The Nonprofit Risk Management Center receives many questions concerning the screening of staff and volunteers using criminal history record checks. Criminal history record checks are important risk management tools but must not replace other risk management strategies designed to lessen the opportunity for abuse of vulnerable service recipients. No background check is perfect and the fact that an applicant appears to have a clean record is not predictive of future behavior.
The following are some of the more frequently asked questions concerning criminal history record checks.
Q: Are we required to conduct criminal history record checks?
A: The answer to this question depends upon the nature of the services you offer and the jurisdiction in which you offer them. For most nonprofit organizations offering services to children, dependent elderly or people with disabilities, the answer is that there are no legal requirements for you to conduct criminal history record checks. The usual exceptions to this are services for which licenses are required. For example, childcare programs licensed by the state may be required to conduct criminal history record checks on their staff.

Megan's law was named after a New Jersey girl named Megan Kanka who was raped and killed by a known child molester who moved in next door to her family's home. In the wake of this tragedy, local jurisdictions sought to develop a way to inform the public about sex offenders in their community. A sex offender registry provides information to the public about convicted sex offenders who live, work, or visit their respective communities. Since the passage of Megan's law, each state has adopted their own system of implementing and updating their sex offender registry. While the sex offender registry laws in each state are slightly unique, many features of state registries hold true for most or all systems. There are currently almost 550,000 convicted offenders registered on a local sex offender registry nationwide. By law, individuals who have been convicted of certain sex crimes must provide personal information for sex offender registry inclusion in the community where they live or work. There are a number of criminal convictions that are considered sex crimes which require inclusion in a sex offender registry. These may include, but are not limited to: rape, sexual assault, kidnapping, child pornography, incest, sexual abuse, involvement in the prostitution of a minor, and more. Before a convicted sex offender is released from prison, jail, or a mental hospital, they are informed of their compulsory duty to provide information to the sex offender registry.

That's because the online registry of Florida's 35,000 sex offenders does not provide details about their crimes. The registry also doesn't give the age and gender of the offender's victim, even though the agency has that information. Nor does it give the date and place of the offender's conviction, or occupation and place of employment. For offenders like Persichini, these pieces of information could erase a stigma that lumps him with people like Irizarry. "It's pure hell," said Persichini, 43, a stock trader. "People instantly assume you're a pedophile."
