued taxonomic research may now suggest that the two form a hybrid complex, with P. seychellensis being extinct in a pure form. Of the two definitely extant subspecies, P. s. parietalis

1998 data The Seychelles islands, that lie 5 degrees south of the equator in the Indian Ocean, were discovered by the Portuguese. They were occupied by pirates until the French took over in the 18th century and then by the British in the 19th until 1976, when they became independent. The beaches are beautiful with huge boulders breaking the monotony of flat expanses of sand. The Seychelles deserve their reputation for beauty but they are so expensive that I really cannot recommend them to shoestring travellers who don't care for the snob value of "having been to the Seychelles". CIA Country Reports Lonely Planet Traveldocs
The Seychelles offer fewer underwater diving sites than the Maldives but they are said to be just as beautiful. I did not verify that because the cheapest rate I found was 60 $US per dive, more that twice what I paid in the Maldives and four times the rate in Sri Lanka
